I hired Coastal Creations ("Coastal") to perform a landscaping installation and a yard drainage solution.

As plants are warrantied by Coastal, in March of 2022 I contacted them to let them know that some of the plants had not made it through the winter. I also sent a photo of one plant that had toppled over completely. As Coastal had delayed initial installation of the plants multiple times, it was apparent that the plants had been installed too late in the season and accordingly many of them had not survived the winter and/or did not have appropriate time to establish roots. Coastal agreed to remedy the topped plant and return in the Fall of 2022 to replace plants that had not survived. That was generally done as promised.

Coastal refuses to remedy/replace one particular plant that is leaning (see attached "Leaning"). Coastal claims the problem is due to over-watering from the sprinkler system we had installed and that such watering voids the warranty. The attached picture ("toppled") was taken in March of 2022, prior to the installation of the sprinkler system, and shows a plant of the very same variety that was installed at the same time as the leaning one. It was also well prior to the time in the season when any material watering would be needed; in fact we were watering only very sporadically as per care instructions provided by Coastal (~1x/month). It is therefore logical to infer that the leaning is also caused by timing of installation (in fact if you look in the background of the "toppled" photo you can confirm the plant had already begun to lean).

There is more history overall; my relationship with Coastal deteriorated throughout the job as a result of various factors and we've had a string of disagreements over various aspects related to this job. However, I am seeking to be made whole for this singular item only as the causal factor is relatively unambiguous and I believe I have been denied the warranty claim improperly.
