On October 16, 2024, I signed a contract with Allied Engineering Assoc. ('AEA") for a soil test, septic system plan, and submission to the ********** **** ****** ********. At that time, I paid AEA a $1,600 retainer, along with separate payments of $150 for a soil test application and $250 for a septic plan review.

Under the terms of our contract, work was to begin 2 weeks after AEA received the signed contract and retainer. However, despite my repeated requests for updates, AEA has either provided vague responses or failed to reply. To my knowledge, progress on the project has stalled, with no explanation as to why.

Additionally, AEA sent us an invoice for the full contract amount of $4,000—despite not completing the agreed-upon work, failing to provide updates, and not responding to our inquiries. We have not paid this invoice, as it does not account for the $1,600 retainer already paid. We are willing to pay for any work that has actually been completed, but only upon receipt of written proof detailing the work performed. Regardless, we are terminating our agreement with AEA effective immediately and would like a refund for any portion of the un-used $1,600 retainer and the fees paid for soil testing ($150) and plan review ($250).
Thank you for helping us with the matter.

      Business Response

      Hello,

I do not agree with her assessment of what went on. She called us because she bought a house with 4 bedrooms, but the septic system is only approved for 2 bedrooms. I don't knw how that happened. She hired us to see if we could get her approved for a 4 bedroom design. We did our usual background information search and started work. We put all that we could into the computer. We then went out and tied into the property line and surveyed the locations of the house and well and driveways and large trees in the area of the existing septic. Once we had that, we tried to locate the existing septic system based on an as-built sketch that we got from the ****** **********. It did not seem correct, because the septic system ended up under a 36" pine tree that is probably older than the septic system. I explained that to her and she sent a sketch that showed a new septic tank was installed. The sketch had no swing ties on it to locate it from any corners of a building or anything. In an email on Jan. 9, 2025, I told her that we would need to hire a colleague with a video camera system with a sensor that we can use to inspect the existing system and locate the different parts of the system (septic tank, piping, distribution box, leaching system laterals), it usually costs around $1,500. she did not want to pay that, so we proceeded with scheduling the soil testing. I did all of that legwork because we didn't want to dig up the system she has, especially since it is too small. we contacted the ****** ********** and then it got too cold to do soil testing and it snowed. We need to wait for the snow to melt to resume scheduling the soil testing. On Fb. 26, 2025, she sent an email saying that she was terminating her contract and wanted to settle the bill or refund, wherever it was at. I responded and told her i was sorry she felt that way, but would get back to her about any invoicing.

I will send an attachment in a subsequent email, of all of the email conversations we had from Dec 2023 to Jan, 2025, and her email dismissing us dated Feb. 2026. My scanner isn't working properly. Please let me know if you have any questions or comments. Thank you.
