Advance seal coating destroyed driveway drain boxes with their roller. Their repair is not acceptable, we had an agreement that they would patch and fix. Driveway does not drain. Terrible quality of work, and the owner will not stand behind his word in fixing his damage.Business Response

We paved a new asphalt driveway for ************************* 2 years ago, to which he called me a year later saying that my crew members damaged his drain boxes with the compaction roller, at first it seemed strange that it took him over a year to call me, because there has been constant remodeling being done to his house since the past 2 years and anyone of the contractors that he hired could have caused damage to the drain boxes, so I pushed that to the side and I personally went over to **** at the beginning of summer 2023 to arrange repairs to the drain boxes over a year after the driveway was paved.
At that time **** told me that he will buy the drain boxes, and all he wanted us to do was to cut out 2 sections where the drain boxes are being replaced, he mentioned that he would install them and fill them,
So I arranged a time when the crew would come over to cut out the sections, and I also told him that if he wanted the crew to fill around the drain boxes for a small fee,
Moving forward about a month later, I contacted him and told him that we are performing a paving project in his neighborhood, and I would be able to fill with asphalt at no cost to him (free) Because we are in the area, he agreed.
After the asphalt fill was done, he called me again telling me that the drain boxes arent draining properly because the new asphalt is not allowing it to drain correctly, so there is a small puddle in front of 1 of the drain boxes, at that time I mentioned to him that I had no further work in his area and I was unable to do it for free, and if he wanted to get it done immediately there would be a crew and material fee of $500, or he can wait until I get more work in his area.
at that point he was extremely frustrated and did not even give us a chance to resolve the matter, but gave our company a bad review on ****** and the BBB, I contacted him through phone call, text message, and I also replied to the ****** review, saying that we are willing to repair what needs to be done on a specific date, To which he never replied to my text message or to the ****** reply.
please note that these repairs were never a part of the original contract, and being tho that he waited over a year to tell me about it, makes me think we are getting the blamed for another contractors mistake, there is no proof that we did the damage, but we were willing to do the repairs so we can maintain quality customer service in the evergreen area.
Since *************************
did not respond in time, winter is here early in Colorado and being tho asphalt is a seasonal business, we are not able to get any repairs done until spring of ****, he waited too long to reply.
Please help us to resolve this issue
Thanks

We are okay with the contractor making the repairs to their work in spring of ****. The contractors response has several inaccuracies in it, and differs from the unprofessional response I initially received from the contractor
the delay in addressing the issues, is generated from ***** stating I will come look at, and then never coming to inspect the quality issue.I assume he hoped it will go away. I have documentation showing ***** stating he would come look, but never showing up.
***** never disputed that his crew destroyed the drain boxes. The pictures I have of the pavement and drain boxes clearly show their roller compacted directly on top of the boxes.
I will reserve any further comments on quality and performance until we see how/if they fix it in spring of ****.
thank you

The company called Asphalt Advance Seal Coating owned by ***************** at ************ resealed my driveway in August 2021. The paving came with a 3 year warranty. I sincerely apologize for that we could not satisfy your expectations,
but at time of estimate we instructed you that the cracks in your driveway were to deep to fill with a crack filler and they needed to be cut out and install new asphalt, you said that other companies that gave you estimates told you the same, but you did not want to do that and you told me to fill the cracks and seal coat the entire driveway, in the attached file you will see that the crack filling is only warranted for 1 year, after the job was completed you were happy with it, a few months later you called me to fill the cracks with more crack filler and we did, the following year after the crack fill warranty expired you called me again complaining about the cracks, to which I came out again and filled them again, then I told you that your crack fill warranty has expired and if you want to cut out them out and replace them with new asphalt I would do it at my cost, but you did not want to, and you asked me if I can fill them again and so I did, I filled the cracks 3 times, twice out of warranty, the only way to resolve this crack problem is to cut them out and replace them with new asphalt, and I can do so at cost if you are willing, again I apologize that we could not meet your expectations.

I am rejecting this response because:I spent just under $2,000 for driveway to be fixed. It lasted less than a year. I'm still not clear why it did not last?
I believed what you said about oil based asphalt as compared with water base and chose to spend the extra $$$ over competitors.
Why did it last less than a year? Why didn't the times you tried to fix it work? What guarantees that your "new fix" will last.
Please call and explain the "new fix" to me with cost. ************. I am so disappointed and hope that you can make it right.
Sincerely,

To BBB,
This email is regarding complaint #******** regarding Asphalt Advance Seal Coating Services @ ************.
I am wondering why the case was closed?
***** (owner of Asphalt Seal Coating Services) never returned my 3 calls after my complaint to get new cost of fixing problem.
Why? Does that mean he knows it can't be fixed???
He told me work was guaranteed, but now does not want to fix it???
See problems listed below...
When he came the 3 times to fix cracks, he never filled cracks completely full.
Why? He was coming after doing other driveways and only putting in
what he had left over from those jobs. Obviously, not enough asphalt.
Then he also came sometimes when the weather was not optimal...for example, one time temp was too cold, another when it rained the next day.
Everything I have researched says weather is a huge factor in doing asphalt work.
Another time I called 2 times (June 2022) before crack warranty was up, and he never would answer. Then I called again on June 22, 2022 and he did not answer,
so when I was leaving message that I was going to contact BBB, and he picked up call immediately. He said he would come after July 6.
Unfortunately, for me, he never fixed it correctly, plus he kept putting me off...Was that to allow the warranty to expire???
I would now like him to answer his comment, "I can do so at cost if you are willing."
If he does not return my calls how am I to know what "at cost" means???Will new job hold? Or will the same thing happen???
I have already paid him just under $2,000. The job took him less than 2 hours.
It was sealed on 8/28/2021 - warranty expires in 3 years 8/28/2024 ; crack warranty 8/28/2022 - but he kept putting me off.
I am a very patient and kind person who just wants to be treated with respect.
If someone makes a mistake, that is ok, but then please fix it.
Help...
Thank you,

Complaint: 19432530Dear BBB,
I thought you should know that Advance ******* Services finally got an email to me regarding
the cost of repairing the warranted cracks in my driveway.
The estimate was $3,950.
That solution is unacceptable. I have already spent $1900 on driveway that was warranted.
See previous letter to you.
Now ***************** wants $3,950 to fix it again.
I would like him to honor his work and the warranty that I had. Another charge to fix what he didn't fix does not work for me.
I would like him to fill in cracks completely full, not partially full like he did before.
I would like him to do it when the weather is conducive, not like before when temps were cool and rain the next day.
I would like an amicable solution. Paying an additional $3,950 in not a fair solution.
I would like him to fix my driveway, honor the warranty, with no charge.
Please do what is right, have an honest, reputable business.
Please relay this information and solution to him and get back to me as soon as possible.
Thank you.
Sincerely,
