My SUV's check engine light came on. I diagnosed the issue as a faulty fuel injector. My Nova warranty included that repair. I took it to my repair facility that specializes in European cars. Their diagnosis confirmed my diagnosis. Nova refused the claim. Their argument was that the crankcase was overfilled and that was the cause of the faulty injector. Owner neglect they claimed. I do my own oil changes and I follow the owner's manual scrupulously. The master technician, Eric, with over 30 years experience working with European cars disagreed. His assessment was that the faulty injector caused diesel fuel to seep into the crankcase thus causing the overfilled condition. Furthermore, he stated that Nova should honor their warranty. Nova disagreed. They still would not honor their contract. I called them and threatened to take them to conciliation court. I don't think they believed me. I then filed a lawsuit and emailed them the case number. They eventually called. I think they at first thought I was bluffing. We went back and forth and finally agreed to a settlement. They would pay for all the repairs if I cancelled my policy. They would reimburse me a prorated amount on the time left on the policy. I agreed. I did not want to stay with a company that would deny legitimate claims, even doubting the opinion of experienced professionals.

The following is an excerpt from an email to Nova from the repair shop. Nova still rejected the claim.

I’d like to clarify that while oil was present, this issue likely stems from the fuel injector being out of specification and leaking fuel into the crankcase while in the rest position. The malfunctioning fuel injector may have caused a mixture of fuel and oil, leading to the condition observed.

Given the technical nature of this issue, we believe it is not a result of negligence but rather a mechanical fault that should be covered under the warranty. We kindly request that you reconsider the claim based on this information.
