    Saturday 10-12-24 My personal computer Cougar would not restart. I sent a text to **** at the Computer repair doctor (Computerberg Technologies ***********************). Early Sunday morning 10-13-24 I was able to restart the Cougar and update current D: drive data to my **************** 8TB drive.Sunday 10-13-24 I agreed to drive the Cougar and ******** 3660 purchased from **** 9-11-24 into town and drop it off at 10 AM at the ******************************** used by Computer Repair Doctor. I showed **** a sheet of paper with all the Cougar drives listed: C:/ 1TB with 599 MG of data. *** 8TB with 3.51TB of data. The Cougar had two additional drives, G:/ 8TB 3.48TB that was a mirror of the *** 3.51TB. and an old E:/ 4TB backup with 2.33TB.I DID NOT ask **** to do a Rush 24-hour migration because I had Carbonite cloud access plus a Carbonite hard drive coming ***** and had all the data I needed to do my work on my external 8TB ******* drive.10-14-24 9:45 AM I received an email Invoice # **** for $1,502.00 eight hours to restore data at $199.00 per hour. I could not believe what I had been charged and never asked for 24 Hr. rush service. I called and expressed my outrage with what had been done. Thats when I realized that **** had both of my computers being held hostage. I called the ********************** for assistance getting the computers back, but we didnt know where they were being held. I had to get my computers back, so I paid the invoice using ****** and arranged for **** to deliver the computers. The **** 3660 was not configured properly. The Cougar C:/ documents migrated to the **** 3660 C:/ drive was not useable. They would not open and could not be deleted.I called my credit card company and disputed the charge. 10/15/24 at 9:16AM called ********** arranged to drop off computers 3PM Picked up computers 10-16-24 4PM cost ****** new computer worked perfectly all data in correct drives.10-18 did remote with MDL set up missing apps cost *********** my docs download

    We believe The Peet / Hotel Fraudulent Chargeback has engaged in a Computer Fraud Scheme / Software Piracy Against Computerberg Technologies / Computer Repair Doctor.- We protest this Chargeback as it is a cybercrime against us Computerberg Technologies C.R.S. Section 18-5.5-102(1)(a).  Computerberg Technologies / Computer Repair Doctor has now over ******************** work for Peet / Hotels.

    We were contracted In May and again in August 2024,  and did deliver (Contract 1 / 2 - One New **** Server 1 - See our purchase receipt to resell the ****) that we purchased from **** and then deployed / resold to Peet / Hotels (see Estimate(s) and Invoices(s) Message Thread. Computerberg Tech Sold a new **** and specialized parts, and Custom Configured / Programmed, Custom Refurbished, Network, Secured with Anti Virus software as part of complete new **** Server with Windows 11 software, as we are a **** Dealer.  We performed work to the computer at our facilities and work to the computer onsite.  The chargeback is fraudulent and is in malice.  Please see the complete message thread, date time stamped with all photos between Computerberg Tech / Computer Repair Doctor and between Peet / Hotels from August until November 2024 for more than 30 hours of work to date, including Sundays, including virus cleaning, and data transfers of 12 tb of data approximately for 2 of the hards drives in the old clone Cougar Server.  See Exhibits, Contract 1, Estimate 1,  and Invoice 1.

    We were contracted (Contract 2 / 2 - Server 2 Revive DOA clients old DOA clone Cougar server) to License Norton AntiVirus Software, used Windows Pro Software on Computer Tech own servers to clean and transfer 12 tb approximately of clients data, Custom Configure Networking between ******** and ******* Locations, Diagnose then Clean Multiple Trojan Viruses, Transfer all Data cleaned from 2 hard drives to the new **** Computer on a ******************* delivered on Monday completed data transfer.  We completed this work as estimated and per our contract for fees time and licensing and the chargeback is fraudulent and is in malice.  Computerberg Tech documented the work as is evidenced in the message thread(s).



    We demand that the Hotel client is now not authorized to use the **** Server since the chargeback as we consider this theft and computer crime victimizing our **************** with fraudulent chargebacks for goods received and working.  We believe that part of the cyber crime against us is to receive specialized Computer Chips, and bitcoin mining video card equipment, and **** Server Equipment and Hard drive SSD / Memory chips that are export controlled without paying, as the client left town once receiving the equipment.

    Norton Antivirus 360 1 year license Installed on the **** Computer

    We Completely believe that making us utilize a license of Norton 360 to clean multiple viruses, purchasing the license for us to use and from ********************** as the ****** and then charging back the license while keeping it is software piracy violating Federal Law 17 U.S.C. 506.
    We protest that the Norton license we issued and used to clean the viruses from the clients original broken Clone Server (Cougar) is now pirated due to the fraudulent chargeback.
    We paid for  the Norton license and cleaned multiple viruses off the client's old Clone server computer with Norton Software Antivirus licensing.  The client is now pirating this software from us with the chargeback. We believe we found pirated software on ***** Cougar clone non name brand server that contributed to making the trojan viruses Infection  on ***** old server- See below photo of norton report finding multiple trojan viruses and malware on the old Cougar Server.

    We allege part of the cyber crime against us is to victimize us with real estate racketeering by a hotel real estate company to defraud my company as part of larger cyber crime in my community, partly based in retaliating against those complaining about 2024 Frisco Colorado Elections (see message thread) by using real estate fraud to commit racketeering bait and switch tactics on contractors to steal computer equipment and steal software. The client never attempted to create an RMA nor return the equipment per our contract while demanding to keep all of the equipment with a chargeback. The client never mentioned any issues in our message thread until demanding the fraudulent chargeback.

    We protest that Peet has now pirated hardware and software in violation of our 2 contract(s) that were Digitally Submitted and Peet received an email receipt of submission / with a copy. (see exhibits).  Peet has violated our terms of payment, and licensing terms.  **** never attempted any type of mediation before the chargeback, as the chargeback occurred before any 3rd party had completed mediation.

    We think that the use of 3rd Party who is a ********************* but a *************************** to Hack our **** Server and Norton Software Licenses was a cybercrime.
    We protest that Peet / Hotels has Pirated our computer and used another computer company, that is not legitimate Microsoft Business Partner / .Net Programmer, to finish our programming work hacking our licensing, violating our warranty.  The Client is refusing to return any equipment nor pay the restocking fee by issuing a fraudulent chargeback, while using another *************************** without a Frisco physical address to hack our computer and hack the software licenses so as not to pay our invoice and financially damage our company.





    The 3rd party computer business consulting company used to hack our software license and damage our computer company using unauthorized equipment, and has financially damaged us, unfairly in breach of our 2 contracts with Peet, which violated our contract for 3rd party software and 3rd party tampering.
    The 3rd party company *********************** apparently pirated and installed a software license that was part of our work and billing, and chargeback.
    The 3rd party company ************** used our **** Server computer that has not been returned nor fully paid for to hack Computerberg Technologies computer specialized data cleaning and data transfer work.
    We believe this is a cybercrime that Peet in bad faith paid for a Hotel Server, had us register the **** server to his hotel name with ours on the original receipt, and then demanded a chargeback once we had completed installing the New **** server, upgraded chips, and Export Controlled Video Card (Can do Bitcoin Mining) to their hotel network and completing registered the computer to ****, and then Peet used a 3rd party to hack our computer after a fraudulent chargeback.  
    Damage to Computerberg Work Truck during delivery on September 12, 2024 caused by Peet.
    On September 12th, while delivering the New Server, there was physical Damage and *************** has an insurance claim for the ****** SUV during September 12, 2024 Service call where the Front Gate Malfunctioned and slammed down on Computerbergs work ****** SUV when Peet was behind the Open / Close Button of the Gate.  *** ****-******** continued to work in good faith and **** then brought his 2nd server computer in for additional work the following month in October 2024.





    Please note the photo of the malfunctioning Snowflake / Peet / Hotel front gate during our September 12th, 2024 during the Service call Visit to deliver the New **** Server to the ********** in the Snowflake Condos.  The gate malfunctioned while Barnney Peet was at the controls of the Gate and it slammed on Computerberg Techs work SUV.  With the Fraudulent Chargeback, we believe this was done in malice.

    We strongly believe that Peet / Hotels has done malice and has scammed ****************************** with a fraudulent chargeback and a fraudulent complaint, while intentionally damaging my car (see insurance complaint) on 09/12/2024 as part of larger fraud scheme and malice.
    We protest that **** has omitted copies of the disclosures herein in their complaint so as to commit fraud by omission and deceptive disclosures to gain a fraudulent chargeback.
    We are attempting to file a police report as well as a report with ******* Inland for the serial numbers are registered for warranties.  Until the chargeback is dropped and all 3 of our invoices are paid in full, we will consider the computer equipment stolen.
    As is in the Microcenter Receipt to us as a Reseller, here is a list of parts and serial numbers which we claim are stolen now due to the fraudulent Chargeback (see Microcenter Receipt for our original purchase of the computer, chips, and special video card parts). We believe these parts are fraudulently registered to Peet / Hotels as the chargeback is erroneous.

    I am rejecting this response because:

    1. The work done by Computerberg ******** failed to provide the agreed transfer of **** to my **** 3660 purchased from Computerberb 9-11-24 . The request was not complicated. Copy **** from my older computer "Cougar" 1TB *** SSD drive containing 599 MB of **** to the **** 3660 2TB SSD, Then copy the Data from the Cougar 8TB D:/ 3.51 TB of **** to the **** 3660 10TB D:/..

    After the transfer done by Computerberg The *** drive in the **** 3660 was not useable. The **** transferred to the 10TB D: was in two master folders (another copy of the Cougar *** and a copy of old 4TB E:/ found in the Cougar.

    The correct ***** D:/ **** was never copied to the **** 3660. When i dropped off the two computers in the **** parking lot which was not normal, i showed *** detailed diagram of the Cougar drives and had reference to my Laptop **** 7650 with C:; and my wifes **** ************************ our Cono using a one GB switch ethernet wired connection.  *** kept trying to sell my on more apps that i don't need and referred to the Cougar as a hotel server which is not true. this Cougar is my personal computer that my wife and i share photos and files.

    2. I never requested a rush ************* any discussions with ***. In fact i told him a Carbonite backup hard drive had been ordered to be shipped ***** to my address in *********. Colorado incase the Cougar C: or D: had failed.

    3. When i realised the transfer of **** had failed and was not usable and i had paid $l,547.06 on ****** to gain access to my computer held hostage at an unknown location since computerberg used the US *********** as the official address used on documents. I called the **************** and talked to a ****** police officer for assistance getting my computers.

    4. I Filed a dispute with my credit card used my the ****** payment.

    5. *** was impossible to talk to, he made up endless stories to try and justify

    6. ************** was able to do the work in one day, charging only $195.00
