    We hired PO to inspect a premises at 119 Wood Road, #119 a brand new property. Inspector found small issues but missed the big one which made property unlivable and unsalable. We were remote so could not accompany the technician. Had we been there we would have certainly detected it. It was a scraping vibrating noice emanating from below which occurred at least every 15 minutes. We didn’t discover until we entered the premised after signing the closing papers. Thankfully we were able to delay the funding and get out of the deal at a cost of $150000 including attorneys fees.

    We spoke with the property manager and real estate agents involved in this property. The issue noted was not present at the time of the inspection. The noise came from a damaged garage door because of an incident in which a truck hit the garage door. This incident occurred on January 5th of 2024, several days after our inspection, therefore, would not have been heard during the inspection on December 22nd. We have documentation of this from the property manager.  We did not note any unusual noise in our inspection report because no unusual noise was heard.  Additionally, the engineering team states this issue is currently being remedied. The damage has been repaired, negating the assertion that the property is unlivable or unsalable. In fact, according to staff there are tenants currently renting the space that have not complained about any noise. The damage to the door that created the noise occurred after our inspection and therefore could not have been detected during the inspection.

    Our inspection was performed on December 22, 2023. According to the property manager (see attached email) the noise began January 5, 2024 after the garage door was hit by a vehicle. The client closed on the property February 5th, prior to all repairs being completed, and was upset by the noise and chose to back out of the deal after having closed. While this is unfortunate, we do not feel this is our fault as we would not have detected a noise that was not occurring at the time of our inspection.

    Also, not sure what the $700 refers to. Mr. Braner paid $475 for his inspection, not $700. I'm also not sure why he thinks we should sue the sellers when we were not part of the transaction and have no ill will towards the sellers?
