    Contracted JJ landscaping to do a stamped concrete patio, walkway, 2 small concrete slab extensions, retaining wall and firepit for **** in early May 2023. After several delays in pouring due to rain and JJ landscaping not being able to book a concrete company the pour of concrete finally occurred on June 23rd. There were several opportunities but potential rain was given as the excuse. After pouring ** was contacted several times about finishing the seal. After forms were removed we found the sprinkler lines were punctured and water drained under slab eroding some foundation. Additionally no color was added to the stamped concrete mix as agreed.. and antique powder on top was not the color agreed to. The forms were not removed prior to curing and edging was not finished resulting in an unfinished look on edges. I was willing to work with ** to just finish the job but he began to make excuses about not having a truck and having back problems. Several days were promised to finish the job but no further work occurred. The concrete was never power washed and sealed and retaining wall and firepit was not built. He now argues he does not owe the wall and firepit because was "free". He does not feel any money is owed back because it was "free". The cost was 700 deposit, **** upfront and **** at end of job. I have paid **** which includes **** as he said he needed it to keep going with the project. I am requesting the **** back as it was never completed. It will cost more than that to fix the foundation work and complete the project. ** is now claiming since the retaining wall and firepit were offered as free they are not required to be done. Clearly it's in the contract and was provided pictures of what final outcome would be. Had that not been in the contract I would have not hired **. I'm only seeking the **** I paid prior to work being completed.

    After I discussed with ** that he was not meeting the terms of the contract I received a new invoice with the retaining wall and firepit removed and added to the overall price for rebar. Added note states I must pay remaining balance before he "will do retaining wall work and firepit". So he removed it from the contract to make it look like it was never included.
