Juan was hired to install gutters and underground drain pipes, which he did and I paid him $1,200. Prior to starting the job, I showed him where a sprinkler water line was located so that he would avoid cutting the pipe. He did the job. Overnight the sprinkler system started. Water poured out of the line that I told him about and that he cut. Water flowed downhill and flooded the window well and basement of our house. I had no choice but to contact a water restoration company who vacuumed the water and left about a dozen fans for two days to dry out the basement. Baseboard were removed and the drywall below the window have yet to be repaired. I have messaged Juan twice looking for reimbursement for the damage he caused. He has not replied. I am seeking help from you to contact him and encourage him to reimburse me for expended funds, which is $1,783.25. If you are not successful, I will file a small claims action him. Thanks for your help. ***** *****

      Business Response

      To whom it may concern,

My company did a job installing a 4" PVC pipe. It took us two days to do the job. The first day we ditched and installed the pipe, we never saw an irrigation pipe. The second day we went back to cover the pipe with dirt and the job was done, we received the payment and left.

Two days later we received a text from the client, that he had a problem with his irrigation system. We went immediately. The client lost emotional control and he got into his car and never got out again.

I called an expert in gardening and he cleaned the area where the irrigation pipe was located. He immediately told me that the pipe break was old. The owner of the house never came back for me to explain the situation.

The gardening professional told me he had to do one more test and fixed the irrigation pipe. When he finished, he told me that he was going to activate the irrigation system zones 1,2,3 and so on.

When he got to the damaged area, he realized that the irrigation system has a 10-second shutdown and the system shuts down immediately.

The reasons why I do not accept this claim are:

1.- The irrigation system has an automatic closing valve, when the line breaks it has a time of 10 seconds. The system was tested 3 times by the irrigation professional and he was paid $200 for the inspection.

2.- Three sprinklers were directed towards the wall of the house and not the grass.

3.- That night there was a storm in the city and there were many floods in various areas of the city

4.- The irrigation pipe break was old

5.- The distance from the sprinkler is 7” away from the wall and has a slope of 5 feet, logically the water goes down.

6.- He has two underground windows or window walls, one installed with a galvanized sheet and the other with 4 by 4 wood. Automatically the water that passes through there is transmitted through the wood because it is not correct.

      Customer Answer

      Complaint: ********

I am rejecting this response because:

The owner’s reply is full of exaggerations and lies.

      1. The irrigation system has an automatic closing valve, when the line breaks it has a time of 10 seconds. The system was tested 3 times by the irrigation professional and he was paid $200 for the inspection.
MY REPLY >>> Not true. There is no automatic turnoff of the sprinkler system if a line brakes.

      2. Three sprinklers were directed towards the wall of the house and not the grass.
MY REPLY >>> Not true. The sprinkler heads are directed to the grass where water is needed.

      3. That night there was a storm in the city and there were many floods in various areas of the city.
MY REPLY >>> Not true. Look at the pictures and you will see that the ground is dry except for the PVC pipe that he cut.

      4. The irrigation pipe break was old.
MY REPLY >>> PVC sprinkler pipe can last between 75 to 150 years old accordingly to several online sources. *************************************************************

      5. The distance from the sprinkler is 7” away from the wall and has a slope of 5 feet, logically the water goes down.
MY REPLY >>> The distance from where the water line was cut to the wall is approximately four feet, not 7 inches. You can see that in the pictures.

      6. He has two underground windows or window walls, one installed with a galvanized sheet and the other with 4 by 4 wood. Automatically the water that passes through there is transmitted through the wood because it is not correct.
MY REPLY >>> This statement is irrelevant. The owner cut the pipe causing the flood in the basement. See pictures.

When I call the owner to return to the house and repair the cut PVC line, he acknowledged that he or his working cut through the line even after I showed him that the line was there. He saw the sprinkler heads and system.

In addition, he offer to return the $1,200 that I had paid him as compensation for the damage. I contacted him a few days later after he repaired the pipe to collect and he refused to reimburse me. He said that he will see me in court.

In conclusion, the owner acknowledged that he cut the line by repairing the line and offering to repay the amount that I paid him for the damage to the basement. Now he refuses.

      Regards,
