Complaint Details:I purchased a pre-owned forklift from Discount Forklift and received the unit on [insert date]. Upon delivery, I discovered that the forklift was governed through the computer system and would not exceed approximately 2 mph. This limitation makes the forklift virtually unusable for our business operations, as it moves slower than walking speed and significantly reduces efficiency.This critical modification was never disclosed during the sales process. I was promised a demonstration video of the unit running post-service, which I never received. I trusted the word of the salesperson, ****** *******, and unfortunately did not push for the videoclearly a mistake.When I raised the issue, both ****** ******* and ***** ****** informed me the unit was sold as-is, and the problem was mine to resolve. I understand what as-is means when it comes to physical condition, but this was an undisclosed software limitation that was known to Discount Forklift prior to sale. ***** ****** even confirmed that correcting the issue would require a dealership technician to reprogram the lift, and the cost is exactly why they dont perform this fix before sale.I feel misled and taken advantage of. I was not given the opportunity to make a fully informed decision due to the lack of transparency. The customer did receive their quality control video on 5/30/25 at 11:52AM mountain time from [email protected]. There is electronic records of this email being sent, both from the email account and from the system that sends the email. The customer has chosen not to acknowledge their receipt of this email. As for the governed speed. It is not possible for Discount Forklift to anticipate the needs of every customer as it comes to speed of a forklift. More customers prefer slower speeds to faster speeds. OSHA actually recommends that the fastest driving speed is at the pace of a brisk walking speed. Being able to walk faster than a forklift travels is completely normal. Add to that the nature of the proprietary software used by forklift manufacturers, Discount Forklift cannot change the governed speed. The customer also acknowledge the opportunity to view the equipment in person, or by a trusted third party, which they declined to do so.
The unit was sold, and delivered, in the pre-owned, 'Rental Ready', As-Is condition in which is was promised.

I am rejecting this response because:The use of this lift was known and well known all the time to be used outside on the lot of our RV dealership. Looking for the most favorable opinion of OSHA is always a possibility but does not apply to our application that was clearly stated this was being bought for. I am not disputing the condition of this Forklift rather a modification that was hidden intentionally and not disclosed. I would have no inclination that this lift had been modified or reason to think so if not disclosed. This modification limits the use and makes it useless for our application that they knew it was being purchased for. I understand I signed for the condition of the forklift, but this does not fall under the definition of condition. See below the legal definition

Under UCC § 2-316 and case law, “as-is” can waive implied warranties, but it does not protect a seller who fails to disclose known defects or material alterations.
California and Many Other States:
If you knowingly withhold info about a significant modification, it can be construed as fraudulent concealment, even if sold as-is.
I don’t know how many more times I can state this or prove it any further. Obviously, this company does business in an unscrupulous manner. I will never conduct a business with them again. I will be seeking further legal action.

I am filing this complaint to address deceptive practices by Discountforklift regarding their financing advertising and loan payment terms.Discountforklift uses misleading advertising to lure customers into applying for credit. They prominently advertise affordable loan payments on their website to attract buyers, but do not provide crucial information about the actual financing terms until after they secure a down ********** my experience, Discountforklift did not disclose the total cost or actual payment terms before requesting my down payment. After I made the payment, they informed me of financing terms that were significantly different from what they advertised. Upon attempting to request a refund due to this misrepresentation, I was informed that my down payment was non-refundable.Discountforklifts website does not include a disclaimer about these terms, nor do they provide clear, upfront information to potential customers. Their tactics are misleading and cost me both time and money that I cannot recover. The customer had two chief complaints:
1.) There was a misrepresentation of the financing terms.
&
2.)They were not informed that their down payment was not refundable.
As to their first complaint, in the screen shot that the customer provided you will find the term 'with Approved Credit" used. Third-party financing institutions are used for the purchase of equipment. There are many factors that can lead a customer to receive less favorable terms made available to them. All of these factors are outside of the control of Discount Forklift.
As to the complaint of not being informed of the non-refundable nature of the down payment, attached you will find the Panda Doc that the customer acknowledged and signed, affirming they had read and agreed to Discount Forklift's "Terms and Conditions of Sale". Line 10 of the used equipment portion of the terms and conditions states: 10. Payment remittance, down payment or payment in full constitutes acceptance of invoice and these terms and conditions. Down payment or payment in full are nonrefundable. It was made clear to the customer, prior to any monetary exchange, that the down payment was non-refundable.
The down payment is held in an indefinite credit on account. It can be used for future purchases, rentals, or parts & accessory purchases. For additional concerns, please reach out to ******************************************************************. Thank you!

I purchased this scissor lift in August. The machine only worked for 4 months. We have emailed and called the company to get it fixed, but they haven't fixed anything.It is hard to get a hold of them, and when we do, we are told they are going to fix it, and it's been 6 months and nothing has been resolved. I am rejecting this response because:When purchasing this item, we were never informed that the company whom we purchased from wouldn't be responsible for any defects. When we spoke to a representative from Discount Forklift, they said that we could hire a mechanic and they would pay for the mechanic and send the damaged parts. After we hired the mechanic, we never heard back from Discount Forklift.
We should be responsible for dealing with another company because we purchased this item from Discount Forklift.

On dec 24th I was looking online for a forklift for my business and, came across their ad and began looking , with a set budget. they had a lift advertised at 440 a mo, that was in my budget area. so we bagan to talk it out. i wanted to finance it and that wasnt a problem. my credit was great and all my business information in order. They sent me a credit app and i filled it out. when ii sent it to discount forklift they said we need to **llect the 10% down payment. I said why? I still hadnt heard from the finance ** yet. they told me they **llect the down payment so they have it when it clears and then its an easy transaction. Okay, whatever I gave them the **** down. this went on for days, the finance ** started pulling hard pulls on my personal credit, serveral of them. Then they called and told me they had to have 35% down. and they used factoring in lew of percentage rate. but it came to over 65 thousand dollars for a 16 thousand dollar lift. as this was going on they called and said that lift was no longer available it had motor issues. That I need to pick a different lift. they were all way more expensive, now any invoice i signed before this was now DEAD. they killed it. at this time my down payment should have **me back to me. they held it and asked if they **uld run it thru another bank. i told them It dont matter, im not sure i can afford a more expesive lift that past place was trying to rob me ! he assured me thisi other bank was better. They ran it to them, well guess what, they not only told me my credit had been hit alot yeah, the last place did all of that, and my business wasnt aged enough. then why you hard pull my persoanal credit with a hard pull, we always do that, and now we need 40% down PLUS a first and last months payment . WHAT? *** never heard of anything like that before. aboslutely not. I walked from any deal with them , Now they say they are KEEPING my downpayment! thats theft.Business Response

I understand and appreciate that you and your start-up company are running on such a tight budget. The original unit you selected was not taken from you, however, your Match Maker did suggest finding a different unit because he was aware that your purchase was time sensitive, and after your purchase it was discovered that several repairs were going to be needed to get the machine to the ************ standard we sold you the machine in. Other options were presented to assist you in getting a machine in a timelier manner and you chose a replacement machine.
The payment amounts on our quotes are for example purposes only and are with approved credit. Financing is done through third party banks so payment amounts will vary depending on terms and personal credit.
Prior to your purchase you read and acknowledged both our Expectations Letterand Terms and Conditions of Sale. Our Terms and Conditions of Sale very clearly states that down payments are non-refundable: 10. Payment remittance, down payment of payment in full constitutes acceptance of invoice and these terms and conditions. Down payment or payment in full are nonrefundable. You were approved for financing on the machine and turned down that financing due to the terms offered to you based on your credit worthiness.
As I told you previously, your down payment is not lost. It will remain in a credit on account for your future use. It may be used as payment towards a future equipment purchase, rental, or for the purchase of parts and accessories through our ********** Headquarters parts department. I have contacted **************** and the charge was reversed , as they are now asking discount forklift to refund the money, as under feral law and the fair credit act, and trade acts, if you order any good or service online, using a credit card and the goods never are received or even left the ************* of business, at no fault of the customer, as this company could not ***** the orignal sale invoice. They closed that invoice in which I paid a 10% down payment. that made that invoice null and void, this company then went into a whole seperate sales pitch I could not get qualified for , even the finance company wanted a whole NEW down payment of 40% which i could not afford, they were all along going to finance the forklift for 100% to the forklift company. they never should have asked me for the 10% down payment. This whole deal was shady at best. and my 10% down should have been refunded to me or at least to the credit card comany as soon as the forklift company could not fullfiil their end of the sale. that deal fell apart bacause the could not send the forklift. that invoice was null and voided by them .Initial Complaint

I have been trying to resolve an ongoing issue with Discount Forklift since I purchased the Anastasia ********************** on February 18, 2022. However, after several attempts and back & forth with management (644 days to be exact).The first week I received my forklift the check engine light came on, a had a small leak and the gear was slipping. I received the forklift on February 22, 2022, and I immediately called and emailed them of the issues that I was experiencing with the forklift. I spoke to *****************************, *********************, and *********************** and after that ********************* reached back to say he apologized, and he would send a technician out right away. A technician named ****** came out and inspected and serviced the forklift. During his service appointment he said a part needed to be ordered (directional leveler). That never happened. Months went by and my phone calls and emails stopped being answered. I then made a YELP review and reported Discount Forklift to BBB and then I received a call and email from Discount Forklift Manager *********************. Mr. ********************* stated that he would get this situation handled on April 5, 2023. ********************* previously said he would be the point of contact and get my forklift taken care of. Then he said he was too busy, on vacation and just felt that he didnt owe me any explanation. With the assistance of *********************, the replacement part was ordered April 11, 2023, ****** the service technician would contact us for installation, and we would receive $2,000 on a future purchase. On August 1, 2023, I reached out to Discount Forklift Shortly again because we still have not be contacted by anyone. An email came through from ********************* saying ordered. Shortly after that the part was mailed to us with no instructions. Again, I reached out to all parties involved and was contacted again by ********************* stating that he apologies he thought everything was handled 11/7/2023. 1) We purchased a forklift for the price the of $24,225. The price I was told to write down was $23,900.00. At the last minute during invoicing it changed. That was supposed to be our savings. That was a lie. Had the salesman measure two different lifts to ensure we were purchasing the correct one as they stood side by side(I was on the phone). Decided on a purchase that transacted from my bank at 4:45pm. 2) The very next day I had the hardest time even getting customer service to return a call or email. It was quoted as next day they start the delivery process. Come to find out it is now on a rental use. So a customer can make a purchase that is ready, make the purchase and then send that out the next day for rental. That is a double dip (this is quoted in other reports as well). 3) We decided we no longer wanted to do business with this group. Many times they have told me in writing, "to have my attorney send a demand letter, you are not thinking clearly, you have contacted so my companies you have us confused." This went on and one into an escalation. I finally told them that if someone does not want to do business then give them their money back and move on. 4) Here is the problem with that. They have a clause that it is the same day refund. How exactly does that work when you pay at 4:45pm and you cannot get any to contact you until 3pm the next day? It does not. What happens then? They get to keep your money because the lift they wanted got screwed up while someone made a purchase and used that same one to send out the next day. Definitely not the one I want. 5) This customer service record and the way the customers are handled and belittled upon are way beyond belief. At one time even adding an attorney and half of his working staff to the email group and involving multiple layers of arrogance against someone simply trying to get a refund the next few business hours into the next day. I am rejecting this response because: This response overlaps into the next day. It does state that they can rent them out but that was not what the salesman told me. He told me we get them ready for shipment the next day if they are purchased. So we purchased late in the day and there is a disclaimer stating the they give full refunds if done in the same business day. **************** never responded to return my call or email until the next day at 3pm. Their disclaimer does not state that if you want a refund the next day unless no one contacts you back then they get to keep your money. It sounds more like fraud. Even if you purchased in early in the morning and customer service did connect back with you until the next day then it sounds more like a scheme to divert and keep customers money by intentional not connecting with the them until overnight and into the forwarding morning. That is a scheme if I ever heard one. Also, and by the time this information was passed they obviously already had it out for rent. I did not want anything that would be rented out if I purchased it. That is exactly why I asked. Now they have added a credit (we do not want one) but I am not allowed to come to the store and pick out one. This is another diversion to keep customer money. It is plain, simple and ******* clear to me.

2/23/23 - Invoice #****** paid $27,805 for a **** forklift, which was defective. The company offered to swap the defective forklift on a new lift. 3/21/23 - Invoice ****** $23,998 for Ekko walkie stacker reach. The freight for the return of the defective unit should be removed as per the company, they picked up the defective item at the same time as delivery.Company said they would issue a refund for the difference in equipment. Despite numerous attempts, to date the company has not issued the refund. We have been told several times that the refund was approved and was waiting on the accounting department. Our non-profit purchased a forklift from Discount forklift. Shortly after purchasing the forklift, we began to experience mechanical problems. Discount forklift sent out a technician which stated that he believed that the shift leveler needed to be replaced. This was causing the forklift to turn off during operation. We were told by the technician that the part would be ordered, and we would be notified when the part was ready. On 03/02/2022 ********************* responded to me via email that he would order the part. We have not been contacted since. Throughout the months we have tried to contact ***, only being able to get him on the phone once and that was in February 2023. He told me he would look into it and reach back out. I am still awaiting that call. When he didn't reach out, I called and received a cell number for ****** that worked there. He stated that he couldn't find any orders for our forklift, and he would have Ric contact us back. Again, I am still waiting for that call. I purchased a used forklift from this company, the total including the charger amounted to about $30,000 They sent us the wrong charger, and while they did in fact send us a new charger, we incurred significant expenses for the initial installation that was completely wasted. Additionally, getting the new charger took over 2 weeks, leaving us without a forklift for an entire month. I requested compensation, the company completely rejected any form of a refund with no attempt at negotiating. In my opinion, their handling of the situation is very unfair, and I would not recommend anybody purchase from them. --------------On December 9th, I entered into a sales agreement and put a deposit down On December 23rd, I completed the remainder of the payment On December 30th, we received the forklift + charger On January 6th, we paid $3700 for an electrician to professionally install the charger. This required running cables and renting a scissor lift. On January 9th we emailed the company as the charger would not work. They confirmed the wrong charger had been sent, and would send us the correct one. On January 13th we follow up about the charger, they say they will let us know On January 18th we follow up on the charger, no response On January 20th we follow up on the charger, no response On January 23rd we follow up on the charger, they say they're "looking for the tracking information" On January 24th I have a call, they confirm they "messed up and forgot to ship it", and immediately ship it that day. On January 26th we receive the charger and have to pay for installation again. This is a completely different set up, so the previous $3700 paid was all for nothing. On January 27th, I emailed them asking to get refunded for the $3700 we spent due to their error, as well as $1800 for the 3 weeks we didn't have a working forklift due to their error. Discount Forklift is a scam. How many horrible BBB reviews can one company obtain! We put a deposit on a machine we were told we would have delivered within two weeks. After dozens of calls and emails to check in we had no real update at 5 weeks! We were lied to multiple times and told a different excuse each time we called. I have requested a refund of the deposit multiple times due to the shady treatment we have experienced, well before we even received the promised video of the machine. They have rejected our refund stating we made them keep the machine off the market, they then told us it took so long because the machine WAS BEING RENTED OUT on a prepay the whole time. This company is a total scam and they are attempting to hold $3,515.40 of our funds when they have not upheld any of the agreement on this purchase. I was transferred around to multiple people all down talking the previous person & when I asked to speak to upper management to resolve my request I was told & I quote "they have more important things to do". This company is disgusting. Steer Clear! I just want my deposit back and to never have to deal with their shady tactics again.Business Response

I am rejecting this response because:Your "Customer Success" stated that they "have more important things to do" and there has been no one on your "team" that has helped settle my concern in any way. You have not gone above in beyond in any aspect of our dealings, you have been incredibly rude, shady, misleading, and outright dishonest. We will not be proceeding with a purchase from you, as stated, and all we want is our deposit back which you are holding under fraudulent circumstances as you have not upheld any item of the agreed upon terms of this purchase.
