    In July 2022, ***************** entered into a contract with our ***************** to do a sizable hot tub project for the sum of about $345,000.00. His company, Apex Building llc did part of the work and then abruptly stopped in November of 2022. They were paid just over $200.000.00 and at first kept telling us they would return to complete things. They did just a couple small items to appease us. They left the site a total mess and we were cited by the town for lack of proper erosion controls in place and site safety conditions. Apex was notified of the conditions and ignored them for over a month, then they came and took their equipment but left all the trash & broken equipment and did do further work. Apex was again notified and requested they complete the work. they ignore those notices. We terminated their contract for nonperformance and they still did not return any communications. As we looked to complete the work through other means, we discovered numerous deficiencies in their work and a number of items that they had billed as completed but were not complete. They placed gravel fill 50 feet past our property line and now we have to remove it all and re vegetate the neighbors yard. The plumbing that they installed slopes backwards and did not pass inspection and now it must be removed and completely reinstalled properly. They built a retaining wall improperly and it has to be removed and reconstructed. They never completed the framing of the hot tub building but billed 100% for it. We now have to pay to complete what was already paid to them. Their contract called for 100% completion by end of October 2022 but they never got more than about 55% before they abandon the job. We want restitution for all the items that were done wrong and return of the funds that they were overpaid as well as reimbursement for expenses that were the result of their incompetence. Minimum restitution we are seeking is $79,291.00

    Here is a partial list of communications with Apex Building

    12/9/22 phone message left for Rush and Hunter. Large pile of dirt place on ski slope and stopping ski resort from opening ************ lift.  No response, We had to hire another contractor to move dirt. 

    1/27/23 called Hunter and Rush and left messages to remove tools, materials, equipment that was blocking ski slope access. no response.

    4/26/23 Town violation notice posted by code enforcement officer.  We called and left messages with Rush and Hunter.  they never responded

    7/20/23 Town and building department posted another violation notice. We called and left messages with **** and Hunter. No response. We spoke with building inspector who ten contacted **** directly.  **** told the inspector he would remove trash and install erosion control within 2 weeks.  He sent someone to the job over a month later and removed all his tools and left all the trash on the job.  This was the last time anyone from Apex Building ever responded to anything. 

    10/19/23 certified letter sent to Apex thru attorney. letter was signed for on 10/20/23. They never responded
