In a signed contract, in exchange for a commission, Deering R*** of Chaos2Calm agreed to (contract language verbatim below):
    - Include property removed from my mother's estate in her annual sale in June
    - Take pictures and measurements of furniture items.
    - Research pricing of items.
    - Take additional photos for posting in sale
    - Post sale or auction on ******** (20+ groups), ***************, **************,
    ***************, ****************, *********, ****** **** ******, **** *********,
    **** **** *******, ****** **** *******, ****** **** ******, *** *****, *********,
    ******** and **********

As of 9/18/24, NONE of our property was sold. After a poorly attended event in her back yard, all of it "was donated" except for one high value antique bench (which she kept to place into an online auction.) I had to follow up many times for donation receipts and I wasn't provided with any valuation estimates, even though the contracted work included pricing of the items.

I have also had no actual proof that the bench was submitted to auction, which she claims was done in July and would be attempted again in August. I have had to follow up many times and received explanations/excuses each time.

    - For the 1st online auction, which may or may not have occured: "the bench didn't sell"
    - For the 2nd auction: "I can't put it into another auction for 30 days", "I had technical issues", "it's the holiday weekend".

To conclude this matter, I want proof that the bench has been placed into auction OR an opportunity to retrieve it (NOT to have it donated if it doesn't sell.)

I am sorry this customer feels this way, but she hired C2C only to do a home clean out of her mother's estate.  She hired a different company to sell her  mothers items on auction and after they sold some of the items she contacted my company to clean out and get rid of the rest of the belongings in the condo, which we did and we were paid for.   I was trying to help this client maybe make some more money, so at my expense we also brought a few items we thought might sell to my company location to add them to a multi client fall spring sale, I did not charge the client a penny more for the packing up of these items and the stain of her items in the sale.  Unfortunately it was a bad weather weekend and the sale was an outdoor sale - so after the sale we informed the client that none of the items sold and that some would be picked up by local donations and the remaining would go to the dump (also my expense).  As it states in our contracts, we do not make any lists of what the donation companies take, all we provide to the client are the donation sheets we are given.  This client did not like the fact that we do not tally up all the items that are picked up and give her a monetary value, none of my other clients in 12 years have complained about that.  She had contacted me a few times about when the auction would be up and I did explain to her that I would send her an email as soon as it goes live.  It had not gone live yet, so I did not send and email.   She decided to write this review on yelp and so I then informed her that I would not be adding her one items that I have been holding for her in a pod with other clients items, at my expense, I did not charge her or any clients rent fees.  That she needed to come pick up the items the next day - and so she didi and now she needs to complain about it.  The first auction company she hired was unfortunately not able to sell most of her mothers items because of the condition that they were in and I feel bad that I tried to do her a favor by trying a different way to sell them and still buyers did not want them, but to write a nasty review about my company when we were trying to do an added favor for her, I am hurt.  I should have just dumped everything from her mothers condo during the home clean out and not tried to go above and beyond.

I am rejecting this response because:

The owner is not being truthful. I have attached the original consignment agreement with a commission split agreed upon by both parties. The agreement to attempt to sell our items was no favor. Further, the contract stipulated that C2C efforts would include "Research for pricing of items." Photos of the yard sale (in which the owner claims "nothing sold") had items marked with prices. To ask for a fair market value of the donated/discarded items is not unreasonable. Another estate sale business that I worked with in Texas (where my mother had a second home) provided a fair market value of donated items as a matter of doing business, without my needing to ask for it.

This business owner does not operate in a fully transparent or honest manner. I have no confidence that my mother's items were handled appropriately. We did pay separately for a clean out. But as soon as she was paid for the clean out, she no longer had to conduct herself in a transparent, proactive, or honest manner.

    Sincerely,

C2C Home Editing assisted in the sale of my brother's estate from 8/19/23-10/5/23.
They have failed to make payments of $2035, $705, $3575, $1192.50, for items they have sold for my brother. They took over 50 items from the home to auction on 10/5/23 and have yet to provide any indication of what has sold and no payments have been made on those items.
There were public and private sales that have not been paid for yet to my brother's estate (all below figures are what are owed to my brother's estate and have the commission already taken out):
    ****** ******** ***** ***** $3575
    Supplemental Sale 8/28 $2035
    Supplemental Sale 9/6 $705
    Clearance Sale 9/23 $1192
    Private sale to Realtor $150

No Details (as to what was sold)have been given for sales held 9/8, 9/9, 9/10, 9/23.

Deering Rose the owner of the company has refused to pick up phone calls and or return emails. Occasionally (twice) she texted me to say she was sorry she hadn't responded because she was so busy. This is what she said:

10/19/23 "I need to go through the accounting and see where we are with the removal of the items for refunding buyers for outdoor items, so I will try to get that over the weekend. Thank you for your patience."

11/7/23 "My next day off is the 15th or 16th of the month and I will finish the accounting"

I sent her an email on 12/1/23 asking when accounting would be finalized and check(s) would be cut.

On 12/14/23 more excuses were given and that she needed to go through details. She says several items that were left outside were taken by the gentleman i hired to clean out the property before the house closing. I have my doubts that anything marked was taken by as he and I walked the property on 9/29 and I pointed things out to him that Deering had told me were sold or she was taking to auction. She was supposed to be there but didn't show. Her items were supposed to be gone before then too. To date she hasn't told me what several items or the value.

C2C knows that it owes **** ************ some remaining funds.  We have done all the accounting of the sales that were made and kept immaclulate records of all and out of the total sales we have paid him $5,000 with a bank check.  The remaining minimal funds are to be paid off monthly with an agreement we made with him.  Unfortunately at the time we ran this sale, we were also doing other sales and jobs and a few of those clients decided not to pay C2C for our services, so we are owed almost 8,000 and we are taking action with his and taking these clients to court.  Unfortunately things like this happen and C2C had hoped to be able to pay **** more expediently, but estate sale sales have gone down in numbers quite substantially and we have been taking many loses because of this.  It has never been our intent to owe **** this much money for so long and we are diligently working on rectifying this matter in full.  C2C hopes to have **** paid off in full for the sales that were made from his brothers' house in just a few months.

I am rejecting this response because:

I received Zero Communication from C2C for about 10 months.  She did Not respond to the Better Business Bureau's efforts when you reached out.  She also did not respond to the *********** ********** ** ******** ********** when they reached out to her several times.  She only responded when she was served when she was served with a lawsuit for funds owed and documents never provided.  Only then she provided documents many of which were simply add-ons to documents which I provided for the lawsuit.   And she had claimed that they were "sent to me months ago".  She did pay $5000 at that time but there still is a balance left and we could not come to an agreement what that number is so I am continuing with the lawsuit.  She also "donated" and "disposed" of my brother's possessions with out contacting me for permission.   And takes no accountability for her actions for those items.  She has the dollar figure I will settle for.

    Sincerely,
