I am rejecting this response because:
It is made up of false information, refusal to pay us money owed, and is a further attempt to delay accountability on their part and silence us through intimidation.  I have sent a reply with additional information about business.
    Sincerely,

This claim is absurd and UNTRUE> NO items were ever removed from the sale, other than sold items, which were paid for. In our contract, which ********************* SIGNED, it states clearly that items will be priced and sold--per our valuation, and the guidance of our Appraiser. On the 2nd day of the sale, the items were agreed upon as being sold at a discounted rate, starting at a minimum of 50% their original price, as well as bundling items to sell, as to liquidate the inventory for them.

At news of *****'s first complaint, she was contacted SEVERAL TIMES, (More than 6) via text messages and voicemail, to address her concerns. NO answer. Would NEVER return any phone calls, and instead continued to HARASS us, with her threats and lies. The harassment and threats continued for several days, and she would NOT agree to a mediation. After contacting the ******** sheriff's office, he then advised her that  the contract she signed, allows for a mediation. Finally, after her verbal abuse went on for days, she FINALLY agreed to settle for a $240.00 payment, (which was NOT DUE to her) along with a NO-CONTACT *****. Waiting just 3 days after her texting us she agreed, she proceeded to contact other persons within the Estate *************** slenderizing our name and spreading hurtful and UNTRUTHFUL words! At that point, we then decided she had breeched the mediated agreement, and refuse to send her any monies.

Any sort of mediation moving forward, would have to be documented and performed by a professional service, and paid for, by *********************. I find the whole situation and accusations to be absurd and with NO GROUNDS. Ultimately she is dissatisfied I believe, because she has sentimental value to items sold and thinks they were worth more than the appraised amount. NO excuse to mistreat, threaten, lie and slander myself, nor my daughter who owns the company with me.

    Customer Answer

We were not paid our sales proceeds on time per their sales agreement.  They have provided excuses in writing and voicemail that contradict each other.  I have reminded them in writing multiple times that I have all their written statements and voicemails so I am not sure why they try to deny what they have said.

No threats ever made.  Second request dated 7/25/2023 was met initially with responsiveness by ******** as I stated our disappointment in being treated in this manner.  She left two voicemails stating she was sorry and empathized with us not receiving money and further stating she would be totally ******.  Stated check was sent out two weeks ago.  She states in call she should have mailed certified.  She offers to send $500 bonus for this error on her part.  This was second contact about check not received as I texted ******** on 7/19/2023 and stated that check was not received.  She responded via text that she was very ill after sale and check just mailed.  Stated she is sooo sorry - she forgot to text me this information.  This communication was very cordial with me texting I hope she feels better and stating that I had also been very ill and hospitalized.  ******** statement twice of no prior communication is blatantly false, and ******** says via text just mailed on 19th - then in voicemail on 25th mailed two weeks ago.   Subsequent texts state mailed two weeks ago.  Many different versions of when same check was mailed.

We were not provided itemized list with late check and had to ask to get a copy almost 4 weeks after sale.  List is incomplete and does not address our deep concerns of items not accounted for.  Hundreds of items sold at over $10-$15 per item not accounted for in list we received.  Many items between $20-$50 not accounted for.

******** stated in both voicemails on 7/25/2023 that she would mail check overnight the next day.  She stated twice in same voicemails that she would send the $500 bonus to make it up to us along with sale funds/proceeds.  We responded to voicemail(s) via text stating to overnight check and forward tracking for check.  Instead of honoring her promise,  ******* start texting us next day demanding we respond via phone.   Her texts were not apologetic, took no accountability for their lack of payment, made false statements unrelated to us not being paid on time, and repeatedly blamed post office.  She stated via text on 7/26/2023 that she would overnight check.  She asked for minimal communication in a lengthy subsequent text that day again accusing us of threats for stating consequences of their inaction or lack of satisfactory resolution.  Tracking number was not for overnight mail,  but other method and arrived on the 31st of July.

Speakers were removed before sale and we were advised they had already sold.  This was not information given to us in advance, and speakers were subject of text requests from them prior to sale asking if they were to be sold.

We would never have agreed to letting the person (appraiser as they state) price items they intend/desire to purchase - that is absurd; and contrary to their website advertisement stating that the appraiser will be paid out of their cut and an obvious conflict of interest.   Also, appraiser would have priced items prior to sale not during sale as they now state in writing.

Additionally, we were both told that this Company is fully bonded and insured.  They do not have either a bond nor professional liability in force.  Both were stated in bold black larger print on website.  ******** may not require them to be bonded, but advertising they are requires them to produce said bond. Their registration with the Secretary of State dated April 27, 2023, as well as their articles of organization dated the same prove that they want the state to recognize them as a legitimate business.  The website advertisements should have been changed and updated by them to reflect their new ownership - ********* (previous owner) name, content and Testimonials removed.   We can only assume this was done to sell themselves on/as Victorias  reputation and experience and induce clients to hire them based on advertised content. Clearly this is a Deceptive Trade Practice.

They have continually tried to creat a narrative to deflect from their culpability.   We are not responsible for their lack of accountability, inexperience, advertising misrepresentations - they are.

******* has become angry and tried to threaten and silence us for telling them how we will proceed if they do not pay us/resolve; then after contacting appropriate legal and public entities for recourse which is well within our rights they try to slander us and make further false accusations.

******** and ******* have not followed through on promises of full payment, restitution and/or resolution.  Instead saying that offers made both in voicemails and texts are revoked.  Also, texting us and telling us we contacted them about agreement which in false and text messages show.  Further, no agreement had or has ever been sent for us to review.

We reject their reply as false.  We have paid an attorney and he sought a payment and restitution.  None has been forthcoming.
