    Stephen S******** (Mr Fix It) was contracted to renovate a bathroom. Several times, at different stages of the project, I shared my concerns about the quality of work being done. Stephen first made excuses, then became defensive and near the end of the job he became belligerent. During a conversation regarding the final details he abruptly hung up the phone on me. I made multiple attempts to contact him, by phone, text and email. My final attempt to reach him was by emailing and texting him that his refusal to return my calls would be taken as him definitively walking off the job and leaving me to find my own way to completing the work. Stephen refused to return my calls and went effectively radio silent for weeks. That is what I had to do to get the project completed and make the bathroom usable, at my own expense and time. We then received notification of his intention to file a mechanics lien in an attempt to get the outstanding balance. Both parties agreed that half the amount due would be sufficient to close out the contract. However, Stephen demanded we sign a very extensive NDA as well as release him from the contracted guarantee of his work. This made us very uncomfortable and we told him while we were willing to pay the mutually agreed upon final payment we would not sign anything releasing him of responsibility. Stephen is now attempting legal action against us in the form of a lien against our property in the amount that was outstanding at the time he hung up on me. I believe Stephen, alone, is in breach of our contract by walking off the job, refusing to return my multiple calls, texts, and emails and therefore has no grounds or rights to pursue any legal action against me. In short, I believe Mr. S******** walked off the job and has no right to make any legal claims against me. As suggested by BBB agent I also filed a complaint with the *** *** as found in the attached pdf accompanying this submission.

    Mr. *** supervised and approved Mr. Fix It's work on a daily basis. Only when the project was due to be completed and paid for, did the customer refuse to allow Mr. Fix It to return to complete the project and present the final invoice. Mr. ***'s complaint is solely due to the mechanic's lien that was placed on his residence for non-payment.

    I am rejecting this response because:

    I did not prevent Mr. S******** from completing his work.  Mr. S******** breached our contract by walking away from his responsibilities and leaving the bathroom renovation incomplete. The work done by his subcontractors was satisfactory and done in sequence. The finishing work including tile work, grouting, hanging a new entry door, hanging shower doors and painting was Mr. S********’s work to do.  It was during this time that I shared my concerns about the quality of Mr. S********’s work specifically.  Mr. S******** hung up on me rather than allowing opportunity for discussion.  Texts, emails and phone records show that I tried many times to contact Mr. S******** after he hung up the phone.  There are no records to show that Mr. S******** made any attempt to respond to me by phone, email or text. With no response for weeks, I was left in the dark about his intentions to complete his work. I had no option except to hire an independent contractor to complete the bathroom.  The only contact I had with Mr. S******** after he walked off the job was notification of his intent to file a lien. I have filed this complaint in order to hold Mr.S******** accountable and show that he, alone, is in breach of contract.
