I hired Sunset Landscaping to build a retaining wall in my backyard in October 2022. Less than 6 months later the wall collapsed because proper building techniques were not used. Some of the construction defects are:
-The wall base was not built below ground level to give it a sturdy footing.
-Drainage stone and drainage pipe were not used behind the wall to properly drain water.
-As seen in the photos, the lumber in the middle of the wall were not crossed over each-other to add strength.
-Rebar was not used in the base of the wall or throughout as I was able to rip the lumber off the wall with my bare hands (I have additional photos of screws going in less than an inch into the next piece of lumber).
-The wall was backfilled with the excavated clay soil that was causing drainage the drainage issues instead of fresh dirt/top soil.
-The invoice I got was not followed and the owner of the company admitted in an email that he didn’t use materials he charged me for because he did not properly quote the project. This resulted in rushed work and an incomplete project.

I contacted the company and they want to charge me $2,400 for materials because they’re, and I quote, “not in the business to lose money”. When I tried to explain that as the customer, I shouldn’t be held fiscally responsible for them to not lose money on a mistake they made, I just got pushback. The second invoice I was sent included $120/ton for stone when I gave the company 8 different quotes from material yards in the area for the same drainage stone that ranges between $30-$45/ton. They also tried charging me for 10 tons of stone when I have an email stating the truck they brought only has a payload capacity of 6 tons. My security camera shows they did not leave and pick up a 2nd load of stone. When I questioned the stone cost they said they’d take off 4 tons so I’d only pay for 6 tons but they couldn’t have used more than 6. The half of the wall that didn’t fall is already leaning and will fall soon.
