    In September 2023, ***'s Construction came out to my house to conduct a survey to install a fence in my backyard. We were told that the work would be done in October. That never happened. We called them in November & was told that due to the heavy rains, it would take a few extra days. We gave them a week... to no avail. No updated from them for the entire month of November. When we finally spoke to them in early December, we were told that the fence would be installed on December 19th. They never showed up or called. On December 22nd, I called & sent a text message informing them I wanted a refund. I immediately received a response from the owner, ***, saying he was on his way over. I thought great!!! The fence will be installed before Christmas. He came over only to tell us that their licenses had expired but that they should have the renewed license by the following week (after Christmas) and that the work would be done on December 26th. That didn't happen!! How is it that as a business owner, you aren't aware that your license expired? And if you were aware, why weren't your clients informed of this delay. This is NOT the way you conduct business. Both myself and my husband called again, only to get their voicemail. On December 27th, I called.. yet again.. got their voicemail and left a message informing them I want a FULL refund. This is the worse contracting experience ever. I just want my money back so that I can go to a reputable company to have my fence installed.

    I am rejecting this response because: a letter demanding a refund was emailed on December 28, 2023, at which my attorney received a response stating would be issued in 10 days. That would have been January 11, ****. Today is February 8, **** & my refund still has not been issued.  The letter was also sent out certified return receipt to 3 different addresses to which they were all returned undeliverable. A small claims has now been filed against them.

    We were ready to do the installation on December 28 and they decided to cancel.  ***'s Construction & Fence LLC regrets the inconvenience caused in this situation. As stipulated in the contract, from the customer's approvals, we have six weeks for the installation. On October 27, 2023, we received the email about the approval. The months of November and December have been very difficult in terms of frequent rains, and it delay the installations. We are in all disposition to reimburse the deposit, without charging you the cancellation fee for the delay we had. But due to the material being customized we have not been able to reuse it or return it and the company have not been producing as usual due to the weather lately. We are working on having this return as soon as possible.

    I am rejecting this response because:
    Rain is not the excuse we were given  on December 26, 2023 *** himself arrived at our home and informed my husband that the reason the work had not been done is because they had allowed their license to expire  we were told that their renewal should be within that week and that the work would be done in a few days (from the 26th)  as November was a rainy month, it did not rain everyday, nor did it rain everyday in the month of December.  Again, rain wasnt the excuse we were given for the delay it was a licensing/permit issue.

    we are 2 months past the 10 days that you said we would be refunded. But you are right doesnt make sense to continue to go back & forth. We can do that in court.
