    Business Response

    Date: 02/02/2024

    Dear concerned parties,

I am writing to address a concerning situation in my business relationship with the new management at ***** Condo. My name is ***************************, the owner of Golden Tech Group, and I have been working with ***** Condo for over six years without any prior complaints.

Recently, I received a complaint from manager ************************* that contains misinformation. I want to clarify the situation and better understand the events.

Approximately one year ago, the previous board members and I embarked on a project to install an Access Control System for the entry gates of the building. As per the approved invoice from the board, I had to wait approximately six months before commencing my role, as another company was responsible for installing the metal doors and electrical motors.

Once the installation of the metal doors and electrical motors was completed, I could finally begin running the data cabling for the project. However, the doors were not functioning correctly, so the condo failed city inspections. My company stepped in to rectify the issue when the other contractors disappeared. The condo failed inspections twice due to structural problems caused by other companies involved.

During this period, my company had to wait to finish the job, which entailed the installation of the access control panel and data setup. After nearly a year, during which I continued to provide network maintenance for the building, the condo finally passed the inspection.

The misunderstanding arose when I requested a two-week extension to complete the job. At the time, I had two other projects to complete for different clients and required time to rearrange my schedule accordingly. Both ************************* and *************************, the regional manager of the management company, confirmed that it was acceptable for me to take the two weeks. However, to my surprise, I received a disturbing letter demanding the return of the money for the job, even though the cabling structure and network setup were already completed.

I possess evidence demonstrating my attempts to reason with the management to allow me to complete the job, yet I did not receive any response from them. Having been in the business for nearly 20 years and working with numerous building and business companies, this is the first time I have encountered an issue like this. My company always strives to maintain a professional approach and intends to complete the job. Unfortunately, they are not willing to cooperate for reasons unknown.

I also want to highlight that I previously worked for the previous board of ******************** for six years and completed multiple jobs without encountering any issues.

I am more than willing to provide any additional information or evidence that would assist in resolving this matter. I sincerely hope we can find a mutually beneficial resolution to this dispute.

Thank you for your attention and assistance.

    Best regards,

    ***************************
    Owner, Golden Tech Group

I am rejecting this response because:

Attached are emails from September 2023 sent to Golden Tech Group regarding the installation of the garage gate access system.  He was given more than six weeks to install the garage gate access system.  *************** attorney sent a letter on November 10, 2023, to Golden Tech Group to return the funds paid for the gate installation and gate camera installation that was not performed.  Also, Golden Tech Group was given a 30-day notice of the termination of the monthly contract on November 10, 2023, since the other projects for the manager office door and maintenance door mag locks were started in early 2023 and were never completed.

*************** has to hire another vendor to supply and install a garage access system.  *************** had to spend over $5,000.00 to replace the *** equipment owned by the association and several calls to ****** to contact the software company to relinquish his rights and to give access to the association.  He verbally informed ************************* on a phone call that he would contact the software company and give the association access to the system.  His verbal agreements were also not honored by *************  *************** was unable to access their own equipment.  After the termination letter was sent, our *** system no longer worked, and the user ID was removed from the valet system.  He was the only one that could access the system remotely and the only technician that serviced the cameras and door access system.

****** was given so many chances to complete the work that he was already received the full payment.  He always had an excuse and continues to make excuses for failing to perform his obligations.

    Sincerely,

    *************************

    Dear Parties Involved,

I hope this email finds you well. I am writing to address the concerns raised in the previous email regarding the *********** and the gate access control system. I want to provide accurate information regarding the timeline of events and clarify any misunderstandings that *** have occurred.

The email in question, which contains information about the *********** and the city inspection, was sent to my company email two days before I attended the ****** to fix the gate. Unfortunately, due to unforeseen circumstances, I have not had the opportunity to access that email until now.

On September 28, my company, Golden Tech, addressed the issues with the ***********, unaware that it had already passed the city inspection. It was on September 28 that I became aware of this after hearing about it through word-of-mouth. Immediately upon learning this information, I approached ***** in the manager's office to discuss the schedule and finalize the door projects. During this conversation, we verbally agreed to a two-week grace ****** for me to complete my ongoing projects with other clients.

However, to my surprise, a week later, I received a notice of cancellation of my maintenance agreement with your company. I promptly called to address the situation and propose the completion of the job, but unfortunately, my attempts at reasoning were met with refusal. The mention in the previous email about your company hiring another company stemmed from the fact that you canceled our agreement without prior notice and in bad faith. Additionally, you sent letters requesting a refund without any reasonable grounds or facts to support your claim. I am more than willing to discuss and address any concerns or issues. Still, it is unreasonable to expect me to answer questions about equipment installations and passwords from five years ago, mainly since I had already provided that information to the previous board.

Considering the circumstances, I must clarify that after the cancellation, I do not have any obligation to answer calls from your management. However, I have always been willing to assist where possible despite the constraints imposed upon me. As a human being, it is only natural that I *** forget a password created for the previous management five years ago.

It was essential to bring these facts to your attention to ensure that the situation is viewed accurately and that any misunderstandings are cleared up. If you have any further questions or concerns, please do not hesitate to reach out. I remain committed to resolving this situation fairly and reasonably.

Thank you for your attention to this matter.

    Sincerely,

    ***************************

I am rejecting this response because:

The property manager contacted ****** with Golden Tech by phone and informed him the garage gate passed inspection prior to September 28, 2023. ****** reports in his previous response that we agreed to a two-week grace ************* The thirty-day termination letter was sent on November 8, 2023.  Two weeks is fourteen days and the number of days between September 28, 2023, and November 8, 2023, is forty-one days (five weeks and six days).

***************'s attorney sent out a 30-day notice of contract cancellation on November 8, 2023, which stated in the letter the contract is cancelled effective December 8, 2023.  No one from Golden tech would answer or return our phone calls for service requests.

The response from Golden Tech also stated the previous board was given the passwords which is incorrect.  They were not given the passwords for the systems.  Golden Tech Group installed the camera and access systems and the only company to have remote access.  Golden Tech had total control of our camera system and when our new vendor and the property manager contacted ENS Security Cameras for access they were informed that Golden Tech Group is the only company that can be given any information regarding the passwords.  Also, someone removed the User ID from the valet camera system and Golden Tech Group was the only one that had access per ENS Security Cameras. The camera system is the property of the association.  *************** had to pay over $5,000.00 to change the DVRs for the camera system.

Golden Tech Group was paid in full several months in advance by the previous board president who hired him originally to install the building new camera and door access system. They didn't honor their agreement and continues to make excuses.  The regional manager ************************* also called ****** several times to schedule the installation of the garage gate access system.  ****** also was unable to secure a date from ****** for the installation of the system.

The ******************** board of directors doesn't want to speak with ******, they want a refund of the money paid for the garage gate access system that was never installed.  ********* of directors wanted the property manager to contact the Better Business Bureau regarding Golden Tech Group business practices.

The only resolution is for Golden Tech Group to refund the money that was paid for the garage gate access control system that was never installed.  If Golden Tech Group refuses to refund the money there is no reason for anymore communication with Golden Tech Group.

    Sincerely,
