AETHETIC TREE SERVICE destroyed my trees. They cut 2 feet over the property line, into my property AND chopped off a tree. That is illegal in ******** and considered to be trespassing.I have been advised that if someone destroys your landscaping, they should be sued. If this is not solved, a lawsuit will happen. These trees were tall enough to cover the garage roof, approximately 20 feet.About $1800 for the tree, and $600 for planting it. $60 to $70/hour for moving costs.

    Business Response

    Date: 03/03/2023

This complaint is fabricated and absolutely shocking. Ive been a licensed arborist in ****** for over 30 years and my company has never received a complaint from anyone regarding work we have performed.

************************* is not a customer of mine nor have we ever stepped foot on her property. We were hired by ******** north neighbor to cut a few branches from a shrub that was overhanging the fence between the two properties and lying on my customers shed (Barbaras shrub.) These branches were approx. inch in caliper or less and were taken up to the fence line. We never chopped off any trees on her property nor did we cut any trees over the property line.

We believe this is retaliation due to a pending lawsuit against ************** for her involvement in the destruction of her neighbors property.  To the public, please reference Case #C32022M4267 in Arapahoe *************** 304 for verification.

Since I began my business in **** we have taken great pride in the work we do and have always operated with the utmost integrity and honesty. Consequently, this published fictitious complaint gives me no choice but to pursue legal action against her for defamation of character.

I am rejecting this response because:  This response is totally unacceptable.  Not one word in my Complaint is fictitious or fabricated.

Please please come to my house and see for yourself.

If he cares about the truth he would do that.  I tried to talk to him and show him photos, but he would not have it.  That left me no choice but to file a Complaint with the BBB.

I have been a customer of yours.  You removed a tree.  I had found someone to do it for less, but you were already here, so I said to go ahead.

As for stepping on my property, by ******** law, it is considered trespassing to encroach past the property line, and destroy landscaping.  You don't have to put your feet on my ground.

There are no scrubs, just trees.  She said to a handyman friend of mine, that the branches were getting into their gutters and over their roof.  Said nothing about the shed.

She also said to him that they only cut dead branches.  Not true.  Look at the photos.  Some branches have clean cuts, some branches are split i.e. some were dead, some were alive.

Legally in ******** a neighbor can cut branches on their property line, and it is their responsibility.

They are vindictive  toward me because, after 15 years of cutting the branches on their side of the fence, and taking trees out that they asked me to take out, I stopped doing that.

There was never a thank you, never a kind word.  It was always after one thing was gone, they complained about something else.  So I stopped.

Then they were mad after I didn't share the cost of a new fence.  That happened because they wanted me to pay the $600 for taking my tree out, and taking my fence down.

They got greedy.  Odd though they didn't share the cost of my fence when it was put up by the previous owner.  I know that because she told me that when the previous owner put up the new fence,

they took down their chain link fence.

I didn't care about a new fence, and was only sharing the cost to be neighborly.   But it was always something else, never ending for 18 years.

Please please please come see my property, look at it, and explain your side of the story.

Reaching pass the property line is trespassing by ******** law.

So just come and look at my trees.  As two alumni from DU, maybe there can be some listening.

    Sincerely,

    *************************
