      The ***** of ********* has posted their license on Facebook.  It obviously shows that the company is licensed in the ****************.  I stand by the other portions of the complaint, but withdraw the portion about not being licensed.  I will say however, we were never presented or shown this certificate previously.

      Per your BBB site, they did not hold a license on **********.  The license that the *** provided shows a date of 11-03-2023, license number B *******.  The question here is where they actually licensed when the *** first hired this company?

      All the statements in the complaint are false and easily refuted. That is a moot point however because this is an erroneous complaint. This individual is not and never has been a customer. We have no contract with him and he has not remitted any funds to us. We have a contract with the ***** of ********* at a condo building where he is a part-time resident. He is not on the ***** of *********. He is not authorized to speak for the ***** of *********. He has no position of authority at the property. We have the full support of the ***** of *********, the majority of the condo owners, the property management staff, and the construction companies currently doing work on site.This individual has no standing whatsoever to dispute any contract that we are involved with. As such, there is nothing we can do for him as there is no way to resolve a fictitious dispute.

      I am rejecting this response because:

       

      I am an owner in the building, and although the ***** of ********* hired this company, I am paying for their services.  By all appearances, this company only received their license in November of 2023.  The *** hired this company over a year before this license was ever issued.  I do not feel I should be paying my money to this company, who was not licensed (as per BBB forum as of 06-05-2023).  If they license runs for 3 years, then obviously, they did not have a license for ********************** in 2022.  I am not on the ***, but I am paying for their services and have complained to the ***, stating they should never have been hired, and they are not providing any value to us, now or at any point in the past year.  I will stand by the statement that multiple owners have seen them sleeping in their vehicles and even confronted them.  This is of no value to the owners and the *** should immediately terminate this company. The support of the *** means nothing, as we do not believe they have lived up to their fiduciary duties.  I as an owner, have every right to dispute these charges as all owners are paying for these non-essential services.

      I have already provided my lawyer with the letter from Rising Force Security LLC. These false allegations are another case of my character being defamed, and now we have written evidence of this.  The *** has already been presented with a Cease-and-Desist letter by my lawyer, and now with Rising Security Force LLC being utilized by the *** to also defame my character, I am seeking legal actions.  I would love to testify in court about each of these false allegations and will anticipate my day to get satisfaction against these false accusers.  I will ask my lawyer to send a Cease-and-Desist letter to Rising Force Security also.  I have never threatened any violence and did not ever touch any employee of this company.  The one time that I spoke to the Brevard County Sheriff, I told the deputy, on the phone, I told him this was not true and they dropped it.  As for the other allegations, Rising Force Security has no first-hand knowledge and it is obvious to me that the *** is using them to attempt and defame and destroy my character.

      As far as allegations that I am seriously delinquent in any assessments, this is not true.  I have a pending lawsuit against the *** for this specific assessment and my lawyer recommended against paying this specific assessment until the lawsuit has settled.  I am still awaiting the settlement from the ***, and thus have not yet paid.  I told the ****************************** that I would bring this assessment current after I receive the settlement.  I was able to vote in the recent *** election and did so. I am current in all my *************** and all other assessments. We do have pictures of their security personnel asleep in their vehicles, and have even confronted them and told them that the *** better not catch them sleeping. I do have at least 20 percent of the owners who agree with me, and the others are not living in *************** and have no direct knowlegde.  I spent 6 months last year at the condo, so I definitely have first-hand knowledge of the activities.

      That letter was intended as a private communication and will never be published by us or the BBB. Unlike your emails and ******** posts. The *** had no input on the letter and in fact we haven't heard from them on this issue. All statements were 100% our opinion. We referred the BBB to the *** for any questions about our contract or performance. Not for feedback on you. We appreciate you clearing those matters up and accept your version of facts that relate to you personally. We regret any errors in our statement and retract any statements made about you as they are not relevant or productive. We will also accept your cease and desist letter as we have no desire to be involved in this conflict. We actually have no animosity towards you and no desire to disparage you. The *** isn't using us for anything other than to provide Security service. It was you who pulled us into your conflict and seem to be using us to attack the Board. We sympathize with your desire to save money and know it can be frustrating dealing with a *********** or HOA. We have never taken sides. We have treated everyone with courtesy. We were therefore shocked and frustrated to be mentioned in your mass emails along with what legal counsel has advised us are defamatory statements. We hope a cease and desist letter from us will not be necessary and that we can agree not to mention one another in the future. As for sleeping guards, you have never contacted us with concerns. You jumped straight to public messages portraying us as villains and filing a BBB dispute even though you acknowledge that you represent a small minority. I'm sure you can understand why you wouldn't receive a happy response from us. We greatly value our reputation and that has nothing to do with the ***. Construction won't last forever and we'll still be operating long after the contract at your community ends. The incident you are likely referring to involved an officer who was off duty and had already been relieved by another officer. He decided to take a nap before driving home. He is one of numerous Veterans we have hired and he knows not to sleep on duty. We advised him that he shouldn't be sleeping on a post at all and transferred him away from that site. As for the License, the previous License was up for renewal June 06, 2023. We submitted the application for renewal in April, well in advance. It took the State until November to process the paperwork. That is not our fault. The License is still valid while the renewal is pending as long as you submit the application on time. As luck would have it, the BBB contacted us about BBB Accreditation in October. As part of the vetting process they saw that the License was pending and posted that notice. We notified them when things were cleared up with the State. We have contracts all over the state and there is no way we would be operating all this time without a license as you have suggested. In closing, we are not moved by legal threats anymore than you are. It is a waste of both of our time. We now view this as a big misunderstanding. We wish you well and hope we can co-exist peacefully.
