      Contract for home remodeling entered into on April 16, 2022
      We had a specific attachment to contract as to scope of work as well as target completion date and gave a deposit of $65,000.
      Stonybrook did the demolition and some minor framing but then stopped work twice. First time claiming the loss of his mother caused him distress and disappeared for over a month with no communication. Second time he disappeared after receiving two payments totaling $85,000 which was earmarked for bathroom fixtures, paint and wallpaper, kitchen cabinets and counters, doors and windows, electrical work (some was started) and carpets (half a deposit was placed but in his name, not mine).
      He has been totally out of communication since end of August 2022. I have just been forced to enter into a new contract with a new contractor.

      We signed a home improvement contract with Stonybrook Remodeling, LLC (SBR), owned by Jose C*****, on 4/10/2022 and paid the initial 30% deposit via credit card.

      Jose reached out to us on 4/13/2022 about credit card processing issue as his bank wouldn't process credit card payment as it was too high. Jose requested that we make the payments 50% on the credit card and 50% by check. We made the payment as requested. Jose cashed the check on 4/20/2022.

      Jose was supposed to provide us with architectural drawings, arrange a meeting with his designer for the layout, order tiles for us once we finalized the tile selection, which was done in a timely manner by us. There was no contact from Jose for 60 days even though I reached out to him multiple times via phone and email for a project update but he didn’t respond. I called his office multiple times and his Office Manager didn’t know what the status of the project was or if Jose was going to call me.

      Jose emailed on 6/20/2022 apologizing for the delay and saying that he will be moving forward with the project. We responded to schedule a meeting to go over the architectural drawings and Jose stopped responding again. At this point, no architectural or design layouts were provided to us and no permits were filed.

      As a result of his unresponsiveness, unethical and predatory behavior, we decided to terminate the contract due to breach of terms of contract and disputed the 50% of 30% of initial deposit we had paid through credit card.

      We informed him about the dispute and his Office Manager called to schedule a meeting. It was too late by then. Since then, we have sent him a registered letter to terminate the contract and requested full refund of the second half of the initial 30% deposit. He has acknowledged the receipt of the letter and apologized in email and communicated that he will write a check to fully refund the deposit but I haven’t receive a check as of today.
