I am filing this report on behalf of my mother ******* ******** who is an 85 year old female. MR Exterior LLC was contacted in July of 2022 to provide roofing services.Mr ******* ******* wrote up a proposal for the work and this was signed by ******* ********. On July 8, 2022 a cashiers check in the amount of 4500.00 was given to Mr ******* and in the memo it was stated replace roof. The total cost of the job was 9000.00 with the 4500.00 going down as a deposit in which Mr ******* was supposed to buy the materials. That is the last time he was heard from. He picked up the check and disappeared. My sister ******* ******** assisted my mother in this transaction and her name appears on the contract as well. Many phone calls have been made to Mr ******* regarding this matter and calls are never returned. We are looking for the return of the 4500.00. If this is returned there will be no court action, however if Mr ******* continues to avoid dealing with this matter, Court papers will be filed which will include additional monetary amounts as Mrs. ******** is an elderly woman on a fixed income. We would just like to recover what has been lost as to date there has been no communication and the roof still has not been done. There is no sign of any materials either.

I would ask that you please reopen this case as I was viewing Mr. *******'s response

using my phone and thought that I was swiping to advance the page andinadvertently selected the "not satisfied" response without adding my side of the story. The facts of the case remain that he was paid for a job that he never started. I have offered him sevral repayment options but he still has not complied. There is nothing in his contract that states he can keep a customer's money if he doesn't do any work.I have also filed a complaint with the Dept of Consumer Affairs and mine and his BBBresponse figures prominently in their investigation.

    Business Response

    Date: 08/18/2022

Mr ****** signed two contracts for two separate properties July 26th & 27th. The second contract he signed (Clayton address) on July 27th, he explained was priority and chose to have me schedule that first. I moved the schedule around to accommodate his wishes and completed all contract work to satisfaction on July 28th. He then informed me he wished to have the Dover address done immediately as well. I attempted to meet his demands by scheduling it for the weekend (July 30th&31st) Friday July 29th my family was involved in a car accident which totaled my van and required my family to enter the hospital as precaution. I contacted Mr ****** to notify him. His expectations were still to have the work in Dover start that day, otherwise he wanted to terminate his contract. Mr ****** and I reviewed his contract before signing on the 26&27th. At no point did he mention any deadlines when asked if the contract was satisfactory. The deadline was imposed on me on the 28th. I tried to appease his demands but was unable. On the 29th he demanded his contract be terminated and a refund be issued, just two days after signing his contract. Shortly after I fell ill and required medical attention. I have one message from Mr ****** demanding a full deposit return, he has not tried contacting me like he claims. He has since gone onto social media and exaggerated the truth and slandered my name. Time and resources were spent to handle Mr ******’s project. At this time, I’m seeking legal advice, and if it’s determined that I’m able to complete the contract, I shall do so in a timely fashion. Otherwise, a refund will be issued minus my expenses.

Mr ******’s review, I’m unable to see. However he signed two contracts for two separate properties on Tuesday August 16th. We finished the contract he said was priority by August 18th. He was under the impression that we’d move directly onto his second project by August 19th although a schedule date nor a timeframe was ever discussed. That specific project needed a permit pulled for removing a chimney. On August 20th Mr ****** became hostile demanding a refund after several site visits were made and materials were purchased.
