Hello ******, we recently had a complaint on bbb, but the customer settled with us, and signed that they would not leave poor reviews like the one found on bbb under the claim in my subject line.

I attached the settlement, please view #8 of the settlement agreement. Please let me know if we can get this removed, or if we should go back to our lawyers.

    Thank you!

Jim Black Construction (JBC) was contracted to assist with remediation, and associated repairs at my residence in May of 2022 due to an accidental fire that caused damage to my garage. We had to move out of our home as repairs were being done. Since we were not there during the winter months, JBC had one of their plumbers 'winterize' our heating system. We have a hot water heat, Boiler system and the JBC plumber failed to blow out or remove the water from the boiler system. When we went to turn the boiler back on in March to restore heat, due to the fact the water was not blown out properly from the pipes, we had 23 burst pipes which is $8,050 worth of repairs. ********** charged $350 per leak repair which is within industry standards for this ($300-$500). That doesn't include the 7 sections of drywall repair. When notified, JBC accepted no accountability saying their plumbing work has no warranty. This is clearly a case of negligence on their part as the only way a pipe bursts in this case is when water is not removed. They offered no compensation for what is entirely their mistake. I am seeking reimbursement of the cost to fix this from JBC . I am attaching photos and other supporting documents. I am also going to write a review about JBC. In general the employees were OK to work with, however company owner *** Black was unprofessional and confrontational. Please let me know if you need additional information. Sincerely, ***************************

    Hello ********,

The last time we worked in the home was in November of 2022.  The house has been inaccessible and in your care since.
We winterized and shut the water off to the home.
We installed temp water so we could perform the abatement per the approved insurance scope and amount, which was complete.
Following abatement, it was discovered that you performed your own removal and clean-up of additional asbestos material, by scraping all of your acoustic ceiling texture throughout your home, which takes water to soak the texture to facilitate the removal.
We cannot account for other parties restoring water to the home, when this was done, and if done properly.
We did not restore water to the home.
Because of the above facts, JBC cannot be responsible for the damages to your plumbing system.

I am rejecting this response because:  The removal of the acoustic popcorn ceiling was done and complete at least a month BEFORE the winterization of the heating system, so there is still liability on the part of ***** Black Construction.  I would be willing to take half of the amount of the repairs and not including what it cost to fix the drywall and ceilings.

    Sincerely,

    **************,

I am not sure of the exact date and timeframe you are referencing in your statement "The removal of the acoustic popcorn ceiling was done and complete at least a month BEFORE the winterization of the heating system", therefore, I have provided the invoice from the plumber showing that the winterization of the home was done on 10/12/22, in addition to ************* stamped photos showing you actively working in the home on 11/9/22. With these two pieces of information, this would prove your statement to not be accurate.

Again, I can not be responsible for a job site to ensure its well being if we other people / contractors are actively working in the home, performing services that generally require water, such as scraping acoustic ceiling texture.

Additionally, if you felt this was our responsibility, we should have been notified prior to you having all of the work performed for an astronomical price, and had the opportunity to verify liability and make the repairs.
