      On 4/3/23 at 11:06 am I called Sposato and asked to cancel my irrigation system opening and future scheduled business with them. I had found someone else that I was going to give my business too. The person on the phone they would cancel. On Friday May 19, 2023 I received a text from Sposato at 12:36 confirming my appt for upcoming opening of my sprinklers the following week. I replied to the text saying that I had canceled in April to be ensure canceled that the sprinklers were always working and active by another company. The following week, Sposato decided to come out and see that my sprinklers were on and left. (have on video) Did not perform any service. While they were at the house I called the Sposato office and said I canceled this and referenced day/times, text, etc. They said they were going to have to charge me. I said you did no work and I had canceled. They proceeded to bill me 100.00. Once receiving the bill I called and they moved it to 50. I said you did not perform any work and I had canceled. Now they are sending me another bill for 100.00 after calling, emailing, texting. This company is ripping people off. I want my 100.00 removed as this company performed no service for me of which I have on video.

      ******** ******* - Our contract, attached, that Mr. ***** signed and initialed clearly states in bold and all caps that termination of the contract is required to be in writing prior to any routine services.  The representative that Mr. ***** spoke with after he received the initial invoice in May for $100 unfortunately no longer works for the company so we are not able to get a statement from her.  We have no record of any calls made prior to him receiving the invoice and no one on our staff would have told him that nothing more than a phone call was necessary and that his contract would be cancelled because our contracts are all drafted with the same terms and everyone that works for our company is aware of that. Due to the fact that our technician saw that the the irrigation system was already on the day he came out to turn Mr. *****'s system on, he did leave as Mr. ***** stated without performing any official work.  The invoice Mr. ***** initially received for $100 was an error, it should have only been for a trip charge of $50 and when I spoke with him via email on 8/10/23 I told him that we were only charging the trip fee as he did not cancel in writing prior to his appointment per the contract.  In good faith we will waive the $50 trip charge, but for all intents and purposes, it is instances like this, where phone calls can not be tracked, that we require cancellation in writing.

      obviously *** ****** of Sposato had a problem with his vision  clearly you can see trees are partly bald! They have been like this since shortly after they were planted last Fall  they will never come back fully  they are sick  *** is just giving us a very hard time and won’t replace them despite our one year warranty    Heathy trees don’t look part bald like these! We demand 6 additional replacement trees ASAP   It’s only fair! 


       

      *** ****** and his secretary **** ******** who signed for the certified letter on 6/14/2023. No reply to my certified letter nor to my emails. They ignore me. I am seeking replacement of 4 more tall trees plus 3 short ones immediately. This is long overdue and *** ****** can easily order them but he refuses to. We asked Mr ******* to meet us at our home. He won’t. No reply. We are due these replacement trees now. *** ****** only looked at one side of trees. Many trees are bald on the other side! He was so quick and rushed to leave our home. He said he was busy! Need resolution and replacement trees NOW . If they don’t replace my trees immediately I want a refund for 4 tall trees and 4 short ones. I am 82 years old. Shame on this company! Person who signed certified works for *******. Probably secretary. Named **** ********. Certified document attached with signature.

      I met with ****** ********* and agreed to replace 4 trees. When it came time to replace them they requested another 6 trees to be replaced. I went and reviewed the plant material and let the client know that I did not feel that any more needed to be replaced. Attached are various pictures of the plants. If they were dead or dying as per our warranty I would replace them.

      The plants are alive. Most of the pictures that were sent from the client were of the plants we replaced. Please see my pictures of the current status of the plants that I sent in my previous response. I am not going to replace plants that are of quality and meet the standards of the landscape industry. We are not replacing anymore plants as we have honored our warranty.
