    In October, 2022, MHC was hired to replace a leaking shower pan in my master bathroom for $6600. The agreed upon scope of this work included removal/replacement the tile/backerboard on the floor, 3' of walls, bench and curb of the shower needed to replace the shower pan, plus removal/replacement the existing shower glass door and frame that was attached to and enclosing the tile to be removed. During the installation, MHC made no effort whatsoever to measure the existing space to make sure the existing glass door would fit back into the shower enclosure. The new tile installed resulted in the space being both too narrow and too tall for the original door to fit. As a result of this negligence, the entire glass enclosure had to be replaced with new glass. (Approximately 44 sf of glass) At the conclusion of tile work, MHC's tile subcontractor covertly demobilized and left without replacing the glass door or checking in with me to inspect the work. On the same ************** from MHC attempted via text to collect the entire amount of the contract of $6600. I would not agree to full payment until the door was replaced. The following morning, *** came over and demanded a check for $6000, to cover work done to date, which I paid.After discovering the problem, my initial reaction was to work with ***/MHC to try and make it a "win/win" and purchase an upgraded enclosure from MHC at a discounted price -- a solution which would have us sharing the cost of MHC's screw-up. However, after many more shenanigans (too long of a description to fit in this space) my position is that MHC should just pay for a new glass enclosure.MHC's original contract is unfinished. I have hired a glass company to install an upgraded, all frameless enclosure. MHC should only have to pay to replace the equivalent of the old enclosure. A text from *** says the material for the equivalent of "what's in there" is $1680 plus tax, roughly $1828. I would like a refund from MHC for $1828.

    We originally agreed to replace and install a new shower pan, tile and floor from a company that originally installed it incorrectly. After demo, installing a new pan, liner, drain and tile the leak stopped. However, the glass that was originally installed was cheap and would have never fit regardless of the work that we did. I gave ************** three custom glass options ranging from $1600-$2000 and also gave him a credit of $600 towards the new glass. After several texts and phone calls, ************** never responded and I assumed that he took a different route in choosing a glass option. This is the first I've heard of him having any issue with what we discussed.

    I am rejecting this response because: The response from Mile High Construction Services offers no resolution and is just a continuation of more bad faith and dishonesty.  The replacement of the original glass was discussed at our very first meeting and was clearly included in the written scope of our contract.  The original glass would have fit fine, had MHC taken simple steps to properly measure the space and installed the new tilework to the same dimensions, as was easily done by the prior contractor.   The issue was brought to ************* attention in person on November 2, 2022 during which time I indicated a willingness to compromise a solution.  However, this was only met with anger/hostility and an unwillingness by MHC to accept any responsibility for the issue.   The contract was left unfinished and the credit *********** claims to have offered is just the amount for unfinished part of the contract, which he is not entitled to regardless.
