Signed contract with Daryl Caron 9-28-24 gave check for $28K for cabinets. Job was for complete kitchen remodel wood floors painting and ceiling. He said cabinets came in Dec 5th. He started Dec 19 th and said would take 2 weeks to complete. Per contract paid $16k on Dec 27th upon removal of old flooring and cabinets. He did not dispose of them as in contract I paid condo maintenance. He was out days & weeks at a time for various illnesses. Never told me I had to track him down. He only worked 4 days a week starting at 10:00 a.m. gone by 3 pm. He was supposed to begin painting the walls the last week of February. He said he wanted assigned contract despite the fact that I told him in person what colors I wanted + with a text message what colors I wanted. The contract you wanted me to sign had several other things in it and I told him I needed a contract with just the colors. He wouldn't give me that he took his things and he left and hasn't been back since. I sent him a text message giving him a day and time to meet. He did not show up. He has not responded to any text or phone calls. I have asked him several times for a receipt for the cabinets and he has not given me that. I cannot live there with no kitchen. The floors ripped up and furniture filling the bedrooms. I am rehabilitating a broken ankle and can only be on a single level and I'm staying at my dad's. I cannot get to the kitchen so he has to bring me all my meals. This has been going on since December. My dad is 81 years old and he should not have to continue to take care of me when I can take care of myself in my own one floor home if it was possible. He also states in his website that he is A+ + BBB accredited and he is not.Business Response

Mr. Caron contracted with the complainant beginning October 1, 2024 and began work shortly thereafter. From the outset, the complainant asked Mr. Caron to perform work that was outside of the scope of their original contract. The complainant from the outset was combative with Mr. Caron when he requested that she sign change orders for the additional work that she requested. On numerous occasions, Mr. Caron requested that the complainant sign addendums to their original contract, reflecting the additional work. His aim was to ensure that he was in compliance with state law. On every occasion, the complainant refused. While refusing to pay for the additional work requested, the complainant sought to renegotiate the existing contract, seeking lower prices. In one instance, she covered Mr. Caron's work area in feces. Mr. Caron has foregone other work in order to perform under the complainant's contract and sustained six figure losses. On another occasion, the complainant sent Mr. Caron a signed contract for lower prices than they agreed. Mr. Caron refused to sign that contract. The complainant's position is incoherent, however it seems that she believes that she should get all off the materials at cost or below and be allowed to unilaterally lower the agreed upon labor costs. The complainant has been responsible for any delays as she has changed her mind about the original paint colors and has refused to provide Mr. Caron with new colors for the job. Moreover, the plaintiff represents that she "can't live without a kitchen", however this is a misrepresentation as she does not live at the premises. Admittedly, Mr. Caron was diagnosed with health ailments, however the complainant embellishes these ailments. They did not impact the overall timeline of the project. On March 5th, the complainant had her father confront and threaten Mr. Caron. He was swinging his fists and swearing. As the work environment was no longer safe, Mr. Caron refused to return and notified the plaintiff of the same. Shortly thereafter, Mr. Caron received the instant complaint. This complaint is the result of someone wanting to get work for free and throwing a tantrum when they did not get their way.Customer Answer

I am rejecting this response because:The contractor, Daryl Caron's, rebuttal is completely untrue and borderline defamatory. While I can provide a detailed timeline of our discussions and his response/actions, he has no evidence to support his ridiculous accusations. He negotiated in bad faith and didn't fulfill his obligations under the contract.

We have already sent a complaint into consumer protection about this and are waiting to see what can be done if anything. We had a contract for Caron Building and remodeling to replace our front entry way door, replace french doors with double sliding glass doors and sidelights, and a full bathroom remodel. the front door had some issues, it was supposed to come in alpine white, it came primered with different colored moldings, same with the slider/moldings. he left yellow stains from expanding foam on these items as well. In addition, The bathroom is where the real problems are.
The bathroom was fully gutted, by doing so he damaged the first floor ceiling by cutting the shower drain, and it cracked the sheetrock for the ceiling. He also did the same to our closet that is adjacent to the bathroom. (He half patched the closet) in addition, our shower leaks because he didnt install it correctly. He also ordered the incorrect bracket for the glass doors so now the coating is rubbing off on them, and he never installed a water stop for the bottom (he put in a handicap shower base - flat bottom) The shower leaks when we are using it from underneath this glass doors, we have plenty of pictures if I can submit them. he denies that it leaks, and also said "If you don't dance in your shower then it wont leak" (very unprofessional) The vanity was put in and then he grouted the floor, so quite a bit of the flooring is not grouted (underneath the vanity)
The contract states we were to get a GRANITE top. Instead he had QUARTZ put in. I called proline services to confirm that it is in fact Quartz that was installed. The toilet is the wrong rough in and there is a nice big gap from the tank of the toilet to the wall, he missed tile underneath the toilet, the toilet is also not centered, he missed paint and didn't finish a few corners correctly. And our last payment we asked for 2 days to test the shower, to which he replied "Im putting a mechanics lien on your property"Business Response

This is a complete fabrication wherein the complainants were looking to get services for free. On numerous occasions, they kept trying to renegotiate price. I performed all of the work as outlined in the contract. When I completed the shower door, it was in fine working order. When I came back to the house, I noticed that the door had been hyper extended and broken. I was told that it was slammed when I was not there. When the time arose for final payment, I was told that they wanted to wait "two days" to determine whether the bathroom was leaking. When I left, the bathroom was not leaking in anyway. Moreover, if the bathroom were leaking, I would have gladly fixed it. All materials that were used were approved by the customer. Although the contract called for granite counters, the customer subsequently selected quartz on their own. Please see attached change orders. They were made aware of the price and chose to move forward. There is a change order attached confirming the same. As per the claims that I was in anyway unprofessional with the customers, that too is false. I was scared and intimidated the entire time because the customers had **** lying about the home that were unlocked despite the fact that they have young children. I also worked with the complainants around their hours to accommodate their children's nap schedules despite the fact that this meant that there were numerous days wasted that I could not work on other engagements.
Moreover, this project was completed in stages. There was never complaints of any problems with the doors or lights. It is completely dubious that the complainants were so displeased with my prior work that they entrusted me with a complete bathroom remodel. If they were so displeased with the previous work they could have stopped the project at any of the previous stages prior to the work on the bathroom. They did not. They also had other contractors working in the home and, in typical fashion, have tried to blame me for their work. Please see the attached invoice from Preferred Painting Services. This is of note because the complainants originally represented to me that this was 3400 dollars' worth of work. We see from the invoice that it was actually 320 dollars. Even assuming that the complainants were not again being dishonest, 320 dollars would not entitle them to full refund. The complainants here waited until the work was complete to claim that they were not pleased. To date, there has been nothing to indicate that they were gutting my work and starting over from the beginning. As has become customary with the complainants, they are again attempting to avoid the adult responsibility of paying their bills.
The complainants here have failed to provide any photographic evidence to support their baseless claims. Truthfully, this is because none exists. They are merely attempting to weaponize the system to unjustly enrich themselves with my work. I am sending this matter to collections so that I might be made whole.

I am rejecting this response because: In no part of any Contract, change order or written/signed agreement was the quartz agreed upon. In the ORIGINAL contract we signed with GRANITE being the top of choice by THE HOME OWNERS. If anything it was a bait and switch to lower cost for the business. We never said "the shower door was slammed and hyper extended". Id like to see proof of us saying this. Im sure the business cannot provide proof of this either? I spoke with the MANUFACTURER of the shower door, and sent them pictures of the installed items. They told me that parts were missing on the bottom (the water stopper, and correct bracket) The business seems to be calling the manufacturer liars. They are the ones who made the shower door, He needs to abide by installation instructions. If someone would like to inspect his work and leaking shower, you are more than happy to setup a time to come look at it. As far as him being scared about ********, this is outrageous as he would talk all the time about his ******** and "crossbows". All of my ******** are registered and locked up. As far as my children's nap schedules this has been a strict routine that has been so since they have been born. It was explained to him before we signed the contract. Someone can look at this as hearsay, but Im pretty sure the business owner has no say in how we manage our children.He never dated his original contract "start date and finish" which is by the way a law in connecticut for a contract to hold. As far as the two day we requested after the business put in the bracket on the bottom of the shower door. Connecticut law also says the final payment is due upon COMPLETION and SATISFACTION of the home owners. It also says on the business's contract in DARYL CARON'S handwriting final payment upon completion. This was clearly not the case as we are here now. We discussed things throughout the project with him, to which he would either not say much, not respond, or say "im not done yet" The only thing I can say is someone is lying here, and it seems as though I sent BBB and Consumer protection EVERY SINGLE DOCUMENT, picture of incorrectly installed, missing, damaged, wrong items. And the business sends back the original contract, and a few change orders which I sent over originally.
Furthermore as far as we were trying to get services for free?? that is crazy as we've already paid the business around $40,000. I dont think the remaining $3,000 would be tough to pay. The job was NOT complete, based on the pictures provided and my LEAKING shower, I think everyone can agree on that. I truly believe there were more things damaged here than fixed.
also, I will send over all photographic evidence that he claims I dont have. Consumer protection has FILES and FILES of "photographic evidence".
As far as the business was "told that the door was slammed and hyper extended" it seems your story doesnt match up with the text you sent to my wife saying you arent sure how the door was damaged. Sounds like someone is reaching here. It will only let me attach 4 files. I have about 60 files to go.
