I have retained this law office to represent me in a mass torts lawsuit. I have been requesting more information about my options since December when I was contacted by the system, administrator of the defendant mentioning the settlement options. I have pages of emails detailing for appointments the attorney and his team made with me and have missed. I even contacted their client advocate who assured me that my appointment today would not be missed. My appointment was an hour and a half and nobody has reached out to me at all. The missed appointments are as follows:December 18th, 2024 called me an hour before my time and rescheduled to 12/23 December 23rd, 2024 I was not called or notified my appointment would not happen. I called their office when 20 minutes had passed, and I was told my attorney would still call me. Two hours later, I still have not received a call, and they finally texted me and told me that my appointment had to be rescheduled.January 10th, 2025 I made an appointment via text for January 10 Apparently this appointment was never confirmed, but nobody told me that, so this one was skipped as well.February 11th, 2025 I made an appointment with the client advocate for February 11 at 4:30 Eastern time since I am in ********. This appointment was skipped **** have had no communication whatsoever from the team to explain why or apologize or reschedule.I have several emails detailing this that I can forward I have photos of the text messages that I also will forward. I am expected to pay them 40% of whatever settlement I am going to receive, but I do not think that is fair based on this experience the past couple of months. Not only has us been frustrating, but it has also postponed my options for two months, potentially impacting when I receive this settlement and how long it will take to process. I want the fee reduced at the bare minimum and if I not able to come up with a satisfactory resolution, I would like to switch attorneysBusiness Response

A very detailed letter from our office, sent from the third-party settlement administrators platform (not Defendants) explaining the settlement options was sent to Ms. ******** in December 2024. It stated we would reach out to her and schedule an appointment once we had completed our review to determine the best settlement option to choose for her case. The deadline for all Plaintiffs to select their option is March *******. Prior to our offices final review of her case for the best settlement path recommendations, Ms. ******** reached out against the advice or our letter wanting a call in December. Two calls with the attorney in December, unfortunately,needed to be rescheduled around the holidays, and the last two calls were never actually confirmed and placed on the attorneys calendar. The last two calls our office reached out to her to attempt to confirm the date and times. The third appointment was never actually confirmed. The fourth appointment was initially scheduled for Tuesday, February 11, but then our client services director called her back and left a message for her to see if she was available Wednesday instead due to a conflict on the attorneys calendar on February 11. However, Ms. ******** did not return the client services directors call so that appointment unfortunately was not actually confirmed and placed on the attorneys calendar.
Since that time, the attorney has sent several emails sincerely apologizing for the missed calls, asking to schedule a new date, and time and to explain the best settlement option for her whether that was Quick Pay or Traditional Pay Evaluation. The attorney also gave out his personal cell number so the client can call and text him anytime directly with questions or further concerns. The attorney also sent another detailed letter explaining the attorneys recommended payment (with expected points allocation analysis) which was sent to her through the third-party settlement claims administrators website. Finally, a call was scheduled and confirmed on the attorneys calendar for Monday February 17, 2025. The call occurred on that date and time, and the attorney had a very productive call with Ms. ******** to discuss all her options. The attorneys impression is the call went well, and all her questions were answered so she could make the best decision on her case. Our attorney stated the call was very pleasant and the client left appearing to be satisfied with the advice as she shortly thereafter signed off on the settlement agreement.Customer Answer

I am rejecting this response because:We did have a productive call on Monday the 17th however their timeline of events and apologies and their explanations for the missed appointments is completely misrepresented here.
This version makes it sound like I was bothering them for appointments when every single one with the exception of one was confirmed by their office. They were not rescheduled, they were completely skipped.
Please provide an email address I can forward all of the correspondence from the attorneys office to. The multiple emails do not support their version of events.
After the conversation on Monday I was considering dropping the complaint but I am no longer going to do that out of concern that I will not be treated fairly (and they will continue to misrepresent what actually happened)
The attorney said he would take a reduced fee as a courtesy but that was never discussed or finalized either however I do have the email from him saying that he would.
Unreal. I cant believe they would go as far as to misrepresent what happened in this case Im appalled. Im considering going to news outlets also. Extremely disappointing.

This complaint has 100% not been resolved. After the conversation I had with the attorney, I considered dropping the complaint as I do agree it was a productive conversation, then I saw the company's response and blatant misrepresentation about what happened and it renewed a glaringly obvious issue: they cannot be trusted. Here are the reasons why:
1 -- I have a chain of 30+ emails that support my version of events. You will even see in the emails that I even questioned why they were even making the appointments if they did not have the information necessary to discuss my case. They not only ignored my question regarding that, but they also CONTINUED to schedule and blow off appointments with me. I am absolutely appalled and disgusted that they tried to make it appear like I was aggressive or unreasonable when I was scheduling these appointments. NO ONE--not ONE person said 'hey per the letter we need some time to get your information together'. Had ONE person said that instead of continuing to schedule appointments I would have waited. Yes the letter said that they will let me know what their recommendation was, but they should not have even scheduled the appointments when I called if that was the case.
2 -- You will see in the emails and text messages that I requested to speak to their client advocate, ******* several times leading up to this level of escalation. That request was ignored as well. When I finally did talk to *******, he said he had been out on personal business for a few weeks but that someone else should have reached out from his team (whoever was covering for him). That never happened. I finally had to very directly ask why my request to speak to ******* was ignored, and all of a sudden, ***** finally copies ******* on my email
3 -- When I finally got to speak to *******, he was very apologetic. He explained he had not seen my email requests to speak to him (or the formal request I placed on the general office number as well) and he 'was not sure why no one on his team reached out either'. He was going to look into it, but said that he was 100% appalled when he read the emails also. He claims that experience was not typical and not acceptable, and he asked me if it would offend me if he sent me something just to acknowledge their mistake and try to make up for the multiple issues I had had up until that point. Unfortunately he did not specify what that was, but as of today's date 2/28/25 that 'gift' or 'card' or whatever he was sending has not been received either. He went as far as to verify my mailing address too. I did not ask for anything from him. He volunteered it and it was just another instance where I was told something would happen that would not be delivered. Again I did not even want anything else I just wanted to be heard. He was very apologetic and gave me his cell phone number. He played a part in getting the appointment scheduled. We had 2 more mishaps after that, however. Again--all documented in the email chain I am going to forward. (full disclosure, it is a LOT).
4 -- I requested that ******* be on correspondence going forward. He was on emails only and did not hold up to this promise to also be on the call with the attorney when it finally happened (unfortunately verbal so there is no documentation; I am learning that with this company that is very intentional). The meeting would have 2 more mishaps before it finally happened---making a total of 5 blown off appointments. Only ONE of those appointments 'had to be rescheduled' as they had claimed in their response, and NONE of them came with an explanation whatsoever---as evidenced by my increasingly frustrated emails and extensive documentation on my end.
5 -- The attorney asked me to drop the complaint before we even spoke about it--which would have left the door open for more of the aforementioned unacceptable conduct had I done that. You will see that in the emails as well. I kept EVERYTHING.
I am being illustrated as this very rude and inappropriate person, but the bottom line is you will see very clearly where my frustration escalates and becomes an issue. This company has REPEATEDLY not delivered and unfortunately I am to late in the process to start over with another attorney. I will forward the extremely long email chains and screen shots of the empty promises also.
Due to the repeated misses/disrespect and the misinformation that the company provided in their unapologetic and even blaming me response, the only resolution I am accepting is a dramatic reduction in fees for their 'service' (or in this case lack thereof) and keeping the BBB complaint open until that is in writing.
I will forward the email chain for review also---subject line will be the complaint ID. The owners of this company will be appalled when they see how I have been treated and how this response was handled also. Completely disappointing and I am now going to be making formal complaints as well as a result of their attempt to absolve themselves of responsibility.

The firm was not bothered by her reaching out to schedule an appointment. We very much apologized for the missed/rescheduling of appointments, and when they spoke the attorney gave her his personal cell phone if she had further questions or concerns. Her case must go through the claims process now that she has made her election as was explained to her in detailed written and phone communications, and then the claim administrator will make a settlement award. Once the award is made and all is accounted for, we intend to give a professional courtesy fee reduction given her unhappiness with connecting with our office. We will deliver on our promise. I am rejecting this response because:Nothing else they have promised me has happeneddown to keeping appointments THEY made. No one bothered taking the time to tell me that they didnt have the information together regarding my claim as evidenced by the 35 emails I forwarded to the BBB.
Another example of not delivering is ******* asked if he could send me a gift of some sort (he asked if I would be offended by that) and that never happened either. To be clear, I do not care about the gift because I didnt ask for one. Thats just another example of them saying one thing and not delivering.
I would like this complaint to stay open until they deliver on their promise as it has been the only way Ive been able to get their attention and has added a level of accountability they thought they could circumvent until a third party was involved.

Im trying to find out about my brothers case with this company. He died over a month ago and I cant get a call back from this company.Business Response

After our office was first notified on August 16, 2023, of ************************ passing, the attorney, who had been handling his case, *****************************, left Bachus & Schanker. As a result, Mr. ********* case was re-assigned to another attorney, ***************************, who has more than twenty years of litigation experience. ****************** can be reached on his cell phone at *************. He welcomes any communication regarding the case whether through a phone call or text. Between the delay in our office finding out about Mr. ********* passing and the attorney, who was handling the case no longer being involved with the case, we apologize for any delay in touching base with you.
Mr. ********* case is proceeding forward, as scheduled. It has been set for trial to begin on April 4, 2024. The pre-trial conference is set for March 24, 2024. Our office is drafting written discovery requests to be served on the Defendants, setting *********************** deposition, and working to finalize a proposed CRCP 30(b)(6) Notice to depose Defendant, Colorado Sanitation Services.
