I was misinformed and lied to by the attorneys and staff at van horn law group(***************). They lied to make me a client and file a ch.13 bankruptcy. I have emails from staff giving me false information and one person telling me this and another a different story. I was told all debt would be discharged, but after I filed, they told me only parts and only half of my items were included. I have dismissed the ch.13 bankruptcy, but its still on my record. If they would have told me that they couldnt help, I would have never signed up, now Im stuck with a messed up credit report and have spent thousands in court and trustee fees for nothing.The bankruptcy should be erased from my record.Business Response

I filed bankruptcy with this firm. A week before it was discharged, I received a call about my car, which, from the VERY beginning, I had made very clear that I was keeping. I called them back, the young lady asked a vague question about keeping my car and hung up. November 13, 2024 my bankruptcy was discharged. November 22, 2024, my car was repossessed. Turns out a letter that was supposed to be signed by me was NEVER sent to me. I received the letter on November 25th, signed by Mr ******** on the 22nd. The letter was from the banks attorney dated AUGUST 2, 2024. I never received this letter. Though I was ahead of my car payments because the bank didn't get this letter back, they took the car thinking it was part of the bankruptcy. The law firm then takes 2 weeks, trying to figure out how to fix their mistake. Mind you I have no car, buying rides, my son and I losing pay trying to fix this and all I'm getting is we're trying. Finally, after 2 weeks of trying, they say they finally have the bank's attorney agreeing to letting the case being reopened and to have my car removed. I asked how long this would take and she said she wasn't sure. I still had NO CAR. And no one was taking responsibility. They did give me $100 back of their fee. ****! My son and I lost nearly $5000 worth of stuff due to their mistake. I can give you a list of all that was incurred because of their mistake and they give me $100.Business Response

I am rejecting this response because: They are the ones that caused me to not only lose my car but the $3000+ that I had put into the car the month before! For two weeks after the incident, all I got was we're trying to and no one cared that I was having to beg and borrow to rent a car ($250) and pay people for rides ($25.00) and at the end of the two weeks, there was still no date as to when I would get my car back. The answer was it depends on the judge's schedule. My ** was at stroke level. I was puking daily and I could not deal with! And they waived the last payment of $100. Well, thanks...that's the very least that should have been done! I would like at least $250.00 back.

I paid for the entire bankruptcy. My license was from out of state. They told me I had to get a Florida license. They lied and said they couldnt file federal bankruptcy. Thats a lie. The ******** office confirmed the could. Its been a year and a half and every time I contact them, it goes to voicemail. Then they keep requesting more documents, which they already have. They are purposely defrauding me. I want my money back.Business Response

I reached out to ************ group last fall wanted to file bankruptcy during the time I had lost my apartment and wasn't able to keep my job because of serious health challenges and I had to go through a major procedure. I had depleted my savings and paid them about $604 I told them I was unable to pay the entire amount which was over $1000 due to the fact I couldn't work I was still recovering. After more than 8 months I decided not to go through with the bankruptcy anymore because I found a way to repair my credit and asked for a full refund they denied the refund and said it will be a credit for the future on my account which will not help me because I won't file for bankruptcy anymore. They told me that an attorney was going to call me I've waited for the attorney call no one calls. I called back one gentleman told me I was put on the attorney calendar but he didn't call. I have no source of income I'm still waiting for disability for the past 8 months I still have more procedures to do I need the funds to be refunded immediately.Business Response

After retaining services, circumstances changed and I spent MONTHS emailing and trying to figure out how to determine what needed to be done to terminate proceedings. No paperwork was ever filed. Nothing had proceeded, so FINALLY I was set up with a phone call with Attorney ***************** to discuss termination of the retainer and any potential refund. I was told in my brief conversation that since nothing had proceeded or ever been filed that I was *********** a full refund and paperwork would be sent to do so. I am now told 2 weeks later that I will NOT be getting any refund, partial or full, but instead will have a credit for any future needs. I was even told that no mention of such refund was ever made.I fully understand retainer, contract, etc. But at the end of the day, if I'm not using services even a partial refund would be appreciated.My dealings with them have been a mix of unprofessional and dismissive to non communication and lack of explanation. Numerous emails not returned at all or returned with scripted responses.I accept any naivety on my part as I retained services under duress. I'm hoping for a better resolution, but just know when retaining this firm...buyer beware.If I don't end up with a refund of any sort then apparently I have a "credit" for attorney services that I will likely never need to render.Business Response

I spoke with the firm about closing my case, since it has not been filed with the courts. The attorney, I spoke with assured me that he will send me a waiver and refund all the money I paid. I have been reaching out to the company by email and no one has responded. It doesn't take this long email a waiver or to follow up on your promise. The reason I am closing the case with this company, is due to their inconsistency. They take a long time to reply and makes your feel as if you are the problem. All I want is what was promised to me before they try to charge me again after I have spoken with them about closing my case. I would like for this company to take a few seconds out their time to send over the waiver and process the refund as promise.Business Response

On March 25th I had a consultation to file chapter 7 bankruptcy. I was told I had an easy, straight foward case. On April 14th I signed documents and paid $388. I was then given a list of documents to provide, paperwork to fill out, and a credit councilling course to complete by the end of the month. I completed all the requirements and sent all the requested documents by April 27th and recieved an email saying my case would be assigned to a lawyer and filed within 2 weeks. The entire month of May went by and I heard nothing. I sent emails on May 13th, May 26th, and June 2nd that were all ignored. I then finally just decided to write a ****** review of my experience. I got a call almost immediately and suddenly my case was worked on and I was asked to remove my review so I did. Over the next 2 days I was sent a draft document for review and someone called me to discuss my documents. The documents had multiple errors thay needed to be fixed and I had to send some additional documents. On June 6th one of the assistants called me and said I was actually ineligible for filing chapter 7 so they were not filing my case. At that point I had been making payments on the payment plan and had paid $696. After that phone call I did not hear from anyone, but was then charged another $308. Around June 28th I asked for an invoice and explanation of what I'm actually paying for and I requested a refund of services not rendered. I have not recieved either. I have paid $1004 to the law firm for a chapter 7 bankruptcy and my case was not filed. Attached are screen shots of unanswered emails, requests for refund, proof of the 3 payments they have recieved me (totaling $1004.00), and a copy of invoice that says I am paying for a chapter 7 bankruptcy. And again, nothing has been filed. At this point I have no interest in working with this law firm and my only expectation from them is a refund.Business Response

We've made numerous attempts to communicate with ************** through various channels, including phone, text, and email, in an effort to address and resolve her concerns. Substantial time and effort have been dedicated to her case, including the creation of the petition, collaboration to gather necessary documents, and attorneys had calls/reached out to her. As stipulated in the retainer agreement, refunds are not granted.
However, we have decided to make an exception in this case, and ************** will be receiving a refund for the amount she has previously paid to us. If she does not have it within 10 days please let me know.

I contacted this law firm for a chapter 11 bankruptcy and paid a deposit. I explicitly told them that I wasn't ready to file yet. When I was ready I emailed them and didn't hear back. I am no longer filing and want my deposit back. They stated I needed to sign a form to cancel which isn't true because there was no filing.Business Response
