      After reviewing a favorable BBB report, I contacted Neil C** of Ct Top Notch Tree services for trimming (no removals) of several trees in my front yard. We agreed to the price of $1000.00. On August 2nd he came to our residence, requested a 500.00 payment and began the trimming of some trees. He came back on the 12th to finish the trimming (or so we thought) and asked for the balance of 500.00. He did not finish the trees but asked that we allow him to leave his two vehicles in our yard and that he would return in a few days to finish up. Ten days later, he never returned to finish our trimming. When we contacted him, he said he was working on another job and would get back to us. So, after waiting for 3 weeks, looking at his trucks in our yard and knowing that he was already paid in full, we asked that he take his vehicles off of our property. He took the vehicles, never finished the job and does not have a plan to. We would like to have the job completed as promised.

      I hired Neil/Top Notch to install a black chain link fence last year. We signed a contract /gave him 1800.00. for a 4 ft high fence. We paid for a new fence, but the materials were badly used. The chain link was bent, rusty, and had twigs and vines that had grown through it. I called him before he could install this product. He said he'd get new material. After multiple calls w/ no response for weeks he sent 2 guys to dig holes without telling us. The guys he sent dug holes in the wrong spots. They dug the holes about 15ft from the agreed plan. They hit my underground sewer line. They also dug a 2-foot hole directly in front of a window and ripped ground wires running against my house out of the ground leaving them hanging from the side of the house. When I saw this, I called Neil immediately. He agreed to come back himself but waited weeks. Giving multiple excuses. (I had my son fill the holes during my wait for him). He then dropped off silver poles. When i called him about this he said they don't make black poles (untrue.) I told him to drop off the new correct supplies when I am home. After waiting weeks, he showed up with short used black poles and no new chain-link to replace the used one that still sits in a pile in my garage. I told him we wanted our money back. He said he spent it already. So, we decided to let him try one more time. He showed up with no new poles and started pouring cement and installing the 4- and 5-foot used poles in the ground without letting me know he was here. When I eventually saw him outside, I told him to leave. He then drove his truck across my neighbor's front lawn. (My son reseeded and filled the track damage) I waited a few days to see how well the short-used poles held up. They fell out without even putting pressure on them (I am disabled.) I asked him to remove his material and refund our money to no avail. That was over 8 months ago.

      In the rebuttal of what I was accused of which were not true for one thing, I have a three day resend contract on the contract and the materials that I delivered were not used or Old they were all brand new. The only reason it would have Branches in the fence is that he left it sit outside too long commercial grade fencing the holes were dug in the wrong place, but then they were dug in the right place, and he never mentioned anything about the wires to me on my contract is the diagram of what was drawn up and she agreed to so I feel what he has been saying is faults and not with standing and with the contract so I don’t think I owe them any money whatsoever because I did try to accommodate them to the best of my abilities when they  called me about the polls. I came the next day. I did not wait weeks and when I did show up over there half of the time she was in the house and would not open the door and not permitting me. I was going back to go do the job and I was told to leave the premises so evidently he had somebody else to do the job. There was no burning out of any tire tracks in the front yard. I just backed up to drop up material did not leave any tracks whatsoever. If I did I would I would repair myself so that’s not true, at some point she came over to my house and asked me and trade for all the inconvenience to do the landscaping on her property and I said OK that’s fine. I even offered my Services to put the fence back up and I did not hear anything from them at all ,until I got this report.

      I am rejecting this response because: I am going to address the inaccuracies in your response. We never saw or signed the "Resend Contract" as you can see on the document you uploaded here. The fence materials you used were previously used and damaged. Wires were torn out of the home and ground and my sewage line was hit while your crew dug multiple holes. You admitted in your response these holes were dug in an area we both did not agree upon. You had multiple personal excuses for delaying the fence installation. I was always available to you. Including answering my front door. You refused to move your truck that was parked across my neighbor's front lawn causing damage to their property. Which we had to pay for seed and fix ourselves. I have never been to your home, that's bizarre to make that up. Your suggestion that we may have had someone else install our fence is not possible. We don't have a fence because you took our fence money. As in the document you uploaded, it shows we paid in full.  We are willing to set up a payment arrangement and would be pleased if you could remove the debris, you left behind. I have uploaded pictures of some of this debris and damage caused to my property.

      On or around 4/14/22 my wife and I made a transaction with Neal C** of ct top notch tree and home improvement for 5 cords of unprocessed firewood for $500. Neal asked for the payment upfront. He said he would not bring all the wood at once but drop it off in intervals until 5 cords total was met. Between 4/14 and 4/28 he delivered 2 cords and that was the last we heard from him. On 5/17 I texted Neal and indicated we were ready for more wood. He replied by saying the when he cuts a big tree he will bring some by. I asked him when to which he replied "I dont know." I reminded him that we paid in full up front and we expected wood to be delivered in regular intervals. Firewood needs time to season before it can be burned for fall. Neal said we didnt agree on a specific timeline; I said we didnt agree to extend him an indefinite timeline since we already paid in full. I suggested to Neal to either commit to a delivery or refund us $300 for the 3 cords he still owes us. I did not receive a reply back which indicated to me he feels it is ok to take money but not feel any sense of responsibility to deliver. At this point I would prefer the $300 refund as the firewood he did deliver was subpar.

      I am writing per complaint #******** against Top Notch Home improvement and owner Neil C**. Per your instructions, I would like to notify you that the complaint has been resolved. Mr. C** has made large length and round wood deliveries that before processing, I would estimate come very close to the agreed amount of firewood. Mr. C** reiterated that if after processing it is a short of the total 5 cords to let him know and he will deliver the balance. Regards **** **** ******* **
