My contractor requested a deposit of 1500 dollars in September. Then October 25th, 2024 he requested the first major payment, which was half of the contract money. He did not do any major work for 3 months until January. He started work on January 13th and 2 days later he requested the second payment, In our contract it says the second payment was due when he was halfway done. He was nowhere near halfway done. I told him I did not want to give him the money, I voiced my reluctance. He told me that he purchased all of the materials so he had no more money and if I did not pay him he would stop working. His mason told me that he bounced checks and then he fronted money for my contractor. He only ever had 1-2 people working which led to mistakes. He cut our radiator pipe and we were without heat, he left my electric pole unattached to anything and it fell off, he nailed through our existing bathroom and has not fixed it, my yard has sinkholes they threw the excavated dirt there, there are big blocks of concrete and nails all over it, and he is blaming us for all of it. Now he wants us to sign a new contract saying that he does not have to do our bathroom that is in the contract, and he is only deducting 5500 off of the final payment. He also wants us to pay him 20,000 of the remaining payment now. I do not want to eliminate the bathroom and I do not want to give him more money. His subcontractors tell me he has not paid them, he bounced the check to his mason guy. No one is working for him right now, my front step that he added is crumbling, my home is still open to the elements, my yard is like a war zone, and he will not respond to our emails. He wont bring materials and he says he wont come to work unless i sign a new contract with his demands. He has screamed at me, and told people I am crazy and that I did not pay. He has never given us a schedule or a budget or a breakdown of our money.Business Response

Good Morning ** ***, I want to inform you that the reference of addition on ** ******* ***, i decided to stop working on April 24 for the following circumstances:
No Agreement between homeowners and contractor( Contractor has been treated with Humiliation and Discrimination !)
- We started the demolition of old vinyl siding
- We install a new Vinyl siding color black chosen by homeowners
- The Concrete subcontractor started the excavation work on January 15 2025
- After excavation has been approved masoner installed footings on first week of february
- Footing inspection has been approved by ** ********* ****
- After the first week of February we started to build framing work.
- On March 4 more or less we made demolition on old roof and we found Rothen plywood and rafters that necessary had to be changed ( Not in the contract)
( I explain and showed to homeowners but they didn't care about it ) but i did consult with her Architect ****** that i have to change the whole entire existing half roof because of bad condition and he was agree to replace it. but that cost me more money on materials and labor work of course. ( Home owner ****** ****** didn't want to recognize that was extra work but it was my obligation to let her know)
(I DIDN'T ASK FOR MORE MONEY. ..trying to help her)
- We replaced the whole rafters and all paywood roof (whit extra cost) and and installed Lvls as drawing shows.
- On April 8 My roofers installed architectural shingles roofs
- My Carpenters installed Windows ,Main entrance door and installed New Azek Trims all around.
-Around April 15 Roofing work and Electrical work has been Approved by Inspector *****
-The next steps were Insulation work, sheetrocking and Painting work ( 20% percent of the job to be Done ! )
(the little issue for niche tile i went to fix it by myself)
Mrs ****** ******s From ****** **** has been very rude with me yelling at me treating me like her employee and not like a contractor. I noticed that she is Racist because she treated me with discrimination and hatred !
Also since the beginning she has acted with no Work ETHIC because she has been asking my subcontractors and labores their phone numbers and asking them everything about me WHY ....? Perhaps her intention was to sue me, take me to court and build her house taking advantage of me...?
All of this disagreement and issues with this kind of homeowner I spoke and told to their Architects that they wanted to interfere and mediate this situation to arrive at a good ending but that Lady didn't want to. ( Why..? ) Maybe they Don't Have money to pay at the end !
Price agreement on contract was $120K ( Professional estimator made this alteration or addition of $175k minimum ) but i Accepted to build it for $120k because it was a WINTER TIME and I wanted to keep my workers working through this time of the year.
After the Professional Plumber ( **** *******g) went to inspect the basement ceiling to make and run pipes for the bathroom he found a very difficult area to run pipes and he thought that it is illegal to do it like a homeowner wants! ( HOMEOWNERS SAID THAT THEY BUILD A BATHROOM IN ******* SOMETHING SIMILAR) Build By " NO CODES"..! )
- Anyway they made two payments so far of $90K and the remaining before Plumbing inspection was $30K after bathroom remodeling has been eliminated l reduced $5.500 on my labor price because materials were part of them .
arriving at $24.500 the final payment.
Besides the 90K that they gave me, I spent $18K of my own funds to keep working on this project , but I had no more budget to keep on truck.
This is very very Frustrating for me trying and making an effort to help homeowners to build their own house but in return I receive humiliation.
- After April 24 they put up a sign saying NO TRESPASSING PRIVATE PROPERTY and her husband emailed me saying DON'T COME BACK ANY MORE...WE WANT OUR MONEY BACK !
.( IMPORTANT : Mrs ****** ****** offered money to my carpenter to work on it and she was trying to convince him with texts .!! My carpenter and workers got very scared about it knowing that the Immigration situation is very serious in all of the Country. like everybody knows.
.
.
That's the main reason that I wont keep working on this project anymore.
Thank you for your understanding, ** ***, Mr Mike and Mr *****, Regards,
Sergio S*******

Complaint: ********
I am rejecting this response because:Re: Formal Complaint – Breach of Contract by Cares
Contracting LLC
Better business Bureau
I am writing to file a formal complaint against Cares
Contracting LLC and its principal, Jorge Sergio S***************, for breach of
contract and abandonment of a residential construction project located at my
home: ** ******* ***, ******** ** *****.
On September 7, 2024, I entered into a contract with Cares
Contracting LLC for $120,000 to perform extensive renovations, including a new
bathroom, flooring, electrical and plumbing work, insulation, drywall,
painting, exterior siding, soffits, and more. I paid $90,000 in total—three
quarters of the full contract amount—significantly earlier than was stipulated
in our agreement, in good faith and to ensure progress.
Despite these payments, Mr. S*************** failed to
complete or even begin a substantial portion of the work. In early April 2025,
he abandoned the job site and refused to return unless I signed a new
contract and provided additional funds. I declined this demand, as it violates
our original agreement.
The incomplete and abandoned work includes:
- No work started on the new bathroom
- Unfinished exterior siding and Azek trim; trim left with
unfilled nail holes
- No soffits installed.
- Electrical work incomplete; outlets and lighting fixtures
missing
- No plumbing started
- Wood floors are incomplete
- Insulation, drywall, priming, and painting not done
- Interior trim and closet doors not installed
- Crawl space entry not constructed as per plans
- Damage to existing bathroom tiles and basement wall
- Holes and cracks left in the ceiling
- Crumbling front steps and foundation holes from subpar
masonry work
- Trash, nails, metal, wood, and hazardous materials left
scattered across my yard, destroying my lawn
I am requesting a full refund of the 90,000 payment I paid for this
incomplete and poorly executed work. I am not seeking mediation—only
restitution.Timeline of Events – ******* ****** vs. Cares Contracting
LLC
- September 7, 2024: Signed a contract with Cares
Contracting LLC (Jorge S***************) for a renovation project totaling
$120,000.
- September–December 2024: Paid a total of $90,000 to
contractor, representing 75% of the contract value. These payments were made
ahead of the agreed schedule.
- October 2024–March 2025: Contractor performed partial
work, with many critical aspects left unfinished or completely unstarted.
- From January until present we requested a formal schedule
and breakdown, and he refused to provide us with one every single time. We also had subcontractors knocking on our
doors informing us that he was bouncing checks and flat-out refusing payment
and telling the subs that we were not making payments.
- April 2025: Contractor demanded a new contract and the
final payment. When I refused, he walked off the job entirely.
- April 2025–Present: Site remains unfinished. Numerous
damages were discovered, including structural harm, unsafe debris left on the
property, and additional expenses now required for repairs and cleanup. Also, he continues to call me racist and I am a ***** ***** ** *** ****. This man should never have a licence and the BBB should take my complaint serious and not even allow him to make such slanderous remarks
Sincerely,
******* ******
