During a repair to a balcony, All Phase Restoration caused damage to our car 4/15. We were put in contact with *** *******, who I met with to look at the damage on 4/22. When speaking to him, he said he would not have an issue paying and would reach out later that week. On 4/29, *** left a voicemail saying he wanted to get it figured out (or, rather his words of, "put to bed"). On 5/2, we sent him a quote from a repair shop for $2,563.88. On 5/6, he called and said he would give us a check for $600 or nothing at all. By offering compensation, he is admitting fault and should cover the whole repair.

We take allegations like this very seriously and are committed to addressing them with integrity and transparency. However, the narrative presented in this complaint is not an accurate account of events and borders on extortion via public pressure and defamation against our company.  If the ************************************* does indeed decide to dedicate resources to this issue, by all means, please have them contact us immediately.

Mr. ******** ***** initially submitted a complaint through community management, who then redirected the matter to us. Upon notification, our representative *** ******* promptly reached out to Mr. ****** The claim involved a dent on the hood of his vehicle, which he alleged was caused by one of our subcontractors dropping a wooden beam.

*** inspected the vehicle and documented the dent with photographs. Based on his assessment, the damage did not appear consistent with the impact of a wooden beam. Nevertheless, *** conducted a thorough investigation, including seeking a professional opinion from a body shop. Additional unrelated damage to the vehicleincluding scrapes to the bumper, a bent license plate, a damaged headlamp, and brush guardwas also documented.

We also made efforts to obtain video footage from the property to further investigate, but were informed that no cameras were available.

Despite the absence of any direct evidence connecting the damage to our subcontractors, and in the interest of ********, *** offered to cover the cost of repairing the hood onlythe portion originally claimed. This offer was made with the intent to resolve the situation respectfully, and included a proposal to pay the repair shop directly upon completion of the work.

We understand that disputes like this can be frustrating, but we stand by the professionalism of our response and the fairness of the offer extended. Public accusations unsupported by clear evidence are deeply concerning, especially when they misrepresent the situation.

We remain open to resolving legitimate concerns, but we will not be pressured by inaccurate claims or public mischaracterizations.

I am rejecting this response because:

PER The original photos, clear damage to the hood, headlight cover and bumper can be seen. However, damage to the license plate is not seen. We noticed this and requested all quotes not contain the license plate. Original photos were sent to the apartment complex who forwarded the photos to All Phase seeing as *** specifically referred to them in our first conversation and knew exactly which car before I got outside (and admitted to looking at it before I was present). The damage to the hood, headlight cover and bumper can be seen in those photos. As the main damage was the hood, that is what we brought up to the complex who passed that message along before we ever knew who we would be dealing with. Due to color of paint on both the hood and the headlight cover, it is clear those happened at the same time.

We submitted a photo when work was in progress on 4/14 showing a man unloading the back of a truck who was throwing things out of the truck right next to the car. The photo does not clearly show damage to the hood yet. Work was not completed until later in the week.

It is clear something fell first hitting the hood and then scraping the headlight cover and the side of the hood as it fell to the ground right about where bumper damage is present. We could hear people dropping things on the ground during the work from our window. Our cat was growling because he didnt like the sound of it. As well as, something fell, a man said something like, aw, s*** That landed on that car, and another man saying something about thats why they carry insurance. I, unfortunately, was unable to go out at that time to discuss it with the workers who clearly damaged someones property (not knowing it was our property). I made a note of it in case I heard of anyone looking for information because I had taken the photo due to them throwing things around. Any amount of reason would cause one to believe that, yes, the people dropping things from above that are working on a balcony caused the damage to a car below, especially after hearing them speak about dropping things and insurance covering the damage to someone elses property.

Im so glad your own people determined you not to be at fault without ever knowing what was heard because we spoke for less than 5 minutes while I was bleeding from breaking up a cat fight and had my mind clearly somewhere else, which I told him this when we spoke. As well as he tried to stop the conversation as soon as I mentioned I had a picture of someone unloading stuff from a truck parked next to the car because they were throwing things around and onto the ground. Its almost like a biased opinion was the goal the entire time. We will be contacting someone of our own to assess.

*** also mentioned to me how he could see the damage being from them doing the work during our conversation. What changed? The company got to him and influenced the conclusion of not being at fault? So, youre telling me that between multiple workers throwing things around near other peoples property (vehicles and a balcony below), a worker mentioning something fell on someones car, another worker saying thats why they have insurance and the person who supposedly decided All Phase was not at fault telling me he could definitely see how the workers caused the damage, that Im just supposed to accept it because that is defamation of a business who claims to be honest, trustworthy and do whats right? Maybe I grew up differently, but from my experience, you  are the exact opposite of what you claim to represent dishonest, untrustworthy and choosing profit over whats right.

Did the professional opinion look at our car with neither of us present? If so, that is a violation of our rights as the owners. We got four different quotes with the lowest one being almost $2,600. In ********, the owner has the right to choose who does the work on their car, so even speaking to a body shop without our consent about the issue is untrustworthy and violating our rights. $600 would not cover us getting a new hood and replacing it ourselves not to mention the damage that was clearly caused at the same time as the hood.

I have attached the specific photos referred to in this response again for your convenience.

      Regards,

      ****** *****

Weve looked into your complaint and tried to handle it fairly from the start. But you still havent shown any clear proof that we caused the damage to your car. The roughly $600 offer we made was never an admission of guilt it was just a good faith attempt to settle the matter and move on, even though the evidence didnt point to us. We made that offer because we were trying to be decent, not because we thought we were responsible. Since that offer has been rejected and this situation keeps escalating without facts to support your claims, were taking it off the table. If you still want to pursue this, youre welcome to speak with our attorneys going forward.
