    A contract was signed with Delta Build Services to build a single family home for a total value of $260,000 USD over 3years ago. Delta has received payments of over $128.000 USD, has failed to pay suppliers in the amount of about $18,000 USD, see list of liens on the property and has not performed any work on the property since October 2024. No response or answer from Delta on phone calls, emails or text messages since February after an in person meeting with the owner. It is my understanding that funds for this project have been comingled with other projects. There are multiple law suits against Delta for several month, multiple builds are in the situation as mine (partial build and exposed to the weather with no progress) and Delta continues to remain in business and potentially signing contracts with new customers. I am planning to sell my property to cut my losses, and will end up about $90,000 - $120,000 in losses depending on the sell price I can achieve.

    Unfortunately this is not all factual, were are and always been more than wiling to complete the project for Mr. ****** In fact we have responded to every call, & email and always responded honestly. Unfortunately Mr. ***** decided to cancel his contract at will without valid cause which creates a material breach as there is no provision for an at will termination.

    I would also like to state that with the economy contracting in residential investments market we have seen many customers like Mr. ***** use this same method to try and cancel unfortunately it only places them in jeopardy of unnecessary lawsuits & collections and that's why we have active causes against each and every one of them that have tried. 

    There is also a balance due by Mr. ***** which he would be responsible to settle that he didn't state.

    I am rejecting this response because: Everything in that response is completely false. Communication with the builder has been horrible. Any response they have give is inaccurate and just attempts to delay things further. The contracts were terminated because Delta was in breach of the contract for several reasons. Notice was given to Delta outlining the breach and offering them time to cure. They chose not to respond. Therefore, I had no choice but to terminate the contract. The contract was already terminated before this complaint was filed, therefore I had every right to make my very true statements. The liens and lawsuit placed on my properties by subcontractors Delta refused to pay is public records. They were resolved because I paid them. Delta's claims that I owe them money are completely fabricated as it is Delta in fact that **** me. Also on public records are all the other liens and lawsuits Delta has against them. There is a clear history of unethical business by Delta that the general public should be aware of.

    Unfortunately most of what was stated if factually inaccurate. We were hired to build (2) rental homes for our customer, and we have been in communication every step of the way until they decided to cancel the contracts with no cause and owing money on each project. We have had to place liens to insure payment. 

    At this point since both of us are represented by counsel I am prohibited from stating more as its not public information. 

    I would also like to point out that this customer is also in a breach of contract for making negative statements to a third party and this will be added to the case files. 

    In closing, I would have much rather finished my business with this customer and been paid rather than going through a long and expensive legal proceeding.

    This customer has been rude and unruly from the beginning of the project. The contract language is very direct as its states that any 3rd party involvement is forbidden and it survives the life of the contact , including any feeble attempt to cancel for not wanting to pay there open invoices. In the contact it also states that this a cure to any incidence, this was never formal given to us. Either way this is an active case in the courts and once all the evidence is produced we will prevail.

    I am rejecting this response because: the business owner continues to respond with completely false information. He has no interest in resolving anything or owning up to any of his wrongdoings. He steals from honest hard-working people who have entrusted him with their life savings.

    I don't understand as both properties are in production and the owners receive updates on a regular basis. Regarding payments on the projects we are not even 50% , so I don't understand what the expectations are here. 

    Also the contact that was executed specifically state's that the owner is not allowed to make 3rd party claims or statements. 

    (D) Owner shall not make or publish any false statements to any third-party regarding the
    CONTRACTOR, its business and/or the construction of the home or the property, either verbally or in
    writing, which shall specifically include, but not be limited to, any written statements made in any
    electronic format or made through the use of social media or on any website. Owner acknowledges
    and agrees that any breach by Owner of the foregoing provision prior to Closing shall be deemed a
    material breach by Owner and shall entitle CONTRACTOR to declare Owner in default of this
    Agreement. In the event that Owner makes or publishes such false statements after Closing or after
    the termination of this Agreement, CONTRACTOR shall be entitled to any and all remedies available
    at law or in equity. This section shall survive the termination or closing of this Agreement.

    I would suggest that the owner withdraw this complaint as they are liable for this action.

    i have been emailing back and forth with the company that handles the home warranty for delta build in my complaint about well filter system being defective and they keep stating that its not there problem

    As we do not know who this person (Diosnany ****) is , we are requesting this complaint be deleted from our good name, Delta Build Services Inc.(DBSI). We fulfilled our contractual obligation with ******, that we built this home for with no issues and obtained a Certificate of Occupancy on 1/8/2024, almost 9 months ago. We (****) have had no warranty claims to date from the original owner (******).

    In an effort to be through **** has done some research on this project, and it seams as the original owner (******)has recently sold the home to this owner and transferred the warranty. The new owner does not understand the difference between a warranty item vs a maintenance issue.  I will have my team resend the warranty documents to them so at least they can familiarize themselves with the process for warranty. We feel this will also help them determine maintenance vs warranty in the future.

    In regard to their claim, they state that there is salt in the water, that would be correct as salt is used to stabilize the water in the water systems processing. It was also mentioned that the timing of the release for the system may be out of sequence as with the power outages during storms this would need to be reset on a regular basis. Again, this is maintenance and not a defect component. There was a recommendation that the new homeowner contract with a water system maintenance company because they are unfamiliar with the equipment and the processes. In the event that something comes up that is warrantable at least it can be diagnosed by a professional tradesman to make the claim process faster.

    We appreciate the BBB in handling this and look to see it resolved and removed promptly.
