      On October 9, 2023; Caloosa Bayview Condo Assoc. Phase A terminated Infinity Accounting Group (Nicholas G********) as our CAM and Accountant. This was an immediate termination, not a 30 day notice. He did, however, agree to continue to make payments as needed until we made arrangements with the bank for 2 board members to manage the accounts. On November 1, the board removed him from the accounts and have been paying bills. Many were over 90 days overdue. Late Fees have occurred for several accounts. As of today, 11/27/23, we have not received any of the final financial statements, tax records, etc. to be able to complete the transition to our new management company on 12/1/23. According to the Florida Administrative Code: A licensee shall not withhold possession of any original books, records, accounts, funds, or other property of a community association when requested by the community association to deliver the same to the association upon reasonable notice. Reasonable notice shall extend no later than 10 business days after termination of any management or employment agreement and receipt of a written request from the association. He has also neglected to provide the records to our joint recreation center, which terminated his contract on 10/15/23 . Our CAM contract states $300 is due at the time of transfer of records. Our accounting contract states $200 is due first, then items will be released. We would gladly pay this if he would deliver what is required. Even though we have acquired well over $1,000 in late fees on bills. It shall be considered gross misconduct, as provided by Section 468.436(2), F.S., for a licensee to violate the provisions of this subsection.
