I hired this co to install a deer fence, after reviewing details about proper deer fencing with the owner J. Martinez and agreeing to pay more to get it done right. The fence I got was defective in design and installation. E.g., it buckled and opened at the bottom where animals could run though, the corners and top tension wire were done improperly making the fence unstable, the fence was cut at the corners leaving sharp wires exposed. The installers stood on my stone retaining wall bordering the driveway & knocked it down, leaving a dangerous condition.
I told Martinez about these problems, but he just said talk to his guys, who didn't speak English. I sent my young assistant to speak to them in Spanish, and they sexually harassed her! Martinez kept demanding payment. Ultimately, he sent his guys out to my property again with no notice, scaring my assistant to death.
I told him I wouldn't pay the $1275 balance, due to the defects & damage to my stone wall. l spent $600 to fix the retaining wall & will have to spend $1700+ to fix the fence.
Martinez had the nerve to sue me in small claims court for the balance. He knows how to fool the magistrate judges. He didn't show up for the first hearing and lost, but he later claimed he had to care for a sick wife and the court reopened the case. He slept on his rights for years but 5 years later the ct. set a remote trial date. By then, my assistant could not be located to testify. But I had a strong case, with photos & docs to show there were defects with the fence, I told the owner, and he did nothing.
At trial, Martinez claimed I wouldn't allow him to complete the work. I pointed to emails and texts showing this wasn't true: He said the fence was done and demanded payment. But the judge did not want to take the time to review the evidence--he just wanted to rule.
I'm outraged at his ruling, ordering me to pay 1/2 the contract amount plus court costs.
DO NOT USE THIS CO. The owner is unscrupulous and relentless.

*** ******* hired JP Diamond Fence to install a deer fence on her property a few years ago. The deer fence material was ordered from a company that has over 50+ years supplying fence companies with the best material in the trade. During installation ******* wanted to make changes to the project which we did everything in our power to accommodate. Because she was "unsatisfied" by the installation she threatened to call the police to get us off the property which made it impossible to complete the project and remediate any things she did not see as satisfactory. It is in fact stated that the consumer must certify that their review is truthful and accurate, and reflective of their personal experience, in which ******* has made false allegations with no proof. There is no proof of any sexual harassment occurring and if there had been, all possible disciplinary actions would have been taken to pursue justice for such an egregious offense. ******* thought that withholding any payment for work being completed on her property is legal. With over 2 weeks spent performing the work to install the fence and money spent on employee wages, ******* decided that she would not pay for any labor completed whatsoever.
A small claim court trial was held on Tuesday June 20th where Ms. ******* ultimately lost her case against JP Diamond Fence and was ordered to pay 50% of what she owes and her bogus counter claim was dismissed. The court and the Magistrate were very fair and had taken to review with enough time all the "evidence", while ******* is alleging they did not.
As a result of her loss she has decided to, in a manner that is most unprofessional, abuse this platform in retaliation for her loss in the case. This is a case of unjust enrichment where someone had work completed on their property and thought it would be okay to withhold payment for labor. Her review to the BBB is both discriminatory and an act of defamation to a small minority owned company that has been in business for over 12 years.
