      In short, I had an engineered onsite waste treatment system (****) installed by K&A Mechanical in July 2021 at my primary residence. They were also contracted for O&M (Operations and Maintenance) inspections. Since the **** installation, it has remained non-functional for approximately 6 of its 21 months in service. Throughout these 21 months, my yard has been periodically inundated with raw sewage, my shop and portions of my yard have been periodically rendered unusable due to septic gases not venting appropriately, and most recently I was sent a bill by K&A for ******* (****** of this was a labor charge for use of a heat gun to thaw a pipe) for repairs related to the system freezing and ceasing to function in February 2023. I provided K&A weather reports from the national weather service indicating that temperatures were within normal limits, but they still attribute my system's failure to unseasonably cold weather.I have filed complaints with the county and disputed K&As February 2023 bill, as I feel that the services rendered pertain to K&As status as the installer of a chronically malfunctioning system, and not its status of O&M inspector. As an installer, it is their responsibility to provide a safe, reliable system, which to date they have not been able to do. I was never advised that I would be charged for that visit and was not provided an estimate for repairs. If I had been, I would not have authorized K&A to perform the work. I was under the impression that they were still trying to figure out why their system was so problematic. At this point, I will incur additional out of pocket expenses to have the system maintained and upgraded for next winter. The work of K&A Mechanical has resulted in ongoing malfunctions resulting in leakage of raw sewage and permeation of septic gases throughout my property.

      Nolan Jaeger reported that the Septic Alarm was going off on 2/06/23. As usual, K&A responded the same day. The effluent level was TOO HIGH in the pump chamber for a diagnosis of why the alarm was going off. Nolan Jaeger was informed that it would need to be pumped to diagnose the problem and to insure they would not be out of service.

      We returned the next day after being notified that it had been pumped and could NOW detect a frozen pipe that was preventing effluent draining into the STA (Soils Treatment Area). The pipe was thawed, and the septic system became operational again as intended. All of this was done with “0” back up into Nolan Jaeger’s residence but now he does not want to pay even though he was clearly enriched by the service (which does not fall under any service outlined in the O&M Inspections Contract). The bill for that service is now over 60 days past due.

      As to the charges of K&A installing a defective Engineered Septic System, there are several problems with Nolan Jaeger’s claims.

      1. He did NOT hire K&A to install an OWTS (onsite wastewater treatment system). K&A’s contract was with the PREVIOUS owner to “install a new STA (Soils Treatment Area) in July of 2021 because the existing STA had failed. (Commonly understood as a leaching field)

      2. El Paso County Public Health Industry Regulators and the Design Engineer inspected the installation prior to back fill on 7/23/21. Installation passed both inspections WITHOUT ISSUE as is documented on the County’s Assessor’s Site.

      3. There have been a few issues prior to the frozen pipe, and K&A responded to those calls within hours to resolve the problem which kept his system functioning without his family being out of service or suffering a backup in the residence. One was 2 components of the panel failed. Another was a bad seal on the pump chamber lid. They were resolved quickly & under warranty.

      As to the charges that the ***Installation has remained non-functional for months is quite misleading. Nolan Jaeger entered into a County-Required 2Year O&M agreement with K&A on 10/04/2021. The 1st and 2nd of 3 O&M Inspections were done on 10/27/21 and 5/16/22 according to the regulations put forth under the O&M Inspections Program. All components of the system were found to be functioning as intended at that time and reporting of those facts was filed with the El Paso County Public Health governing body at that time.

      We received notice that Nolan Jaeger wished to cancel his O&M Contract 4/20/23. He was mailed the unapplied funds for the 3rd of 3 required inspections which he deposited, and that check cleared our bank on 5/10/23, even though his financial obligation to K&A from February 2023 is now 60 days past due which we would appreciate his taking care of at his earliest convenience.

      It is a shame that Nolan Jaeger as well as numerous others in the county suffered frozen pipes this past February because they can be very costly repairs. K&A has since day 1 made it our mission to be there and help our customers through these bad situations.

      It is also a shame that K&A has had an A+ accreditation with the BBB for 21 years helping out our community and receiving many kind and complimentary 5 STAR reviews. Unfortunately, those reviews fall off after 3 years, so it looks very bad when I have not pursued asking continually for nice reviews. It is also quite apparent how damaging a misguided and maligning review can be.
