    My wife and I hired Monkeys in Trees LLC (**** ***) regarding excavation work to be performed on our property, upon which we were planning to build a new residence. There were two contracts: the first was for the clearing of the lot, the second was for placement of construction entrance stones. We paid an initial $1,300.00 of the $1,800.00 for lot excavation. He never completed the work and the balance was thus not paid. For practicality sake, we are willing to forget the non completion of the excavation work as financially, this could be viewed as being "even". Our financial complaint deals with the placement of construction entrance stones. We signed a contract at the cost of $1,200.00 for stone placement. The entire $1,200.00 was paid "up front" as required by the contract. Mr. *** understood that the placement of the stones, as well as the lot clearing, was to be completed before construction would begin. Our check was cashed. The stones were never placed. We attempted to contact Mr. *** by phone on numerous occasions. The phone was never answered. Messages were always left and were never returned. We raised the issue with our builder (Bay to Beach) as they had recommended Monkeys in Trees. Bay to Beach builders told us that they had also left multiple messages with Mr. *** without any return contact. We always believed that, if we could speak with Mr. ***, we could uncover the reasons for his violation of the contracts and come to a resolution. We did go to the address listed as his business. However, this is a home address and he was not available. We sent a return receipt letter to his business address. This was signed for. We received no response. At this time, we request the return of the $1,200.00 we placed for stone placement. We have copies of the contracts and the cashed checks. We view this as nothing more than blatant thievery. If you could assist us in resolution of this problem, we would be thankful. Sincerely,

    I had made repeated attempts to communicate and try to resolve this issue the customer and bay to beach builders had changed the lay out of the construction entrance monkeys in trees is not responsible for covering the cost for the job becoming larger monkeys in trees tried several times to find out the proper lay out I do not believe the customer is intitled to the total amount

    Better Business Bureau: I have reviewed the response made by the business in reference to my complaint and have determined that this does not resolve my  issue.  For your reference, details of the offer I reviewed appear below. **In order for the bureau to continue to assist you, you MUST provide your view on the matter or your complaint will be closed as answered. Mr. *** had a contractual agreement with us to place stones at our building site. As required by Mr. ***, the entire amount was paid in full up front. A check for $1,200.00 was sent to Mr. ***. The check was cashed by Mr. ***. Mr. *** never provided any of the stones. I do not have any idea why he is treating us in this fashion. He took our money, did not do the work, and to this day he will not return any communications with us. We did nothing to deserve this. This is beyond unprofessional. This is fraud and thievery. We are requesting that Mr. ***, please act in a professional fashion and return our $1,200.00 which we paid in good faith and for which we have received absolutely nothing. Thank you,   Regards, Complaint ID: 20919802

    The repeated back and forth thith the customer and builder bay to the beach changing the size and pay out of the construction entrance with the afect of price change for more material I will settle at half 600 to try to resolve this issue. It states on the contract material cos non refundable. And especially after changing the size and scope of the job more then once
