    ***** ********** requesting a refund of 50% of the one-time setup retainer fee, in accordance with the signed contract dated February 19th 2020. The enclosed payment confirmation shows that the total amount due (3,500.00 ***) was paid in full.
    As per the terms of the contract, the WSL was obliged to provide certain services related to the sales and marketing of the ***** ***** ****** project, which included:
    1. Website presentations
    2. Meetings
    3. Other *** and International lead generation work
    4. Introduction to the CEOs of the major ******** *** ******** ***** companies
    5. Various marketing and sales efforts in **, ****** and Asia
    6. Focused lead generation in ****** and Asia
    7. Introduction of the project to ** and ******an office partners and brokers
    8. Introduction to private equity and financial services databases
    9. Daily /weekly communications
    Despite numerous requests, emails and phone calls made over the past three years, we have not received any information regarding generated leads, meetings and/or presentations, or any supporting documentation regarding introductory and marketing efforts in connection with the marketed property. In addition, promised daily/weekly communication was nearly nonexistent, and furthermore, for the period from October 06, 2020 till January 09 2023 WSL withdrew from communications.
    As a result, it is evident that none of the contractual obligations were performed, and the absence of communication clearly shows that the *** ***** decided not to go forward with the project.
    The contract states:
    “Should for any reason the *** *****/ *** ****** not wish to continue with the sale of the project for any reasonable reason, then a 50% refund of the retainer would be made at that time.”
    It is evident that the lack of proven activities, absence of results in the form of sale offers or leads, and nonexistent communication shall serve as ample evidence that all services were discontinued unilaterally by *** *****.
