      Mr. ******** has never done business with Potestio Brothers Equipment directly. ******************** did place an online order with ************** & ** at shop.deere.com. The part went back order and was cancelled per ******************** request when he contacted ************** & **. directly and they should refund his credit card within 5 days per **************'s policy. ******************** has made contact with Potestio Brothers and was informed to make contact directly with ************** & **. as this was a direct order not placed through Potestio Bros.

      I am rejecting this response because:
      Potestio Brothers Equipment ,in ****************, has refused to pickup the unsafe tractor and has offered no help in resolving the issue of the tractor they sold me that fell on top of me.  This company needs to stand behind their equipment and their customers! 

      EDIT TO ADD: My name is *********************** and I filed a refusal to, Postesio Brothers Equipment, response.  I forgot to say that I do not have an Attorney nor have I ever hired an attorney, concerning  this complaint!  They are a corrupt company.

      medication did not work.. Thankfully, it stopped. I was sent home with an EEG MONITOR GLUED TO MY HEAD AND AN EKG ATTACHED TO MY BODY. I am 68 years old and have driven tractors for at least 45 years and NEVER HAD THIS KIND OF PROBLEM WITH ANY OF THE PREVIOUSLY OWNED TRACTORS! The next day after finding out what had happened two men Potestio Brothers went to my home took a Quick Look at the tractor and found the tractor had not suffered any damage! Their driver lost the check I had paid in full for the tractor and my friends had to write them a check, which was cancelled and I still not thinking clearly wrote Potestio Brothers the full payment for the Tractor that almost killed me! After 4 visits with a Neurologist it was found that I had suffered a Traumatic Brain Injury to my left temporal lobe.Protection Brothers was called again and again to come and take the tractor and mower away and refund me the $$$$$ I had paid. They have refused to pick it up or refund my money!

      While we were deeply sorry to hear about ************** accident and her injuries, this incident requires far more investigation from all parties involved. ************** has threatened legal action against both **************, **** and Potestio Brothers Equipment, Inc.  We have submitted this issue to our legal counsel, and we will continue to work with our legal counsel to try to resolve this issue. On advice of legal counsel, we cannot offer any additional comments about ************* accident.

      I am rejecting this response because: PBE did NOT fully inspect the tractor that fell over on top of me!  They have NOT Ever gotten back to me at all about any resolution they say they have that is fair to both parties??  I want this business to explain the solution they say they have come to that is fair to me!

      As stated in my last response, Potestio Brothers Equipment, has never inspected the dangerous tractor, nor have they provided any solutions to me at all.
      I am wondering what the next steps are, considering the fact that their reply was totally false!

      My office is conducting a legal investigation into ************** allegations and demands.  Our investigation to this point suggests that ************** is a dishonest person who may suffer from a mental health issue or issues. In her rejection of PBE's response ************** states that she doesn't have an attorney and has never hired one. See document attached hereto. Email from June 11, 2024 from *********************** to *********************** where ************** states that she does have an attorney and she and her attorney will be in touch and will be suing PBE.  We have obtained other official documents from emergency services that indicate that the incident as ************** describes it never happens. We have also obtained a statement from an eye witness who indicates that ************** story is mostly fabricated especially the part about the defective tractor, how she was driving it, her injuries, etc.  ************** is a fraud, and she is trying to perpetrate a fraud upon BBB, its consumers, the public in general, and PBE. And, if ************** persists on her same course, PBE will have no choice but to bring legal actions against ************** and any other person and/or entity involved.

      We called Potestio Brothers **** Deere in ****************. On August 18th 2023 we called to get a quote on splitting our tractor tobreplace the main gasket between the engine and transmission along with seeing what was going on with the transmission as the tractor wouldn't move. We were quoted between 14 and 17 thousand. We tried having the tractor picked up using the dealership but they said they had truck issues. So we called a local mechanic to look at the tractor for us. He started the tractor and pulled codes on the tractor but was unable to determine what they meant. So again on November 27th 2023 we had a local towing company pick up the tractor and deliver it to Potestio Brothers to have the codes read and diagnostics ran before work was to be done . On the morning of the 27th my son met the towing company to load the tractor he filled all fluids and started the tractor one hour prior to pickup so the loader could be raised for loading. He then followed the truck into **************** were the tractor was started again and the loader raised to be unloaded. On December 21 2023 my son was contacted by the service manager at Potestio Brothers to let us know diagnostic tests had been ran and the the shuttle shift was our problem with the tractor. At this time he was informed that the engine had blown during the test. He had a conversation with the mechanic explaining that at this point he suspected a blown engine stating he has 20 years experience, and per the book, after pulling the codes, he ran our engine at **** rpm to recalibrate the transmission to see if thst would fix the transmission issue. During this test he was outside the cab of the tractor and the engine started to whine then knock before he could get the machine shut off. He then told my son that the engine was our responsibility at which point he told them to call my husband and I. They have since refused responsibility and are telling us they won't repair our tractor.

      Customers (**** and ***************************) appointed point of contact their Son (*************************) came into the dealership in August of 2023 and spoke with service department asking about getting service work on their tractor.

      The Customers Son stated that the tractor was not going into gear and that it had lost all hydraulic fluid and was not moving.

      *** ****************** explained to the Customers Son that we did not have a truck capable of picking up that equipment at that time to have it looked at, and advised the Customers Son to have a hauling company bring it in.

      On November 27, 2023 the tractor was delivered to the dealerships yard. The tractor was started by the Customers Son, followed by him engaging the hydraulic system to lift the loader off of the tow truck bed allowing the tractor to roll off of the truck in the yard.

      On December 21, 2023 a *** Service Technician went out and did a general visual and an in-depth check on the 6130D Tractor. Mandatory vitals check on the machine was conducted, including but not limited to all oils, hydraulic and engine, and coolant levels, which were all checked and observed to be within manufacturers specifications for safe and manageable operation. Upon further inspection it was observed that the engine oil drain plug was threaded in finger tight, at which point a *** Technician tightened the engine oil drain plug. (See statement below regarding prior mechanics working on unit before it came into *** CS Location)

      We reviewed the Customers complaint and went through processes and procedures set forth by the manufacturer and pulled the electronic codes off of the electronic management system which directed us to the transmission calibration procedure at which point the machine came in the shop and a *** Technician then started the tractor to begin diagnostics on the transmission per the customers complaint of the transmission not going into gear or moving by following all manufacturers specifications and procedures of diagnostics based on the customers complaint.

      A *** Technician started the manufacturers steps and procedures for calibrating the transmission. Upon starting the procedure, they heard the engine emit a loud noise at which point the *** Technician shut the engine off immediately and abandoned the calibration process without finishing it due to the noise made by the engine causing concern. No further attempt at this point was made to re-start the engine.

      ****************** notified the Customers Son that during the manufactures process and diagnosis procedures, the engine emitted a loud noise at which point the engine was shut down immediately and posed an additional concern. *** service department then stated that due to the additional concern,in order to do a full diagnostic with the added and unknown issue the cab of the machine would need to be removed from the tractor chassis to do a full diagnostic to determine the damage. At which point the Customers Son stated that he knew that there was an engine oil leak and that there was more than likely a bad rear main seal and that he would contact his parents to inform them of the issue that was unknown to *** from the customer to see what they would like to do and if they would like to perform the full diagnostic to get a quote or if they would like to decline the repairs.

      Customer called back and spoke with the ****************** and stated that they did not know how this could have happened and that we were at fault for the damages. (Please see above referenced statement where the Customers Son knew of this engine leak from prior mechanics but did not notify ***, and this was a lack of communication between family members and not ***) At which point *** service department explained to the Customer that their Son had informed us that the tractor had a bad rear main seal which was not disclosed to us prior to arriving at *** CS location as well as the machine did not show any engine codes showing it had engine issues. It came in displaying transmission codes which aligned with the customer complaint. We informed the Customer that their Son had told us after running diagnosis on the tractor and this incident that it had a bad rear main seal. All of which was not disclosed upon inception of machine coming in or upon complaint of customer, this was not disclosed to *** service department until after the diagnostics procedures were started.

      On December 22, 2023 the Customer boldly informed us that they were going to be suing us over the situation which is deemed unfair and unethical, that the rear main seal was bad and it was known by them prior to the *** service department working on the tractor and further more giving false statements of equipment troubles.

      On January 31, **** *** service department contacted the Customer to inform them that *** will not be doing any repairs at this time due the accusations and legal threats toward ***. The Customer was then informed of the diagnosis fee owed on the equipment and made aware that a safety waiver needs to be signed off on for the equipment to be picked up. Once again, the Customer informed us of their notice to bring legal action and at this point communication was seized and stopped. Due to the multiple bold threats from the Customer regarding her getting legal involved, and the false statements of the equipment condition when it came in, Potestio Brothers made the decision alongside our legal team to stop doing business with this unethical and threatening individual, who has used a threat pattern against us. And at the advice of our legal team, we have stopped doing business with this customer altogether. The Customer has since also filed a complaint with the Better Business Bureau against the manufacturer prior to filing one against us.  

      On January 31, **** the Customers Son called into *** service department and left a message stating that he would like to pay for the diagnosis fee on the tractor and get the tractor picked up.

      On February 1, **** the Customers Son was called by *** service department and was informed of the diagnosis fee and of the safety waiver needing to be signed in order for the equipment to leave the premises.During this conversation their Son was very cordial of the situation and spoke favorably of our dealership. He informed us that this situation was difficult due to it being between his parents and ***. During this same conversation it was disclosed to *** that the Customers Son had two mechanics look at the tractor as well as a competitive **** Deere Dealer prior to it coming to ***.Which then brings questions as to why it was brought to *** CS location to be worked on after being at another **** Deere dealer that would have the same access and capabilities as ***.

      On February 02, **** Customers Son came into *** CS location and paid for the diagnostic fee on the tractor and asked the ****************** if he could schedule the tractor to be picked up without signing the safety waiver to which he was told no due to the safety concerns of the condition of the tractor. The Son then told *** service that he would schedule to have the tractor picked up tomorrow if possible.

      In previous conversations the Customer stated to *** service department that the tractor was only 90% low on hydraulic fluid before it came to ***, raising further questions as to the machines health and improper use at some point, were as it was possibly ran low on engine oil. (See previous comments regarding *** Technician findings on loose oil drain plug)

      Due to the poor condition the tractor was in when it was brought to *** for diagnostic such as the machine having ******* engine hours,overall mechanical condition of the machine, repairs exceeding the value of the machine, the original customer being a construction outfit utilizing this machine for industrial purposes, and the manor of communication from the Customer to ***, we will not be doing any repairs on this tractor. If there are any further discussions needed in this matter or documentation that is necessary,please let us know so that we can provide any and all documentation needed for you.
