On 2/28/2023 I contracted with **** to provide several services related to a renovation. At that time I also paid him $1500 as a retainer for him to produce the drawings. When he came over to my house, he spent all of 20 minutes with me. During the conversation I explained to him my original vision but told him I knew that wouldn't work as I had bids from GC's and I knew the cost. I told him what I had come up with as an alternative. When he presented the drawings to me he drafted a design that was exactly what I told him I would not be able to do. Right after he sent the drawings, he billed me for the balance of the proposal. He had already been paid for the drawings. Additional services included working with me, the client, to ensure the design was what I wanted, finalizing drawings, selecting and working with a structural engineer, Interview of Owner to develop a Programming Document, Investigate local zoning and building code constraints, Review Owner-supplied information (neighborhood covenants, agreements, etc.), Review feasibility with Owner prior to proceeding, Photograph, evaluate and document site as necessary. Commission geotechnical, topographic and boundary surveys as necessary, pulling any necessary permits and more. He did none of this. When I asked him why he was attempting to collect the balance he said the drawings cost $4500 and the retainer is just a retainer and I had to pay the balance of the contract ($6000 total). I pushed back and he immediately threatened to take action against me. In subsequent communications it was all about him justifying the services and costs and demanding payment. He has filed a mechanics lien to attempt to collect what he claims is the balance of due for the drawings. The amount is arbitrary and does not make sense based on all the other services he was to provide. I want the lien removed and my retainer of $1500 returned to me. He did not do his job, not even close. He needs to be investigated.

    Business Response

    Date: 12/14/2023

Our principal owner/architect has been a respected business owner in this community for over 25 years, with zero complaints.

*********** paid a retainer of $1500.00 to start the project, per the contract. After several site visits and time spent to design her remodel we provided her with architectural drawings, per the scope of our contract, and we billed her for a balance of $4500.00.

************ admitted she did not want to go forward with the renovation. However, she now has full access to the architectural drawings provided by our firm. If she chooses to, she can move forward with her project at any time.

After many failed attempts to communicate with her and settle our bill, we had no other choice but to seek legal counsel. Our attorney reviewed the contract and advised that we go forward with a mechanics lien. This will remain in effect until payment for our architectural drawings is received.
