      On 4/20/2023 our company driver, signed a Trinity Logistics rate confirmation agreement for the rate of $1,800.00 the rate confirmation was confirmed and sent by Trinity Logistics Broker - ******** ********. The rate confirmation stated for the load to be tracked which the driver made sure the load was tracked, the rate confirmation also stated that the load was a dedicated load only, which the driver complied and followed the instructions that was requested. On 4/25/2023 Trinity Logistics Broker - ****** ***** made a false claim stating that our driver partialed the load, which was a lie coming from Mr. ****** *****, our driver DID NOT partialed the load. Once the load was delivered in Phoenix, AZ my driver sent all documents including bill of lading to the factoring company Tafs and to Trinity Logistics. Trinity Logistics breached our contract and rate confirmation agreement. Trinity Logistics, Inc only paid our company $360.00 and they kept our payment of $1,440.00 for a load our driver delivered for Trinity Logistics, picking up in Arcola, TX going to Phoenix, AZ. ****** ***** lied and stated that our driver partialed the load, so that Trinity Logistics, Inc could keep 80% of our payment. If an ACH payment for $1,440.00 is not made to our factoring company, the carrier have the right to seek legal action, when a contract and agreement is breached by the Broker. Our company have already retained a business attorney. For non payment from Trinity Logistics, we will have our attorney and legal team to contact the shipper Maxim Crane 303 Peach Ln, Arcola, TX 77583 to collect payment in the amount of $1,440 for the delivery that was made on 4/24/2023 to ***** ***** **** **** *** ***** ******** AZ. If the carrier can not collect payment then a lawsuit will be filed against the Broker - Trinity Logistics, Inc and the Shipper - Maxim Crane for non payment of delivery which will include payment for our Court costs.

      As you mentioned the load was picked up on 4/20/23 and while your truck was in transit and late for delivery our team started to pay strict attention to the tracking that was turned on. The driver not only had a partial on the trailer, but we have the macro point info (attached below) showing the location of the stop. Our team then called that location/receiver and validated (based off that address) that your trucking company truck, infact made a delivery. That receiver  provided us with the BOL verifying that delivery. This BOL was given to you by Cotter for full transparency. 

      Trinity Logistics listed these specific requirement on the rate confirmation- stating that 80% rate reduction if partialed. These are fees that the Customer will pass along to Trinity. These deductions were given to us by the Customer (deducted from our invoice amount) and then passed along to you. These are within Trinity’s contractual terms and conditions in the Carrier contract that your company signed with us on 11/29/2022. Having another load on a dedicated shipment is a breach of that contract. 

      It’s unfortunate that there was product with this load and these deductions have occurred, but that is between your company and your driver. 

      If you feel that reaching out to the shipper/receivers is the route in which you want to proceed, that is your choice. In that case, you will leave us no choice but to send a cease and desist letter certified via our legal department. Reaching out to shippers/receivers is a breach of contract.

      I have reviewed the response made by the business in reference to my complaint and have determined that this does not resolve my  issue. The broker company still did not provide proof nor provided a bill of lading showing my company delivered to this so called company. Trinity Logistics is making up false claims against my company.

      The shipper whom the carrier picked up the load for contacted us directly to let us know that the truck arrived to their facility with only 10' of open space on the rear of the trailer to put the product, but was supposed to be a dedicated load per the rate confirmation. The receiver also confirmed this sheet metal/boom insert were being delivered at the final destination. From the beginning, this was stressed to be a dedicated load. By partialing the load, the carrier caused delays to our customer. Per the rate con notes, we deducted pay by 80% since the load was not dedicated as required.
