April 26, 2023, we entered into a contract with Marconi Line. ***, owner, was supposed to dismantle our patio roof and install a new one. He was going to extend one wall to give us a smoother look. When they began installing the panels, I informed, ***, you could see sunshine through the panels. He said it was alright, because he was not done. I have photos. His people placed the panels and tore down our wall. Well, he re-erected our exact same wall and put the pan roof outside where the new wall was supposed to give it support. Now it is out there like the Flying Nun's hat, blowing in the wind. While installing the column for the exterior wall, they cut it too short. They glued it with an inch and a half of caulk. I have waterfalls in the aluminum, leaks in all of the panels, and excuse after excuse as to why they are there. He is blaming my old roof. Here is the thing, I had to have my roof inspected by an insurance company so I could get Homeowners insurance. I had five roofing companies along with the state inspector crawling all over my roof. *** still said it was my roof. Well, I got another roofer, and he was shocked at what he saw. All of the tape *** and the boys applied was bubbling up and had dirt under it. The flashing he finally installed was not applied properly. We have over 40 photos taken by the professional roofer showing all of the mess. We were trying to get *** to fix this for almost five (5) months. We cannot use our patio. Our summer is ruined. I do not trust this man. In one of his emails, he said he took this job because he thought we were nice people. Does that mean we would not get upset?! I want a refund. Remember, too, he charged us for a wall that he did not even build!

In late April *** ******** contacted me because his aluminum roof had collapsed. When I first viewed the area and the problem my first instinct was to leave and never come back because it was such as disaster. I overrode my first idea since they seemed nice and had a problem. I then sent my crew to support the leaking roof and figured a price to demo the roof and replace with new.

My crew did not like the looks of the area and cautioned against getting involved with replacement. Against better judgment I accepted a contract with them. Since then there has been nothing but confusion about what the contract involved and the customer constantly trying to verbally demand items beyond the scope of the contract and quote things I never said. In addition their roof overhang over the composite roof we installed is rotted and leaking causing the composite roof we installed to leak. My understanding was they were having the house re roofed and this would be corrected. They only had the garage roof replaced and left the ramaining worn out roof in place.

We followed what was on the contract and installed the screen walls, 7" super gutter and composite roof. They have constantly ignored my suggestion to get the roof overhang replaced and continually complain about the leaks it is causing while at the same time demanding items not covered by the contract. Every visit to the house has resulted in new demands, insults and offbeat comments.

The customer has not paid the contract balance saying the installation is not to the contract when it most clearly is.  I feel I have been conned and they are seeking this installation for free to have money for other projects. The installation is now out of warranty with an owed balance.

It seems impossible to please this customer so we have ceased trying.

I should have followed my initial instinct about this job.

This is the rotted, leaking roof overhand causing the problem.

    Customer Answer

Alright, I have read his response.  First, I want to say, yes, he is right, our aluminum roof of 40 years did cave in.  Yes, it was not a pretty sight.  We contacted him because aluminum roofs are his business, or so we thought.
Being in business, attempting to give quotes for work, you should not get involved in a project you cannot do.  I do not care what your "feelings" are for a customer.  If you proceed and discover that it is over your head, you do something about it, in the beginning.  This disaster, as he calls it, was a roof that had fallen in under the weight of water.  He repairs roofs, he installs roofs, or so he claims.  All he had to do was remove the old one, which was practically down, and install a new roof, one that does not leak.  Prior to him beginning, we had the section of the main roof, shown in the original photo, repaired completely, by a separate roofer. That is an old photo.  Then. his crew came and began installing the metal panels.  Immediately after the second panel was in place, I noticed an opening where one could see daylight in between the panels.  I took a photo and told ***.  *** said he wasn't done, he had to patch it.  I thought it was strange because those panels clip together and there is never supposed to be daylight.  I even called the manufacturer, ***** *** ******* Industries.  They were very adamant that indeed, there was to be no daylight.  I told *** but he did nothing. Everything continued.  *** removed our aluminum screen wall, which was perfect.  What they erected was a mess. I have an aluminum column cut too short.  Well, they glued it together leaving poor stability.  They put caulk in the major gap.  They were to cover a gutter, they did, with two pieces of aluminum and screwed it together.  It leaked like a waterfall.  After pointing it out, they sprayed Flex Seal on it.  On our new 7" gutter, they put screws through the bottom.  That means, it leaks.  All of the panels, where they join, leak.  He placed a panel outside of the screened in patio and it now flops around like the Flying Nun's hat!  No support.  I was told it is a danger to our dwelling and a danger to us should we get hit by it during a wind or rainstorm.
Eventually, after our complaining about leaks and waterfalls, *** wanted us to get additional roofers to look at this particular spot on our roof, he claims had issues. Prior to his beginning, our insurance company cancelled us because we did not want the hurricane portion of our policy.  Well, to get new coverage, we needed to have the State Inspector check out all of our roofs.  He inspected everything.  We did need a new flat roof for our garage and office room.  We had three roofing companies come to look and quote us.  Nobody discovered ***s's roofing issue.  After all of this was said and done, the only person to have an excuse was ***.   He said multiple times get it inspected.  Well, that was truly his downfall.  I had two roofing companies come out to look, again because of him.  The consensus was that we were swindled, they did not find any of ***’s issues.  The photos I have provided were mainly from one company.  The other gentleman said that whatever he could do to help us out in court, he would be there for us to testify.
I find ***'s letter insulting.  He claims that we were difficult to deal with regarding our demands, insults, and offbeat comments.  I would appreciate him telling me what he is talking about.  He made the claim he had been conned.  View all the photos and tell me who has been conned.  He claims I want our money back so that we can perform other projects. We need the money reimbursed so that we can have somebody reputable, install a working roof, one that does not leak, have waterfalls, and pose a potential danger.
My husband, throughout all of this, was going to have another heart implant.  He has CHF.  Our dream was to be able to utilize our pool and patio for beautiful memories.  *** and his crew took that away from us!  How dare he attempt to turn this into us being a bully.  In addition, he has now placed a lien on our home.  He wants an additional $2,928.00.  Why?  Our contract, which I provided had four payments of $2,875.00.  ******** ******* paid it all, too prematurely, I might add because, *** never finished the job and charged for it.
