    Hired this roofing company to replace my roof on a residential property. During the demo phase, a large dumpster was delivered to the property caused some damages to the driveway. I was seeking a resolution (repair or compensation), but the owner refused to address the damaged driveway and threatened to a lien on my house.

    Good evening,
     Shield Proof Roofing hired a third party by the name of J& A Waste Corporation. They should be the ones to be contacted at **************
    since they positioned and removed the dumpster from the pavement. 
    As you can read on page 2 of the signed contract the highlighted area stating Shield Proof Roofing is not responsible for lawn, driveway, sidewalks or pool damages.

    There was obvious damage to the driveway when they delivered the dumpster container and Shield Roofing continue to avoid taking responsibility or offer some type resolution. The owner was not apologetic nor offered some monetary compensation for the damages.

    We cannot place dumpsters on the road or impeding sidewalks. We prefer to place the dumpster in your driveway. 
    If you chose to place the dumpster in another area, we are not responsible for any damages past the curb line. 


     J & A WASTE CORP WILL NOT BE LIABLE FOR ANY DAMAGES PAST THE CURB-LINE. INCLUDING WATER MAINS, GRASS, DRIVEWAYS, IRRIGATION SYSTEMS, UNDERLYING SEPTIC SYSTEMS , ANY UNMARKED OR UNSTAKED   UTILITIES.




    J & A Waste  is Responsible for TRANSPORTATION OF CONTAINERS ONLY
    Customer is SOLELY RESPONSIBLE FOR PROPER LOADING AND SITE MAINTENANCE, INCLUDING, KEEPING AREA AROUND CONTAINER FREE AND CLEAR OF ANY AND ALL OBSTACLES, HAZARDS OR DEBRIS THAT MAY CAUSE ANY INJURY AT ALL TIMES 



    IT IS UNDERSTOOD AND AGREED THAT  YOU (CUSTOMER) ARE UTILIZING DUMPSTER AT YOUR OWN RISK AND ASSUME LIABILITY OF USE .

    I am rejecting this response because:

    This Company was subcontracted by my roofer and I received no such disclosure. Please have them provide proof I received such disclosures. Doesnt make sense I would allow them to put a dumpster on my driveway without protecting the concrete. They are responsible for the damages whether they like it or not.

    This is a case between the owner and the subcontractor  Shield proof and TakTang 

    Shield proof is our customer and was provided the documents many times as they do business with us often.

    Our contract clearly states that Shield proof is responsible for dumpster usage and we are not responsible for any damages to driveway through we always lay wood down for protection but unfortunately the load of the dumpster was very heavy which is what caused the damages

    I am rejecting this response because: Both companies are continuing to blame each other and no one is taking responsibility. If the dumpster company was sincere about their client's properties, they should have every effort to prevent property damage, like my driveway. If the dumpster is heavy as they said it is, why don't they place plywood or a protective barrier like other companies do?
