      Good morning

      At this time, *** ****** & I have come to an agreement.  He is on my property completing the project, and we have agreed upon a price.  I would like to withdraw the complaint.

      only is disrespectful but has insulted me. He does not allow for a 2 way conversation to go over his increases & understand his updated contract & payment schedule. He backdated the most recent paperwork to his favor. The framework is not as expected yet wanted another check for $36,200. on 12/22/23, the Saturday before Christmas, with no prior notice. A check that the bank has to release to me. so, he pulled his guys out til next week so he can get another clients money to fund his expenses (according to his text sent today). He claims to have 45 more jobs lined up. How many others are out there with the same exposure I wonder? I do not want this project to continue with this contractor. If I had known about those judgements 2 years ago, I would have never consulted with him. I just want my money back

      At this time we believe that the project and plan going forward has been agreed to by each of the parties.  The explanation below is simply to ensure that a formal response is provided to the BBB.

      All funds received to date have been deployed to the product which has been delivered to the ********.  Funding has not been provided for panels which are also on site.  The lawsuits referenced are immaterial to this project and have no impact on the implementation for the ********.  Such legal activity is commonplace in manufacturing and construction.

      We understand that there have been legitimate delays faced by both parties.  Following our initial agreement to proceed with the contract in December 2021, there were in fact some supply chain issues associated with inverters and panels.  However, while this probably added in a couple of months delay to the project, a larger issue was the fact that a cease and desist order was placed on the project by a neighbor which brought the project to a halt.  Following this, additional site work was required, such as the ******** needing to change the location of the tracker placement, and remove a significant number of trees.  

      As this is a "kit" purchase, this means that the ******** assumed responsibility for all site work, such as digging and installation of the foundation, trenching, etc.  After the shift in location, the ******** proceeded with foundation and trenching preparations.  Being concerned about the knowledge and equipment required to complete this, we lent them the concrete forms for the foundation work, and while also not covered under contract we provided 5 men for a day to work with the ******** to assist.  

      Upon reaching out to the ******** to continue installation they had funding issues due to unfortunately needing to deal with a significant termite infestation which caused sizable property damage.  Understanding this, we delayed the project and deployed resources to other projects.  

      Once they were ready to move forward, we did have some other customers lined up for installations, but were set to install late 2023.  We coordinated a date and time, and on 12/22/23, we delivered the full tracker frame to the property and all equipment necessary to raise the structure.  Payments made to date cover the manufacture of the structure, permits, and engineering. Labor associated with solar tracker installation has not been funded. Again, services provided to assist in the site work were provided without charge.     

      Our understanding based on discussions with the ******** was that we were fully moving forward.  The size, cost and complexity of equipment and material delivery necessitate full coordination with every customer.  We have put parts and labor into developing the tracker itself, and this was built and on site at the ******** home. The solar panels were also delivered fully in coordination with the ********. 

      We understand initial frustration at supply chain issues, and the complexities that occurred upon the cease and desist order that required the location change.  We also understand potential financial constraints, and are always willing to structure implementation and payments in a collaborative manner.  

      As indicated above, we believe that we are now in agreement as to the manner in which to proceed, and we look forward to an ongoing relationship with the ********.
