Purchased a Golf Cart from SWFL Golf Carts on March 17th of 2021. The cart had a warranty and the company would come out to service it. Since they went out of business I had to find a new company for repairs. The company I chose has detailed all these issues with the cart from faulty wiring, not hooking the axel on correctly, used batteries that were suppose to be new in my contract. Tires that had four plugs in them, I only plugged the tires once so they used old tires. I want to file this claim, not for compensation but to alert anyone if the owners ever try to open a golf cart company again.Initial Complaint

We were told the cart was on order, (but they knew it wasn't coming in.) We were expecting delivery on 12/29/2023. They told they had it and it was on the way to us. Then they said they had truck problems and would deliver on 1/2/2024. On that day they said the truck was on its way. Later in the day when I called to check on its arrival time they told me that we weren't getting a cart and gave us the number for their lawyer, who turned out to be a bankruptcy attorney. They never had the cart, and were lying to us. After multiple attempts to communicate with them, we contacted the Lee *********************** in March. They were told that "we were the next in line to get paid back." We contact them every Tuesday (per their Lawyer's instructions) and have had almost no response from them.Business Response

10/9/2023 We purchased an $18,000 street legal 2023 Honor Golf Cart from SWFL Golf carts in **************, ** from ******************* and paid in full with a wire transaction the same day. I was told they build the cart in 2-3 days and it would be delivered within 2-3 weeks. 7 weeks later, I had begun reaching out to the company to inquire about the status of our cart leaving 6 voice mail messages, without receiving any reply from anyone. 12/24/2023 I emailed **** that we'd like a refund as what was promised what not being delivered. **** directs matters to their "out of state accountant" to process the refund. We never heard from anyone.12/29/2023 I call the manufacturer, *********, and talked to the owner, *****. He informs me that our golf cart was built in 3 days but wasn't paid for by SWFL Golf Carts and that they were going to be declaring bankruptcy soon. My office manager begins to process a wire transaction recall. 12/30/2023 **** calls me now and says he has our golf cart and can deliver it right away. What? ***** told me SWFL Golf Carts never paid him for the cart, and now they miraculously have it and can deliver it the following day? I agree to take possession of the cart and stop our recall of our wire transaction. 1/02/24 The cart was delivered, 2 months late, and did not have the correct wheels or the subwoofer we ordered and even had a few rusted bolts on it. I call ***** from ********* to inquire where this cart came from, and he is just as confused as I am. 1/4/2023 I call **** and express my dissatisfaction with the cart, and asked if we could at least arrange for installation of the proper wheels and the subwoofer. He told me they would resolve this. It's now 2/11/2024 and I still have not received any follow up call from anyone in their company. Additionally, we were never delivered the certificate of origin for the cart or bill of sale so we are unable to proceed with obtaining a license plate through the ****Business Response

Good afternoon,
My name is **** and I am ****'s general manager for SWFL Golf Carts. I want to touch on ****************** complaint. This issue is much deeper than it appears to the customer (Rightly so. As we don't air our dirty laundry like ********* is airing against us, to our mutual customer) I have attached the bill of sale (which the customer has been emailed and has had access to since 10/09/2023), I received the *** from ********* (which has a similar, but different, VIN number - which is the primary reason that we have not been able to register the cart for **************.)
I'll break this down as well as I can, and as detailed as I can, and I will give you as many facts as I can. I'd like to start first with the initial purchase of the cart... ************** purchased the golf cart from me. When he originally made the purchase, I advised him (in an email) that I didn't believe that his golf cart needed to be registered or titled because he was using it in a gated community. We discussed it, and it was just my assumption based on many golf carts sales and their respective lives in gated communities. I let him know that if he planned to travel to ************, he would definitely need to register as an LSV, and he stated that it was for inside the community only.) Regardless of my misguidance, it is not my duty as a salesperson to know all the rules and regulations of each individual HOA, and I make it very clear that I am just giving my opinion. It is the customer's responsibility to be aware of the rules and regulations in their HOA. Moving on... ************** was sold a 2023 Honor 4+2, STREET (We use, and have used, this term for a non-lifted golf cart - LSV or not - since the first few months we have been open - We use this term to differentiate from "LIFTED", which has larger tires) in gray, with gray upholstery. We also added a soundbar for ************** (that he paid for) and we have yet to install a subwoofer for him (that he paid for), but we stand by our word (we have 4.9 stars on ****** with over 150 5 star reviews - and a very nasty one from **************, as he clearly has been given some bad info from ********* regarding his title process) and will install the subwoofer, or give him a refund if he prefers. With that being said, ************** got exactly the cart that he ordered. He now thinks that he ordered a "LIFTED" cart, but that is not what he was invoiced for, nor was it ever discussed, as my memory serves me. This is why he thinks he "Got the wrong cart", and I am sure that this is just fueled by the negative remarks he is hearing from ********* about us. He in fact DIDN'T get the wrong cart. Oh, I missed an issue. He was supposed to get black wheels (same style that he got, just all black instead of silver/black), and ***** - from ********* said "and I quote "We just put matching wheels on the carts that we feel are a good fit. We can't do a specific wheel on a specific cart" - and that info was relayed to **************.)
Moving on to the *** - We have the incorrect *** from the manufacturer or the wrong VIN plate is on the cart. They differ ever so slightly, but they differ. If that was corrected (and we can't correct it because ********* will not work with us anymore ***EDIT W/ UPDATE - WE NOW HAVE THE NEW VIN TAG AND *** IN HAND, BUT THE ******* DEPARTMENT OF MOTOR VEHICLES HAS LET US KNOW THAT ********* IS NOT ON AN APPROVED LIST TO BE TITLED), we would have ********** getting ************** his title. ************** has also been improperly informed that we can just give him the *** and the bill of sale (he already has that in the form of his invoice) and he can title the cart himself. We have been told that we are not allowed to do that by our local DMV office, as per law. Can someone please explain that to **************?
He is very ***et with us, and I feel like he just has had his head filled with so much negative about us, that he has a clouded view. So, realistically, what we need to happen is that we need to get this ***/VIN issue corrected, and we need Honor to do that because it is their issue (SEE AABOVE EDIT).
Please let me know if you can help this process in any way, and please reach out to me with any questions. We pride ourselves on being good people (and we have almost gone bankrupt multiple times trying to prove it), so please know that we are not some "fly by night" dealership, trying to get over on anyone. We have titled dozens of carts (and we have had our fair share of *** and downs), but we aren't scammers.

I am rejecting this response because:
My complaint stems almost exclusively from our "experience" with SWFL Golf Carts which includes... the delayed delivery of our cart by several months, the lack of communication and customer service throughout the process AFTER the sale, and their lack of cooperation to rectify the situation and make good on our original purchase. I only engaged the manufacturer, Honor, because I was not receiving any communication whatsoever from SWFL on the status of our golf cart and wanted to better understand if the order was even placed. If SWFL has ongoing issues with Honor, that is not of my concern. We chose to do business with SWFL Golf carts. Honor is one of the manufacturers that SWFL represents, their cart is what your company recommended to me, and their carts are still advertised to this day on your website.We purchased a "street legal" golf cart that has been built to all of the street legal modifications and communicated from the start that our community requires a license plate on all golf **********************.
While we would prefer just to get a full refund, we would be satisfied with the following:
- The subwoofer be installed (as ordered and paid for)
- The ***** bolts be replaced
- The correct wheels be installed
- The cooperation and necessary documentation required to plate the cart

I agreed to the aforementioned list of issues, and we are currently in the process of handling the title issue, and ************** and I have been in contact consistently about it. I think this problem will be solved amicably and I believe the consumer, and SWFL Golf Carts have come to an understanding that continued support will solve the issue.
