    On 4/27, I entered a property management agreement with ******. In May, the tenant notified ****** of a nonworking air conditioner. After providing approval, I spoke to him on the phone, asking him to please be clear with what he needs from me in the future, as it was unclear, he was waiting for approval. These exchanges were the first signs of inappropriate and questionable business practices and ethics. During our conversation, he continuously called the tenant a b**** I was very uncomfortable. Subsequently, the tenant raised concerns about a tree removal in May. In June, I provided a referral and asked for three additional bids. I got one from ******* Tree. Nothing again until I received the same estimate from ******* in July. When I followed up in August, he immediately passed my request off to a maintenance team. Not until 8/30 did his team begin searching for additional bids. On the day of the service, 9/29, apparently, the tenant attempted to interfere with the removal of the tree. The maintenance teams said I would receive an email from the vendor. I asked the team to urgently let ****** know, I would like to speak with him. The next day, I was told they have contacted him. However, I have yet to hear from him. I also have not received the email. The only information I have, is the tenant may be causing issues and I was concerned about the status of my property. Since signing the contract, I have experienced poor and avoidant communication. He has failed to uphold his duties as a property manager and failed to provide me with important details regarding my property. His actions are unprofessional and a breach of his fiduciary. On 10/10, I terminated the contract with ******. I did not receive a response from him, but he billed me for an early termination fee and failed to deposit the October rent collected from the tenant. To this day, he still has not returned the rent paid to me and refuses to speak to me professionally to resolve the issue

    In reference to getting the air conditioner fixed it is clearly stated to the owner in the Owner agreement and when I first interview with the client that I will not spend over $500 without owners approval. ************ both was told this by me personally on our first phone call  and this was also in the owner agreement that she signed. Under the maintenance section in the agreement it states the following "Owner expressly grants Agent full power and authority to contract and pay for all repairs and cleaning costs, not exceeding the amount of five hundred dollars ($500.00) per month." I don't understand why she thinks that is questionable business practices and ethics as it is there for the owners protection and I found that to be very unreasonable while I was talking to her on the phone about the air conditioner. She was very rude on the phone during that conversation and was asking me if I could change my tone and am I really wanting to manage her property. I was literally confused as to why she was talking to me like that and I assured her that I was just looking out for her best interest. When I find that people are combative and twist things around I would prefer to have all correspondence in writing and I never did speak to her again after that conversation. She never did call me again after that conversation either. I have a maintenance crew that handles all maintenance issues and works directly with the owner and tenants on all maintenance issues. Any time ************ emailed me I responded right away and she never once told me that she needed to talk to me via portal, email or by phone. She did ask one of my maintenance people to have *** call her regarding an issue with the tenant and the removal of the tree that the owner asked us to get bids on and have removed. I was not aware of any issues like that and had not heard from anyone that there was a problem so I waited until I someone told me there was issue and apparently I did not get the information fast enough and then the owner sent me an email terminating her agreement without ever even talking to me. I honored her request and now she is upset because she had to pay an early termination fee that is stated clearly in the owner agreement "In the event that Owner requests early contract termination, there will be an early termination fee in the amount of six (6) months management fees at the current rented amount, or current advertised amount." Her only approach to try to get out of the contract was to try to blame me for abandonment when I nor my team had ever abandoned her. I have many testimonials from previous owners that I have worked with that rave about my service and especially how well I communicate with them. I have never had a complaint about the things that this owner is complaining about and I find it very offensive that she has gone this direction in such an unscrupulous and unfair manner as to accuse me of any of these false allegations just to get a refund. I have been a licensed Realtor in ****** for 28 years and have had no complaints about my fiduciary responsibility, lack of communication or abandonment. I hope this has helped to clear this up and I assure you that these allegations are all false.

    I am rejecting this response because:

    ******************* has deflected each time I bring light to his use of explicit language and aggressive speech. It is undeniably questionable and 100% inappropriate to call the tenant a b**** regardless of how difficult the situation may have been. To use such language when speaking about a tenant is poor business practice. If he doesnt believe so, as he continually claims, then his lines of professionalism are clearly lacking. With 28 years of experiences, it makes me really wonder what other unethical behavior he has gotten away with.


    Anyone who reads the attached email correspondence between ****** and I can see how aggressive and condescending he is. ****** is a bully. I will provide facts, evidence, and speak to him in a civil manner, but his responses are constantly an attack on the consumer.


    Time and time again, I have attempted to reach out and I have received no response.All the evidence is attached. If he chooses to ignore the evidence, there is nothing I can do about that. I tried, many, many times to speak to him. However, I did not hear from him once. I have concerns and worries about my property that he ignored and did not address. He failed to respond to my requests to speak to him and he failed to uphold your fiduciary duties to manage my property. The termination of the contract was due to his actions and his failure. His contract is also beyond lopsided, so of course he would cease my the funds that rightfully belong to me when I terminate the agreement. Again, I request ****** return the funds that belong to me.

    Perhaps in the past, he has succeeded with bullying and abusing people with his aggressive behavior. However, I will not rest until the funds that belong to me are returned. I will utilize every resource I can find to share my store.This is unjust, not just how ****** wrongfully ceased money that belongs to me,but how he treats people.

    Response to ***** last response:

    1. I deny ever calling the tenant a b**** and never had that conversation with ***. There would be no reason for me to be upset with the tenant. The tenant never did anything wrong, and I never had any conflict with the tenant.  
    2. I disagree with *** that I am a bully, abuse people and have aggressive behavior. I have done nothing except defend myself against all of her false accusations.
    3.I have provided all of my email records and portal record conversations between *** and I to the BBB and have clearly never not responded back to her. Hopefully she has provided the same to the BBB to help her case.
