    *Company will not return overpayment from services completed.
    I paid for and coordinated concrete work for my daughter who is an active duty member of the Air Force in DE (I live in PA). The laborer collected final payment from my daughter the date that the work was completed. However, he told her an amount that was incorrect. She was not aware that she was told an incorrect amount and wrote the check for the amount requested which resulted in an overpayment of 565.00. It has been over 30 days since the Owner has acknowledged the overpayment and I have not received checks he’s claim to have mailed.
    *Total amount of project: 6,440.00
    *Payment one = 500.00 (7-18–24)
    *Payment two = 2,720.00 (8-29-24)
    *Payment three = 3,785.00 9/5/24 (9-5-24)
    *Payments resulted in overpayment of 565.00 with total paid of 7,005.00
    9/5/24 Brought overpayment to ****’s attention
    9/11/24 **** asked me where to mail the overpayment
    9/11/24 I replied same day with my address
    9/25/24 I let **** know that I had not received payment
    9/26/24 **** said he will check with bank and reissue check
    10/4/24 I let **** know I still have not received check
    10/4/24 **** said check did not clear and will reissue
    10/13/24 I let **** know I still have not received check

    Attached copies of checks that he received. My daughter (******** *****) wrote the two larger checks from a joint account that we share. Statement attached showing both of our names at the top of page 2. Her name only shows on the actual checks.

    I sent sam the concrete man a $500 deposit for them to put in 114ft of concrete walkway. They were supposed to do the job on July 29th of this year. They didn't show up or call . After multiple attempts to contact them they finally got back to me saying that they didn't have the man power to do the job anymore. I asked him for a refund of my $500 and **** ******** said he thought that was the best solution. Frist he sent the check to my beach residence which I don't get mail there. Then he resent it to my residence in New Castle but only sent $50. I called him and stated that he only sent $50. He said that he would send the remaining $450 on the 24th of August. I have still not received any of the $450 that he owes me.

    Estimate for concrete work 5/16/2024
    Deposit of $500 via check on 5/16/2024
    Scheduled to come out on 6/10/2024- Did not call and did not show
    We called the office, they called back and rescheduled for 6/11/2024
    On 6/11/2024 Did not call and did not show for the second time
    Rescheduled for 6/24/2024 and continued to do the same for 6/24 and 6/25
    4 no call, no shows later we asked for the $500 deposit.
    I spoke with **** ******** and sent an email on 6/25 canceling the contract and requesting the $500 refund. Followed up on the email on 6/28 and again on 7/2 with no response.
    All we want is what we gave him, the $500 deposit.

      Thank you for reaching out.  We did receive the refund check, however it is dated for the 31st.  What happens if we cash the check and the funds are not there?  Do we open up another complaint?

    I met with ******* ******** (*** The Concrete Man)on 4/7/2023 at my home to request an estimate for a 12'x18" concrete patio and a concrete slab for a small shed. He gave me the estimate and asked for a deposit of $500.00 but I gave him a check for $1000.00. I explained to him at that time that I had to get HOA approval so until that happened work could not start. The HOA approved the patio but not the shed slab due to an easement. I then said that I would buy pavers which would be allowed because they weren't cosidered to be permanent. My check was deposited right away and was withdrawn from my bank on 4/11/2023. Due to the change of the concrete slab I asked several times for a revised quote and never recived one. I never sined a contract. **** was also very hard to reach but always called me back eventually. I explained to him that I needed it done ASAP due to the fact that I was having the shed delivered and a fence put upp in the backyard. He agreed and asked me for a date and time that worked for me. I chose Friday 5/12 @ 10am. no one showed or called by 12:30pm so I called ****. He seemed surprised that the guys weren"t here yet but said he would find out where they were and call me back. I never heard from **** but the worker called over an hour later and said they were behind and could possibly be here by 2pm but he wasn't familiar with my area. that I didn't understand because I am in the ***e town as the business and **** had told me that they do alot of business in my development. I was getting a wierd feeling, so I went online and looked at the reviews and they weren't positive at all as well as the BBB giving him only a C+ rating.I then called **** asking for my $1000.00 to be returned as I was cancelling the job. He said that a 10% portion was no nrefundable and to read the contract. It is in the paperwork but I never signed a contract. I told him that I expected it to be returned in 10 days or I would take further.I never heard from him.

    In response to Mr. ***** comments

     

    We did meet on or about 4/7/2023 to discuss him wanting us to install a concrete patio and a small concrete shed pad, note he called us we did not solicit him.  He called as from a referral from his neighbor.  I gave him a proposal he agreed and gave me a check for $1000 even thou I only asked for a $500 deposit.  I told him if I can install both his job and his neighbors job at the same time I would deduct $150 from each because it would be a savings to us and I was passing along the savings to them, he agreed.  A few weeks went by and his neighbor decided to add on to his project, this meant getting another approval from the HOA.  ?This made Mr. ***** very upset because he felt his job was going to be delayed because of the neighbor.  Mr. ***** called me very upset because as he put it "My neighbor is delaying my job and He needed to get it done quickly.  He called me on May 9th, 2023 upset, so to make him happy I moved some scheduling around to accommodate Mr. ***** so I pulled his job forwarded to Friday May 12th, 2003.  He texted me on Thursday, May 11th and wanted to know what time to expect the crew to arrive. I guessed at 10:00 Am because I knew the crew was doing some clean ups because of the bad weather we had.  Mr. ***** called me on Friday around 10:00-10:30 asking me where the crew was.  I did not know I told him someone would get back to him shortly.  I called my foreman and he told me the clean-up was taking longer then expected and the foreman expected to be at Mr. ***** house around 1:00 pm.  The foreman *** call Mr. ***** to inform him he was late and would be there by 1:00 pm and there was plenty of time in the day to get done what was needed to get done (excavate and install forms takes about two hours on a job that small).  According to my foreman *** Mr. ***** started yelling at him, saying we are all crooked and untrustworthy and slammed the phone on him.  I called Mr. ***** no response but then he texts me saying he didn't sign the contract he is not responsible (When he gave me the deposit check he automatically agrees to the contract which can be written or verbally)   He goes on to say he checked our rating with the Better Business Bura  (BBB) and they my reviews were horrible ( We don't have any reviews with the BBB, We are not even members) so that was false.  He just cancelled while the crew was in route to start his job.  So in summary, We pulled his job in to accommodate him,  We offered a discount which he turned down, he wanted a change order with the contract but I could not do a change order unless he completed the contract. (so everything was verbal) Our biggest crime here is my crew was going to be late, not by days, weeks, months but a few hours that is very odd to say the least.

    I have read the response from the business and I don't agree with what all he is saying in his response. He is correct in saying that we met on 4/7 and I gave him a check for $1000.00 by choice, as he only asked for $500.00. I was never contacted again and I had to keep  trying to contact him . I learned from my neighbor(at the common mailboxes) one day that he was adding more to his original job. I never got a call from the contractor saying that, I finally contacted him saying that I wanted to schedule my job, as I was having other things done and wanted the patio done first. I also told him that the HOA did not approve the concrete slab due to an easement issue for that and requested a revised figure. I asked several times with no response from the business. The contract that I have has a signature and date line, which I never signed. He finally gave me a date to start the work and asked me.. did I want an appointment at 10am or 12 noon, I picked 10am. Having no one show up by 12:30pm I called him and he seemed surprised that no one was here. He had the worker(***) call me and I asked when he could be here and he said maybe 2pm which at that time, I said that was unacceptable. No one ever called me to say the schedule was behind due to rain. In fact, I don"t remember it raining that week.At that time, I also mentioned where I was located and the guy said to me that he wasn"t very familiar with this area. I didn't understand that, because the business is in the same town as me and **** in fact told me that they have done many jobs in my community. I have the many  e-mails to him , the last one being 5/13. I never heard from him again. He never mentioned that the contract was verbal and I gave him the $1000.00 in good faith. As for the negative reviews, there are plenty of them on line if you google customer reviews for Sam The Concrete Man. The BBBpage said that he didn't respond to a previous complaint and although the business are not BBB accredited, the BBB gave him a C+.After reading the reviews and him being uncooperative as far as doing the job on time, I got a bad feeling, so yes I did cancel the job over the phone with the worker. It still doesn't explain his lack of communication as to my refund of $1000.00. As I mentioned before, I gave him $1000 by choice, only  so even if he keeps 10% he was only requiring $500 which would equal $50,00 not $100.00. He has made no effort to date to return any monies at all.
