    The mason I hired and paid to build a retaining wall and stairs in my backyard has not delivered on the material or work to complete the project and has stonewalled me for over a month. I asked that he cancel the contract and deliver the material that he purchased for me (but has not delivered) or give me a refund but he continues to have excuses why he cannot.

    At this time, I have paid Jim R****** a total of $9,291 and the only thing I have to show fo it is a pile of stone costing $300 and I trench dug in my backyard.

    Stone mason and design was hired in march of 2023 to do an extensive project for us on our outside patio which included new patio, outside bar and kitchen area, steps leading to patio and huge retaining wall. For starters the job has taken over a year to complete, the patio that he installed is so bad that water puddles all over the place also the pavers were not layed level which is reason for the puddling. The retaining wall that he built was done wrong as the seams match up which hurts the integrity of the wall itself. Also there are a ton of gaps in the wall itself. The stairs he built are crooked have way too much of a pitch to them and my daughter recently fell going down them because they were not properly installed and had no glue to hold them down. On a separate walkway he built there are trip hazards all over because he didnt get his grade right and doesnt line up at all. On same walkway he built the walkway too high so now my pool area is out of code because the gate wont close because it gets caught on the patio pavers. His answer to this was to just raise the gate which I dont want to do because it wont look right, mind you the gate was already installed when he did the walkway. The entire outside Bar/kitchen area had to be completely taken down because when the granite people came to put the top on they laughed and said the kitchen bar area was not level at all and the block he used to build the kitchen/bar area were coming apart and not properly laid. This is now going to cost me over 65k to get all this work re done. Please understand that we bought all material pavers, block, cap etc. The appliances that I purchased were pulled from underneath a protective tarp and were left outside in the elements and now cannot be used. I have had him back several times to fix these issues and still was not done correctly. I have asked Mr. R****** for his insurance info and he refuses to give produce it.

    In response to your complaint, it wasn't until you heard through mutual acquaintances of *** ***** review that you decided to follow suit. 

    The same complaints that you have match up with hers and are completely in correct. Let me discuss the facts without going into nitty gritty and he said she said. 

    We spent countless months and hours to give you outdoor living space you had asked for. 

    During these months and hours there were no complaints just constant changes from you that were done to your liking. It also did not take over a year for your back yard. We were finished in November. 

    At every step of the way and when payment was due you willingly and happily paid me.

    There was a point that it was necessary that I had to begin to communicate with you and *** ******* in the same group texts because you were telling her different things than you were to me. *** ******* even gave me a card and a $1,000 bonus from the both of you, thanking me for everything and all the hard work that was done to complete the project. 

    After your extensive back yard project you contacted us again to facade the front of your house with stone which was done as well and you happily paid us. 

    A couple of months later you contacted me again about putting in a foundation for you so you could put an addition by the pool. That project I declined for many reasons. 

    This past late spring early summer you asked if we could come and add another separate walkway(June) for you in the back where your addition was going. That was done and your wife happily paid us again. During that period I was told by *** ******* that you accused her she and I of having an affair and you were filing for a divorce so I couldn't come back to tie up any finishes that needed to be done on the steps. 

    A month after completing the the steps I was notified by the bank you were disputing the payment for over $3,000 in labor from the last set of steps you asked me to do. I sent my side of the dispute back and didn't win of course. As soon as it was granted back to you it was that following day when you submitted your complaint to the BBB and communicated with *** *****. 

    Long and short of this is not about my work.

    I am rejecting this response because:
    The work that was done was wrong, and I even the town inspector has failed it as you were supposed to pull permits for the wall and never did. The reason you were paid was because you kept telling us you would fix it and and when you attempted to fix it it was still wrong. It seems like Jim is not assuming any responsibility for anything. He has 3 complaints against him right now and and for everyone has sorry excuses. My young children are getting there toes cut up on a daily basis because your pavers are uneven, and sinking creating a trip hazard. The outside kitchen that you botched up had to be completely removed because again you had no clue how to do it right. Granite companies were in shock over your sad excuse for work. This back and forth is not going to go anywhere if he doesn’t assume responsibility. You also have puddles all over the patio when it rains, why? Because you didn’t use the correct material. The drainage you installed goes nowhere you never connected it. As far as turning down my addition? I’d give that job to my kid before I gave it to you. So I guess all the people that are going after you are all wrong huh Jim. I have a meeting at my home with the inspector from the ******** ******** ****** and the **** ******** ********* so I’ll let them handle this shotty work if your that’s putting my kids in danger.
