On Jul 1, 2023 at 8 am, ***** and ****** *********, owner of **** **** ** ** *****, and property managers ****** and ***** ***** (***** ******** **********) met with Neilson N**** at **** **** ****** to discuss the scope of two projects: 1. Repair and upgrade an existing wall separating unit 2 from the rest of the building. This was the first item to be done. It wasn't, and he said he needed the $6,260.00 below first (which we paid on 7/28/23) and then he would do the wall. We paid him 50% of the wall job ($1,934.46 by credit card on 10/24/23) to repair the wall. He didn't show up to work on the wall, has not returned calls or emails and has not returned the money. Wall is still unfinished. 2. Prepare plans and remodel an apartment in the building. N**** said he would start on this task first and needed $6,260.00 to hold the plumbers and the electrical subcontractors, to prepare plans and submit permits. We paid $6000 per check on 7/28/23 (see attachment) and never received plans. No work is scheduled, there are no subcontractors and permits have not been submitted. Our property manager and ourselves have contacted N**** numerous times in the past 2 months by email, phone and text. He is not responding and seems to have disappeared.Initial Complaint

HE CAME TO INSTALL A FAN LIGHT AND THEN WE DISCUSSED THE BATHROOM REMODEL. WE DISCUSSED THE PLANS AND AGREED ON WHAT I WANTED DONE. HIS CONTRACT WAS FOR $4814.39 AND HE STARTED ON DEC. 02, 2022. I SHOWED WHAT ITEMS I HAD INCLUDING ALL THE BIG COSMETIC ITEMS TO INSTALL SUCH AS VANITIES, LIGHTS, FLOORING,FAUCETS,SHOWER AND PAINT. ***** STARTED THE JOB WITH USING A PLUMBER AND AN ELECTRICIAN IN DEC. THEN ***** COMPLETED IT HIMSELF AND CHANGED THE TOTAL PRICE ON DEC. 28 2022 AND I PAID HIM $5982.43 FOR SOME ADDED ELECTRICAL AND PLUMBING SUPPLIES. I PAID FOR SOME ADDITIONAL ITEMS ON MY HOME DEPOT CARD. ***** KNEW HE WAS COMING BACK FOR SOME TOUCH UP ITEMS LIKE PAINTING, NAIL HOLES, INK SPOTS,SHOWER WAS LEAKING WATER ON FLOOR. WE SET UP AN APPOINTMENT TO DO THESE ISSUES FINALLY ON JAN.23,2023 AND HE DIDNOT SHOW UP OR CALL. I CALLED AND TEXTED EVERYDAY. FINALLY TALKED TO HIM, HE SAID HE LOST HIS PHONE,GOT A NEW ONE AND SAID HE WOULD COME ON FEB.03,2023. I CALLED ON A DIFFERENT PHONE ON MARCH 02,2023 AND HE SAID HE WOULD BE HERE TO FINISH ON MARCH 06,2023 HE DIDNOT SHOW UP AND I TEXT HIM EVERYDAY AND CALL AND NOW NO RESPONSE SINCE THAT DAY. I NEED THIS FIXED ASAP AND HE SAW THE LIST, HE SAW THE PAINT ON WALLS DOES NOT MATCH,HOLES IN WALLS,TILE NEEDS CAULK AND GROUT,SHOWER TOP NEEDS REPAIRS AND PAINT,BASEBOARD AND WINDOW FRAME NEEDS PAINTING,HE HAS MY BATHTOWEL BAR,PLUG DOESNOT WORK,HE WAS GOING TO TURN THE LIGHT DOWN AND PAINT THE CEILING PLATE? Hello, my name is Mr. **** or ***** ******* calling regards to a complaint from ******* ****, guess march 15th, me and her had already settled that situation with a refund of money and other options for other people to come take care of the job that she just did not really have. It was just scheduling in the long run, but also in the fact that she kept changing things throughout the project and made it very difficult. So, I ended up refunding her some money and giving her options for other people that could satisfy her needs to getting the the minor painting done and a little bit of drywall completed. Good afternoon,
In response to this, since I was under the impression that upon payment refund this arrangement was settled and it was just under a month before I was contacted, I will offer An additional $150.00, Since I do not believe That trying to go over there and repair these items for her will become more of a heated environment and cause her more stress. This will bring total refund amount too $500.00 And in Montrose area most handyman are charging $250.00 for a full day work. This payment will have to wait till the beginning of next month due to us having maxed out capital on projects for this month if completion earlier on other projects. Will gladly mail a check and regards to this complaint.
In regards to specific statements of her response these are mine,
price for original ESTIMATE was stated that it's is just an estimate and price could change, with removal of more plumbing since the plumbers she had hire two years before did not do the drains to code they had to be removed and redone, Could not see this until accessing the plumbing. Electrical was in the same realm where they did not have anything set up except for the GFI that she has stated that is not working. We did use the same outlet throughout the project and was working fine until our departure. That would have cost more money to repair. I did purchase a new one and gave it to her. The new floor installed is a vinyl flooring which will take time to adjust to the bulge that I showed her. The light that she is requested to have flipped over. I had voiced my opinion that it is too dangerous due. To the brace that hold the glass shades were not sturdy enough. Yes they are able to be reversed. But 2 of those clips would not seat all the And could result in them falling.
In regards the paint she was charged for 3 Coats of paint to be applied to the walls. We were on our 5th coat and after speaking with many painters in the Montrose area. It was more likely that the paint itself was of poor quality. After avoiding that we would have to charge for that she stated it just a touch up on the whole wall.
The over spray on the trim. Was going to be addressed But during the painting stages she was indecisive on whether she wanted the hardwood look or the painted white edging.
I do understand how stressful it is for her to have too make so many decisions In regards to a bathroom that has not been completed in over the last 2 yeand after having to fire the previous installers. She is a very nice lady And it was much harder to have to cancel that type of project. And subject her to having to find someone else. I do hope this can be resolved In a peaceful manner.
