We had the concrete surrounding our pool removed and new pavers installed. In the process , Able and Willings employees broke some pool pipes which our pool contractor repaired. Able and Willing has refused to pay for the broken pipes. Their employees were careless in removing the concrete and leveling the surpface in preparation for the pavers. We also gave *************************** (Able and Willing) a small punch list which as not been completed. Able and Willing received their final payment on 11/1/22. We have contacted him more than once with no response.

    Business Response

    Date: 01/27/2023

This response was taken verbally by BBB:

Per our contract we are not responsible for underground utilities, landscape lighting, etc. We removed the customer's concrete, normally it is 4" thick, however, this customer's concrete, based on age of house and area, was *****" thick with footers in the planter area making it 15" thick. When the pool company was finished with their work, a leak was discovered. The pool contractors removed the pavers so they could fix the leak and we reinstalled the pavers at no charge, but we will not pay to repair damage to underground pipes. The punch list is 1 item and was sent to us on January 1st, when we were out of town for the holidays. We have been in contact with the customer to address the punch list item as well as to make minor corrections to the planters that we were not happy with and pointed out to the customer.

I am rejecting this response because:
His crew broke the pipes when removing the concrete or when leveling the ground.  Due to the thickness of the concrete we paid additional money which ********************** stated he needed for a generator for the concrete removal.  They were aware that there were pipes under the concrete.  Even our pool contractor was in agreeement that he was responsible for the repair.
We believe the crew was reckless in their work and therefore broke the pipes in a few places.

    Sincerely,

    Rich And ***********************
