Consumer is a part-time resident in *******, **. Consumer needed new front door. Order for double front entry door was placed with the business spring of 2023. Business took measurements, doors were delivered spring of 2024. Installation was performed by contractor who referred by business. Consumer separately hired contractor to stain doors. When consumer first saw the doors in 6/24, consumer observed daylight coming thru door panel inserts, from the perimeter of doors and where the doors meet in the middle. Multiple written and verbal requests for repairs have been met with indifference and refusal. In summary, the consumer had a binding contract with the business. The consumer upheld its responsibility to pay the business without having the benefit of inspection. The business did not deliver a merchantable product, and failed therefore to honor the contract. The consumer paid the business. The business NOW discloses the existence of third parties the business chose to work with, including a "broker" and a 3rd party who ACTUALLY manufactured the doors without consumer's prior knowledge. The business made a profit on the transaction, the middle man made a profit, and the ACTUAL manufacturer made a profit. The consumer is out the money paid to the business (approx $10,000), the money paid the installer that the business referred the consumer to, the money paid to the painting contractor hired by the consumer independently, and the money it will require to find a contractor to manage the removal of and the procuring, installation, and staining of another set of doors. The consumer estimates total damages of in excess of $30,000 plus costs, but that this time, is only seeking the business' cooperation to assist the consumer, a senior citizen, to have protection against the elements this winter where wind, snow, and frigid temperatures set in in November which may force the consumer to seek shelter elsewhere for the winter.
