Thomas Lauth and Lauth Investigations entered into a contract in April 2024 with Jill Simonds as a fractional integrator (5K) as well as her partner Ann Jacoby (5K) as Fractional CFO as well as her husband for services (2K) for a total of 13k. The services by her husband were never performed and the contract was for 2k a month for 35HR. Ann jacoby and Jill Simonds both failed to perform their services for month of April and May 2024. Since May 1 all of them have refused to communicate with Lauth. On May 1, we paid Savvy Strategic partners 13k . Since then her and her partners in the contract have not done anything. On May 1 miss Jacoby called and emailed lauth agents repeatedly asking for payment for month of May . In good faith because the contract has a 30 day notice Lauth Paid 13k but her and her agents have now streamlined all communication and not performed any services.

    Business Response

    Date: 05/16/2024

The customer provided written notice of discontinuation of services on May 1, 2024:
    -----
Thomas Lauth Wed, May 1, 3:15?AM

    Good morning
Ann and Jill I will no longer need your services as I will be closing down the rad division over the next 30 days.

    EOS will not be necessary

    Thank you for everything.

    [Signed, Thomas Lauth]

    ----

This was in gratitude and closure from the client, of the continuing services agreement, to which the binding agreement indicates a 30-day written notice period. That 30-day notice made on 5/1/24, the customer was made aware of the fact the retainer fees were still due in an invoice dated 4/25/24 with due date of 5/1/24.

Proof of correspondence is also provided in the continuation/response to the above email exchange with both parties involved. Several attempts were made to meet (dated 5/1, 5/3, 5/8, 5/9, and 5/13) to discuss the continuation of 30 days notice period to any remaining service obligations arranged in the initial scope of the agreement. The company did not show up nor reply to suggested meeting times for us to assure that the fulfillment of any unmet scope of work could be completed (although there are responses to the email thread acknowledging the correspondence was indeed received). Within the 6 business days since Tom Lauth's notice of termination was sent, we have provided 3 different days and times to identify continuing scope of work. We continue to be happy and willing to do so and are amenable to discussing fulfillment of remaining services:
Review formal process for ending the agreement
Address any pending or outstanding issues to achieve closure
Consult on recommendations that may help the company transition

Multiple meeting invites have been scheduled with provided alternative meeting times provided to accommodate Lauth Investigations' availability, to which have not been taken in cooperation. One member of the Lauth team (HR) initially accepted the 5/8 invitation, but then later declined the invitation. Our team has now attended two scheduled meetings in attempts, but unfortunately no one from Lauth Investigations attended.

Please see to that you respond to the several attempts to meet to discuss the remainder of the 30-day notice period.
