    The contract was 95% completed the work conditions Put upon me by the customer Became intolerable and unhealthy I offer refund him an unused portion of payment approximately $1500 Which he refused. I am still willing to refund him any unused portion of payment, If he changes his mind. In the meantime he can use the unpaid portion of the contract to pay another contractor to finish the work. That is all I'm responsible for

    I am rejecting this response because:

    Mr. Man’s token offer to get out of his contract to work on another project is unacceptable.  Considering how much work still needs to be done to rectify his poor workmanship and how many items need to be replaced because he substituted inferior products to save him money are all listed in my complaint.  Perhaps Mr. Man should read it again.  His off-handed, unsubstantiated, comment that 95% of the work is done is what I expect from him.  Photo’s don’t lie.

    Dear Mr. *******,

    First and foremost, I did not leave your project to work on another project.  I left because you made the work conditions intolerable by your condescending comments.  That being said, whatever amount of work needs to be done is less than the money that was never paid to me, which is approximately $17,000.  The small amount of monies that was in my possession, approximately $1,500, was offered back to you and you refused it.  Let me remind you that you had an architect on contract who specified materials to be used and approved work progress and quality as we went along in order for me to receive subsequent payments.  You also approved of the workmanship and progress and only then approved the funds for the next payment draw. I supplied and installed, as specified by the architect and approved by you, all the materials that were used on the project.

    So you’re neglecting to address the elephant in the room — the Jack of all Trades, and Master of Deceit.  You’re actually trying to defend…

    * A “contractor” with no license 

    * A “plumber” with no license 

    *An “electrician” with no license 

    You need to read my highly detailed complaint again — yes, the one with photos of the architectural plans vs. photos of the “contractor’s” work.  If you did read it, you would clearly see that almost everything the jack of all trades did needs to be done over correctly by a licensed contractor, a licensed plumber and a licensed electrician.  Plus, ALL of the unfinished work still left to do in the wake of the “contractor” running to the bank with our money.  It’s all okay with you, right?  Sure  it is.  How about substituting high end (as in expen$ive) products with cheap alternatives?  You’re okay with that too, right?  Sure you are.  Or how about assuming the role of the painting subcontractor, and double dipping by doing it himself?  While we are on that subject, our painter, a professional, looked at all of the doors the “contractor” painted and asked if he painted them with a broom!   That’s how pathetic the “contractor’s” work is.  Now they all have to be sanded and painted again at my expense — and they were new!  And how about breaching his own contract?  You’re okay with that too, right?  Or how about withholding all of the documentation associated with the project due us in his contract that he is holding as ransom unless we sign your Release of Liability?  You okay with that?  Sure you are.  A pillar of society, I’m sure you would hire this “contractor” to renovate your own home in a heartbeat, right?   Sure you would.  After all, he’s a stand up guy, right?  Sure he is.   I rest my case counsel.

    Dear Mr. *******,

    This will be final response to you in this contractor bashing diatribe.  There is no elephant in the room.  I signed a contact with you to execute work as laid out by the guides lines of a set of prints handed to me by you and your architect.  Before that contract was signed, I had a discussion with you regarding the permitting process and whether or not I pulled a permit or you pulled a homeowner's permit it would increase the cost of the job, but it would not change the quality and the fact that everything would be done according to ** code.  I have not and will not read your highly detailed complaint.  The fact of the matter is this conversation is serving no purpose other than you venting at me.  You were fully aware of the parts of the project I was doing myself and what I was subbing out.  You opted to hire a tile contractor and at which a gladly acquiesced.

    At this point, I reiterate, that I will return any unused portion of payment as per the last draw which comes to approximately $1500.00.  If you feel you must pursue this complaint with the BBB further, then do so but I will no longer be responding.  You have my email address and you may contact me once in regard the refund I have offered you previously.  Any further contact beyond that I will consider harassment and address accordingly.
